1Among these domestic sources of Slovak law, which has the highest legal force?
A.An NBS measure (opatrenie)
B.The Constitution of the Slovak Republic (Ústava SR) and constitutional acts
C.An ordinary statute such as the Securities Act
D.A government regulation (nariadenie vlády)
Explanation: The Constitution and constitutional acts have the highest legal force among the domestic sources listed. Ordinary statutes and subordinate legislation must conform to them.
2Which distinction between a financial agent and a financial advisor follows from Act No. 186/2009 Z. z.?
A.Agents are paid only by retail clients; advisors are paid only by product providers
B.An advisor may receive provider commissions if the client signs a disclosure
C.Both roles are legally identical whenever they discuss the same investment fund
D.An agent intermediates under its institutional or agency relationships; an advisor provides impartial analysis under a written agreement with the client
Explanation: The Act distinguishes financial intermediation (finančné sprostredkovanie) from financial advisory services (finančné poradenstvo). A financial advisor acts under a written client agreement and must base advice on impartial analysis; disclosure alone does not permit provider remuneration.
3Which Slovak authority supervises capital-market financial intermediaries and maintains their sector register?
A.Ministerstvo financií SR
B.Protimonopolný úrad SR
C.Národná banka Slovenska (NBS)
D.Slovenská obchodná inšpekcia
Explanation: Národná banka Slovenska supervises financial intermediation and maintains the financial agents and advisors register. A ministry's legislative responsibilities or another body's general consumer or competition role does not make it the intermediary supervisor.
4Where should a client check an intermediary's registration for the capital-market sector?
A.Only the Commercial Register (Obchodný register)
B.The Central Register of Contracts (Centrálny register zmlúv)
C.The NBS Register finančných agentov a finančných poradcov (REGFAP)
D.Only the Trade Licensing Register (Živnostenský register)
Explanation: REGFAP records financial agents and financial advisors in sector sub-registers. Checking the actual sector and category matters: a general company registration does not establish authority to intermediate capital-market services.
5A finančný poradca under Act No. 186/2009 Z. z. is offered a product-provider commission for a recommendation. Which response follows § 32(5)?
A.Accept it if the client approves in writing
B.Accept it if it is paid to the advisor's company rather than personally
C.Accept it if it is described as reimbursement rather than commission
D.Decline it because remuneration for financial advisory services may come only from the client
Explanation: Section 32(5) prohibits a financial advisor from receiving monetary or non-monetary benefits for financial advisory services except from the client. Renaming a payment or routing it through a company does not change its substance.
6A podriadený finančný agent (PFA) already has a written agreement with one samostatný finančný agent (SFA). May the PFA simultaneously contract with another SFA for a different sector?
A.Yes, provided each contract covers a different sector
B.No; § 9 of Act No. 186/2009 Z. z. limits simultaneous written agreements to one SFA
C.Yes, provided both SFAs disclose their commissions
D.Yes, if the PFA maintains separate client records for each SFA
Explanation: Section 9 limits a PFA to a written agreement with at most one SFA at the same time. The restriction is not expressed as one SFA per sector, so allocating different sectors to different SFAs does not resolve it.
7An obliged entity identifies a client's beneficial owner as a politicky exponovaná osoba (PEP). What is the appropriate response under Act No. 297/2008 Z. z.?
A.Use simplified due diligence because the person's identity is public
B.Apply ordinary identification only unless a criminal conviction is found
C.Apply enhanced due diligence, including the required approval, source-of-wealth and source-of-funds enquiries, and enhanced monitoring
D.Treat every transaction as automatically criminal and close the relationship solely because of PEP status
Explanation: PEP relationships require enhanced due diligence under § 12. This includes the prescribed approval before establishing or continuing the relationship, information about the origin of wealth and funds, and ongoing detailed monitoring; PEP status alone does not establish criminal activity.
8After reporting a neobvyklá obchodná operácia (NOO), an employee is asked by the client whether a report was filed. Which response respects the confidentiality duty in § 18 of Act No. 297/2008 Z. z.?
A.Confirm the report after obtaining the client's confidentiality undertaking
B.Confirm only that a report exists while withholding its contents
C.Confirm the report after the employee leaves the firm
D.Do not disclose the report to the client; follow the firm's lawful AML communication procedures
Explanation: The confidentiality duty covers disclosure of the report and related Financial Intelligence Unit measures to the client. It continues after employment ends; statutory channels for lawful disclosure do not create a general right to alert the client.
9Under § 19 of Act No. 297/2008 Z. z., what is the ordinary retention period for customer due diligence records after a business relationship ends?
A.One year after the account was opened
B.Five years after the relationship ends, subject to a lawful extension
C.Four years after the intermediary's most recent professional exam
D.Until the next annual financial audit is completed
Explanation: The ordinary AML retention period is five years after termination of the business relationship; the legislation also covers records of transactions outside such a relationship. The Financial Intelligence Unit may require further retention for a specified period of up to another five years.
10A fund advertisement prominently says '8% last year' but obscures the risk warning and ongoing costs. Which review conclusion best applies the financial consumer information requirements?
A.It is acceptable whenever the historical percentage is arithmetically correct
B.It is acceptable if the full fee schedule is available only after purchase
C.It can be misleading because information must be clear and balanced, including relevant risks and costs
D.It becomes acceptable if described as educational material while still promoting the fund
Explanation: A factually correct return figure can still create a misleading overall impression. Financial information and identifiable marketing must give clients a clear and comprehensible account of relevant risks and costs rather than obscure them behind a performance headline.

