Establish what constitutes the contract

The entire-contract rule identifies the documents that form the insurance agreement. It prevents informal explanations from silently replacing the policy and provides a basis for reviewing a dispute.

BC life section 41 and A&S section 96 generally identify the application, policy, attached documents, and written amendments agreed after issue, with special provisions for fraternal arrangements. The Insurance Act also provides document-access rights.

A sales brochure, email summary, or illustration can be relevant evidence of what the agent represented, but does not automatically become an agreed policy amendment. If the insurer accepts a change, obtain the actual endorsement or written amendment and explain its effect.

Currency and place of payment

BC life section 74 treats an unqualified reference to dollars as Canadian dollars unless the contract provides otherwise. It also addresses place of payment, including particular group and non-resident situations.

The agent should therefore not assume every dollar figure is US currency because the insurer operates internationally. A foreign-currency contract must be identified explicitly. Exchange-rate risk can affect the client's premium burden and the local value of benefits.

Suppose a policy expressly pays US dollars while the family's expenses are Canadian dollars. Even if the nominal benefit is fixed, its Canadian purchasing power varies with exchange rates. Suitability includes explaining that exposure, rather than treating a fixed foreign amount as a fixed Canadian outcome.

Individual life age adjustment

BC section 54 generally adjusts insurance money to what the same premium would have purchased at the correct age. Adjustment can increase or decrease the benefit. It is not always a denial of the whole claim.

Assume a hypothetical $100,000 policy cost $1,000 at the stated age, but the correct-age rate would have been $1,250 for that amount. Under a proportional example using those rates, the same $1,000 buys $80,000: $100,000 × $1,000 ÷ $1,250.

Now assume the stated-age premium was $1,000 while the correct-age cost for $100,000 would have been $800. The same premium corresponds to $125,000 in this simplified example. Actual policy calculations use the insurer's applicable rates and terms, not an agent's rough arithmetic.

The statutory age rule is distinct from ordinary material misrepresentation and its two-year protection. The agent should not assume that reaching the contestability milestone erases an age error.

Age outside the issue limit

BC's individual-life provision permits avoidance where the correct age exceeded the contract's insurable-age limit at application, subject to a five-year window, the life insured still being alive, and action within sixty days after discovery.

These conditions should be read together. Finding an age error after death does not automatically satisfy a provision requiring the person to be alive. Likewise, a qualifying error does not grant an indefinite right to void.

A policy can also have other relevant terms, but the agent must not substitute a general statement that “any wrong age voids coverage.” The statutory adjustment and narrow avoidance route address different cases.

Group and A&S differences

BC life section 55 applies the group contract's age provisions and says age misstatement alone does not make group coverage voidable. A&S section 115 permits benefit or premium adjustment for individual coverage and applies contractual age provisions for group coverage. Where age determines commencement or termination, the correct age governs.

Sex-related rating errors must be assessed under the actual contract and governing law. Do not describe every provision titled “misstatement of age or sex” as if the statute necessarily applies the identical rule to both.

A client correcting a date of birth should be told what documents the insurer requires and which values may change. The correction should not be concealed merely because the original premium appeared favorable.

Assume a simplified individual policy provides a benefit proportional to the premium that should have been paid at the correct age. If the actual premium is $600 and the correct-age premium for the stated benefit would have been $750, the ratio is 600 ÷ 750 = 80%. Apply that ratio only where the governing provision and contract require it. An age error is not automatically fraud, and the special issue-age limits and group provisions still require separate analysis.

The agent should communicate an insurer's calculation clearly and check obvious arithmetic without promising the final legal result. If the client disputes the adjustment, preserve the source documents and follow the complaint or legal process.

The wider lesson is that statutory contract protections have specific purposes. Entire-contract rules identify terms, currency rules identify monetary meaning, and age rules correct a rating fact. Combining them into a broad assertion that every error either voids nothing or voids everything would defeat those distinctions.
