Direct Supervision: NRUPs, Technicians & Supervisor Duties
Most Missouri pesticide work is done by people who are not the certified applicator whose license authorizes it. The federal certification standards therefore make supervision its own CORE competency area — 40 CFR 171.103(c)(9), "Responsibilities of supervisors of noncertified applicators" — and Missouri's January 1, 2025 rewrite changed exactly who may work under whom.
1. What "Direct Supervision" Means
Direct supervision does not require the certified applicator to stand next to the worker. Under 40 CFR 171.201, a noncertified applicator acts under the direct supervision of a certified applicator when the certified applicator has:
- Authorized the application,
- Provided the required training and use-specific instructions, and
- Made themselves available to the noncertified applicator if and when needed.
The certified applicator does not have to be physically present unless the product labeling requires it. This is why 40 CFR 171.103(c)(1)(iv) makes "understanding labeling requirements that a certified applicator must be physically present at the site of the application" a separate label-comprehension competency: some labels — many fumigants among them — demand physical presence, and the label always wins.
[!IMPORTANT] Physical presence is the technician trainee's standard, not the general standard. RSMo 281.020(2)(j) defines a Pesticide Technician Trainee as an individual working in the physical presence and under the direct supervision of a certified commercial applicator while gaining required on-the-job training. Trainees are held to a stricter standard than licensed technicians or NRUPs.

Statutory conditions on technicians (RSMo 281.038.7): for a pesticide technician to use or determine the need for the use of any general use pesticide, the supervising certified commercial applicator must be at the same physical location as the technician and must be certified in the same use categories as the technician, as specified by regulation.
NRUP scope limit: the Missouri Department of Agriculture states it directly — NRUP applicators may use general use and restricted use pesticides only in the categories that their supervisor holds. An NRUP supervised by an applicator certified only in Category 3 cannot help with a Category 7B termite job.
NRUP address and employment changes: the supervising certified applicator or operator must immediately notify the Director when the NRUP changes the address they operate from, or when the NRUP's employment ends (RSMo 281.048).
3. The Four Federal Supervisor Duties — 40 CFR 171.103(c)(9)
Expect the exam to test these as a set:
- Comply with 40 CFR 171.201 — the requirements that apply to certified applicators who supervise noncertified applicators using RUPs.
- Keep the pesticide safety training records for noncertified applicators who use RUPs under direct supervision.
- Provide use-specific instructions to those noncertified applicators — what product, what site, what rate, what PPE, what restrictions.
- Explain pertinent State, Tribal, and Federal laws and regulations to them.
What 40 CFR 171.201 requires of the supervisor
Before a noncertified applicator uses an RUP under direct supervision, the certified applicator must ensure the person has been trained (or is otherwise qualified through certification or WPS handler training), has been instructed within the last 12 months in safe operation of the equipment they will use, meets the minimum age, can understand the label in a language they comprehend, and has been given the specific instructions and PPE for the job. The federal minimum age is 18, with a narrow exception permitting 16 for an immediate family member of the supervising certified applicator when the conditions in 40 CFR 171.201 are met. The certified applicator must also ensure the noncertified applicator has a means to contact them during the application.
Missouri's added supervisor duties — 2 CSR 70-010(3)
Missouri layered two more obligations onto the certified applicator in 2025. The certified applicator must:
- Provide individuals under their direct supervision with appropriate personal protective equipment, and ensure the equipment is used; and
- Ensure that the mixing, loading, transferring, and application equipment used by applicators under their direct supervision is in proper operating condition.
These are non-delegable. "The technician told me he had gloves" is not a defense.
4. Recordkeeping Consequences of Supervision
Supervision shows up directly in the Missouri application record. 2 CSR 70-25.120(4)(B) requires the record to name the person who actually applied the product:
- the name of the noncertified applicator; or
- the name and license number of the NRUP; or
- the name of the pesticide technician trainee; or
- the name and license number of the pesticide technician.
Subsection (A) separately requires the name and license number of the certified applicator using or supervising the use. A record naming only the certified applicator when an NRUP ran the sprayer is incomplete and citable.
