4.4 Transporting Pesticides, Service Containers, Spill Response & Disposal

Section 2.9(A)(2)(g) of 250-RICR-40-15-2 makes "proper identification, storage, transport, handling, mixing procedures and disposal methods for pesticides and used pesticide containers" a tested general standard, and § 2.9(A)(2)(b) adds "common types and causes of pesticide accidents." The Rhode Island rules that fill in that standard live in § 2.25 (Transportation), § 2.24.1(P) (Spill Response), § 2.19(J) and R.I. Gen. Laws § 23-25-19.

Section 2.25(A) opens with the reason: "Accidental spills of pesticides may occur during their transportation because damage to containers most often occurs during times of loading and transport." The highest-risk moments in an applicator's day are not spraying. They are loading, transporting, and unloading concentrate.


1. The Eight Transportation Requirements (§ 2.25(A))

  1. DOT compliance. Vehicles transporting pesticides shall comply with United States Department of Transportation regulations for the transportation of hazardous materials and hazardous wastes, 49 C.F.R. § 171, at all times.
  2. Day-quantity rule. Transport from storage or mixing areas only the quantity and amounts of pesticides or tank mixes which may be commonly used during the day's operations. Leftover or unused pesticides shall be kept secured and locked at all times or returned to storage facilities at the end of each day.
  3. Isolation from occupants. Pesticides shall be transported in truck beds, trailers, or vehicle compartments which are isolated from drivers and passengers. A pickup cab, a van's passenger area, or a car trunk that vents into the cabin all fail this test.
  4. Original containers. Pesticides shall be transported in their original containers with the EPA registered label intact — except that service containers and application equipment are exempt, provided service containers meet the labeling rule below.
  5. Closed and secured. During transportation, pesticides and their mixes shall be in tightly closed containers, secured to prevent tipping over or shifting. Pesticides shall not be transported in open containers.
  6. Segregation from consumables. Pesticides must not be transported in the same cargo area as food, animal feeds and food, clothing, or potable water. Note that clothing is on the list — a duffel of spare work clothes riding beside a case of concentrate is a violation, and a practical route to dermal exposure.
  7. Service container labeling. Covered in detail below.
  8. No food-type containers. No person shall place or keep any pesticide in any container commonly used for food, drink, or household products. Decanting a herbicide into a soda bottle or a milk jug is one of the most dangerous and most frequently fatal misuses in the entire field.

2. Service Container Labeling (§ 2.25(A)(7))

A service container is any container other than the original manufacturer's package used to hold or transport a pesticide — a spray bottle, a bulk-fill drum, a mix tank, a technician's jug.

No person shall transport or otherwise possess any pesticide in any service container, except when in application equipment, unless the service container has attached to it a readable label with the following information:

Two details decide most exam items here:

  • The rule attaches to transport or possession. An unlabeled service container sitting in the shop is already a violation.
  • A dilution must be identified as a dilution, with the active ingredient percentage of the diluted material — not the concentrate's percentage.

3. Spill Containment During Transportation (§ 2.25(B))

  1. Applicators shall secure pesticides during transportation to prevent spillage.
  2. Each vehicle used to transport pesticides and tank mixes shall have spill containment materialsabsorptive clay, sand, sawdust or other similar materialsand tools to absorb, remove and clean up spills and leaks. If not required or stated on the label, any person cleaning up spills shall wear appropriate personal protective clothing to prevent direct exposure.
  3. Spilled materials and contamination mitigation materials must be properly contained and secured during transport and disposed of in accordance with the pesticide label and Federal and State hazardous waste disposal regulations.

This is a strict equipment rule: the spill kit rides in the vehicle, not back at the shop. A service vehicle without absorbent and tools is out of compliance before it leaves the yard.

4. The Spill Response Sequence: Protect, Control, Contain, Clean Up

Rhode Island's storage rule at § 2.24.1(P) states the outcome standard: spill containment and clean-up materials shall be furnished at all pesticide storage areas; spills shall be cleaned upon discovery; and spilled and migrating materials shall be immediately and properly contained and disposed of in accordance with the pesticide label and federal and State hazardous waste disposal regulations.

Liquid spill: apply absorbent from the outside edge inward so the material does not spread as you work. Dry spill: do not add water, which converts a sweepable problem into a mobile liquid one; cover lightly and sweep carefully.

Never wash a spill into a drain, ditch, or waterway. Section 23-25-19 of the General Laws makes this a statutory prohibition:

"No person shall transport, store, or dispose of any pesticide or pesticide containers in such a manner as to cause injury to humans, vegetation, crops, livestock, wildlife, beneficial insects or to pollute any waterway or water body in a way harmful to any wildlife in the waterway or waterbody."

Note the breadth of the protected list: humans, vegetation, crops, livestock, wildlife, beneficial insects, and waterways. Section 23-25-26 separately authorizes the Director to require reporting of significant accidents or incidents by regulation to a designated state agency or to EPA, so an applicator involved in a significant release should assume a reporting obligation and check with DEM rather than assume silence is acceptable.


5. Excess Mixture, Rinsate, and Container Disposal

  • The best disposal is no disposal. Mix only what the job requires. Section 7.3 of this guide covers the partial-tank arithmetic that makes this achievable.
  • Rinsate is a pesticide. Tank rinse water and container rinsate are used as makeup water for the next compatible load, applied at or below the labeled field rate on a labeled site. Section 2.25(B)(3) and § 2.24.1(P) both bar discharging it.
  • Never to a storm drain, sanitary sewer, septic system, or surface water. Section 2.24.1(D) reinforces this on the storage side by prohibiting bottom drains or openings in the storage area entirely.
  • Triple rinsing or pressure rinsing converts an empty container from hazardous waste into recyclable solid waste. The full protocol — 30-second drain, quarter-fill, 30-second shake, 30-second drain, three cycles, then puncture — is set out in Section 6.3 of this guide.
  • § 2.19(J): Pesticide containers shall not be used for any purpose other than the storage of pesticides, unless the purpose has been approved by the Director and the containers have been properly cleaned. Both conditions are required.
  • Unregistered, banned, and discontinued products (§ 2.24.1(N)): unregistered or banned pesticides must be returned to the manufacturer if the manufacturer will accept them, or disposed of under the Department's Hazardous Waste Management rules. If a manufacturer simply stops re-registering a product for reasons other than cancellation or a ban, and the Director determines the product poses no threat when used per label, remaining stock may be stored, distributed, or used up within two years of the state registration's expiration; after two years, remaining stocks and residues must be disposed of as hazardous waste. Receipt and storage of unregistered or banned pesticides is prohibited.
