2.4 Surety Bondsmen: Producer Authority, Appointment and Qualifying Power of Attorney
Key Takeaways
A West Virginia surety bondsman must hold a producer license with property and casualty authority or limited lines surety authority (114CSR103-2.11).
Surety bondsman applicants must give their National Producer Number, a notice of appointment from each insurer and a qualifying power of attorney (114CSR103-3.2.2).
The OIC says the limited lines surety line of authority requires no examination and is applied for through NIPR.
Insurers must report bail bond liability quarterly, by the 15th day after each calendar quarter (114CSR103-15.3).
Before July 1 each year, every insurer must give the Commissioner a list of all surety bondsmen it has appointed (114CSR103-15.4.1).
Outline items II.D (Surety bondsman: company appointment, qualifying power of attorney) and II.F (Appointment) cite W.Va. Code §51-10-8 and 114CSR103-3.2.2. The surety bondsman is the "insurance side" of West Virginia bail. The bond is guaranteed by an insurer, and the bondsman acts under the insurer's power of attorney.
Two routes to the surety bondsman definition
Under 114CSR103-2.11, a surety bondsman is a person who:
| Route | Producer license | Security and appointment |
|---|---|---|
| 2.11.1 | Insurance producer with a property and casualty line of authority | Appointed by an insurer to execute or countersign bail bonds through a qualified power of attorney |
| 2.11.2 | Insurance producer with a limited lines surety line of authority | Posts approved security by giving the Commissioner a qualified power of attorney issued under a producer underwriting agreement, and is appointed by an insurer |
Either way the bondsman charges, receives or is promised compensation, and an insurer stands behind the bond. That insurer must be qualified to transact surety business in West Virginia (2.7). The statute says the same thing in shorter form: the applicant provides a qualifying power of attorney from a licensed insurer or surety company, or pledges cash or approved securities (§51-10-8(d)).
Getting the producer authority
The OIC's How To Become a WV Licensed Bail Bondsman sheet (updated July 21, 2026) describes both routes:
- Limited lines surety line of authority: no exam is required; apply through NIPR (National Insurance Producer Registry).
- Property and casualty line of authority: 20 hours of pre-licensing education per line of authority. Then pass the WV property and casualty producer exam, bringing the course completion certificate, which is valid for six months. W.Va. Code §33-12-5 limits candidates to eight attempts to pass each line of authority. Then apply for the producer license through NIPR.
The bail bond examination is required either way. The OIC sheet lists "pass the West Virginia Professional and Surety Bail Bond Exam" as step 1 for all applicants. A producer license does not replace it.
What the surety application adds: 114CSR103-3.2.2
On top of every item in 3.2.1 (section 2.2), a surety applicant provides:
- 3.2.2.a: the applicant's National Producer Number (NPN);
- 3.2.2.b: a notice of appointment from each insurer for which the applicant is authorized by power of attorney to execute or countersign bail bonds; and
- 3.2.2.c: a qualifying power of attorney from an insurer that is in good standing with the Commissioner and authorized to post criminal appearance bonds.
The OIC supplemental application asks for a Notice of Appointment from each insurer (initial license only, not renewal) and a qualifying Power of Attorney from each insurer that gave a notice. At renewal, surety bondsmen file Form F, a list of all active insurance company appointments.
Non-resident surety bondsmen are part of the system. They must also prove they are licensed and in good standing in their home state and hold a producer license with limited lines surety or property and casualty authority.
Insurer duties around appointments
Insurers carry their own reporting duties (114CSR103-15):
| Duty | Deadline | Rule |
|---|---|---|
| Report total bail bond liability as of the last day of each calendar quarter | On or before the 15th day after the quarter ends | 15.3 |
| Furnish a list of all appointed surety bondsmen | Before July 1 each year | 15.4.1 |
| On terminating an appointment, file written notice with the Commissioner, stating the reasons and that the bondsman was notified | When the appointment is terminated | 15.5 |
| Answer requests for additional information | As requested | 15.9 |
OIC guidance adds that an insurer appointing a surety bondsman on or after July 1 notifies the OIC at the time of appointment. The OIC website hosts a Termination for Cause Form and a Bail Bondsman Appointment Termination Form for insurers.
Powers of attorney and countersigning
- A bondsman shall not sign or countersign bail bonds in blank. Nor may a bondsman give a power of attorney to, or otherwise authorize, anyone to countersign his or her name unless that person is a licensed bondsman (114CSR103-5.12).
- An agent, clerk or representative may issue bonds only "if a power of attorney has been duly executed" (2.1), and must be licensed.
Who carries the loss?
The insurer guarantees the bond to the court. OIC guidance notes that the arrangement may also require the bondsman to indemnify the insurer or fund a collateral account, but the bond is still guaranteed by the insurer. Compare the professional bondsman, whose own deposit with the Commissioner is the reserve for forfeitures (section 2.3).
Exam traps
- Producer license plus bail license plus bail exam. A surety bondsman needs all three. The producer license alone is not enough.
- Limited lines surety requires no producer exam; P&C requires pre-licensing education and an exam.
- Three surety-specific items: NPN, notice of appointment from each insurer, qualifying power of attorney.
- Insurer reports: quarterly by the 15th; appointed-bondsman list before July 1; termination notices with reasons.
Which items does 114CSR103-3.2.2 require from a surety bondsman applicant in addition to the general application items?
A $10,000 cash deposit, an attorney's title certificate for bond and a recorded notice of bond encumbrance
A surety bond from a WV bank, three character letters and a credit report
NPN, a notice of appointment from each insurer, and a qualifying power of attorney
Proof of West Virginia residence, a college transcript and a court approval
According to the OIC's licensing instructions, what is required to add a limited lines surety line of authority for a surety bondsman applicant?
Twenty hours of pre-licensing education and a producer exam
A separate limited lines surety exam with an 80% passing score
A one-year apprenticeship under a licensed property and casualty agent
No producer exam; the applicant applies through NIPR
Under 114CSR103-15.3, when must an insurer that appoints surety bondsmen file its report of total bail bond liability?
Within 30 days after each individual bond is exonerated
Once a year, before July 1, with the list of appointed bondsmen
Within 10 working days after each new bond is written
On or before the 15th day after the end of each calendar quarter