NBS Capital Markets Intermediary Exam (KT): Suggested Study Strategy

1Distinguish the legal roles of finančný agent, finančný poradca and viazaný investičný agent. Check the applicable sector and role rather than assuming the same competence requirement for every employee or principal.
2Separate suitability for advice and portfolio management from appropriateness for other services. Study the specific execution-only conditions rather than treating every listed instrument as exempt.
3Distinguish the manager, fund depositary and central securities depository. Asset segregation and compensation schemes do not guarantee investment performance.
4Work through current yield, NAV, compounded and real returns, costs and duration calculations. State fee bases and return denominators before calculating.
5For Slovak tax questions, check acquisition and admission periods separately, distinguish sale from fund redemption, and identify the profit period for dividend rates.
6Use the current organizer's questions and NBS rules for the selected sitting. The official scope has 14 capital-market topic headings; our five practice categories are study groupings.

Frequently Asked Questions

Which assessment does this practice cover?

It supports independent study for the medium and higher professional-competence examinations in the capital-market sector. These are written knowledge tests administered by NBS-authorized organizations. The highest-level odborná skúška s certifikátom for financial advisors is a separate written-and-oral assessment; this bank does not simulate that oral examination.

What is the current official test format?

Under the NBS examination rules effective 1 May 2026, each sector test has 5 general and 25 sector questions, each with three options and one correct answer. The time limit is 25 minutes, and at least 24 correct answers are needed. The ordinary medium/higher test has no additional oral, practical, assignment, or separately assessed case-study component.

What are the fees and official language options?

The fee is €50 per sector in Slovak or €200 in another offered language. AOCP currently advertises written-test options in Slovak, Czech, English, Hungarian, German and Ukrainian. Confirm the selected language and communication arrangements with the organizer when booking; language options are not separate exams.

Does passing the exam alone qualify me to practise?

No. Medium competence in capital markets requires at least secondary vocational education, one year of relevant sector practice, special financial education and the exam; higher competence requires at least secondary vocational education, three years of relevant practice, special financial education and the exam. Annual special financial education and successful examination at least every four years are ongoing requirements. Section 21(14)–(15) provides a limited supervised route for specified roles, generally for at most one year. Registration or authorization requirements also apply. These are professional-practice requirements, not a claim that all must precede booking an examination.

Does GFI protect against investment losses?

Garančný fond investícií covers protected client assets that become unavailable at a participating institution under the statutory conditions, up to €50,000 per eligible client. It does not compensate ordinary market losses or an issuer's failure to pay its own securities merely because those investments were held through a broker.

Is this an official NBS translation or exam simulation?

No. OpenExamPrep provides independent English-language MCQ study adaptation. The bank uses four options while the real test uses three. It preserves relevant Slovak terms but is not an official translation, an official-format or language-environment simulation, or a substitute for required training, professional experience, or performance practice.
