More Rhode Island nursing assistants lose their credential to a calendar than to an exam. The renewal rules in 216-RICR-40-05-22.5.5 are specific, and two of them — the fixed June dates and the 12-hour in-service requirement — are widely misreported.

Notice that Rhode Island uses a fixed statewide date, not a rolling anniversary of your own license. That is exactly why a renewal notice that goes to an old address is so dangerous — and why § 22.5(D) requires you to report an address change within 10 days.

The Two Renewal Requirements

Section 22.5.5(E) states that a nursing assistant seeking renewal shall have:

been employed as a nursing assistant for at least eight (8) hours within the prior twenty-four (24) months and have completed twelve (12) hours of in-service training per year at the facility where employed; or have successfully completed a nursing assistant training program and passed the exam for licensure within the past twenty-four (24) months.

That "and" matters. Most summaries mention only the 8 hours. Both the employment and the in-service requirement apply, unless you are newly licensed within the cycle.

The 8-hour employment requirement — where the work must be

Section 22.5.5(G) restricts qualifying employment to:

  1. A Rhode Island-licensed health care facility (R.I. Gen. Laws Ch. 23-17)
  2. An assisted living residence (Ch. 23-17.4)
  3. An adult day services program (§ 23-1-52)
  4. Employment by a licensed nursing service agency (§ 23-17.7.1-1)

⚠️ "Private duty employment does not meet this employment requirement." That sentence is in the regulation verbatim (§ 22.5.5(G)(5)). A nursing assistant who spent two years caring for a private client in a family home has not met the renewal requirement, however many hours were worked. Neither does volunteer work — the employment must be paid work as a nursing assistant.

The threshold itself is deliberately low: eight hours in two years. One shift. But it must be the right kind of shift.

The 12-hour in-service requirement

Twelve hours of in-service training per year at your employing facility. Typical in-service content includes infection control, fire and life safety, resident rights, abuse prevention and reporting, dementia care, body mechanics and safe lifting, emergency preparedness, and HIPAA. Your employer generally provides and tracks these, but the record is your responsibility.

Attestation and Audit

Section 22.5.5(J): a renewal applicant attests on the online renewal form that they have been employed within the previous 24 months. Renewal applicants are subject to audit and must retain proof of in-service hours and continuing education units for three years.

Attesting to employment or in-service you did not complete is a false statement on a licensure application — a far more serious problem than a lapsed license. Keep a simple folder: dated in-service certificates and one pay stub or letter per cycle.

Lapse and Reinstatement

Medication Aide Renewal

If you also hold a Medication Aide license:

  • It is valid for two years and expires on the same date as your nursing assistant license (§ 22.5.2(F)).
  • Renewal requires 8 hours of employment as a medication aide within the prior 24 months and proof of 4 continuing education units related to medication administration (§ 22.5.5(F), (K)).
  • Qualifying employment is narrower: a Rhode Island-licensed nursing facility, an assisted living residence, or an adult day services program — nursing service agency employment is not listed for medication aides.
  • CE documentation must be retained no less than three years and is subject to random audit.

Discipline on the Registry

If RIDOH makes a finding of unprofessional conduct, the finding is recorded on the registry.

  • The name and record of discipline remain on the registry for two years from the date they were placed there.
  • After two years, the nursing assistant may petition RIDOH in writing — addressed to the Nursing Assistant Advisory Board, 3 Capitol Hill Room 104, Providence, RI 02908 — to have the record removed.
  • Removal is granted only if RIDOH determines the person's employment and personal history does not reflect a pattern of unprofessional conduct and the conduct in the original finding was a singular occurrence (§ 22.5.5(L)).

A federal finding of resident abuse, neglect, or misappropriation of property is a different matter and is permanent on the nurse aide registry; it cannot be removed.
