Product scope determines required authority

A life insurance licence commonly includes relevant life, annuity, segregated fund, and accident and sickness activities within its jurisdictional class. An A&S-only licence has a narrower scope. General insurance and securities activities use different authorization frameworks.

The agent should identify the product's legal classification. A market-linked segregated fund contract is an insurance product, but selling individual stocks or conventional mutual funds can require securities registration. A life licence does not confer authority to practise law or provide every form of tax advice.

Bank employees also operate under their institution's authorized framework. A banking role alone does not establish a personal life-agent licence or permission to sell any outside product.

Examination and licence are separate

Course certification and passed modules satisfy qualification requirements, subject to their validity periods. The applicant still must meet licensing requirements, including suitability, insurance, fees, and any sponsorship or supervision conditions.

A licence can have restrictions for a new entrant. In Saskatchewan, for example, the council describes supervision requirements for newly licensed agents. Passing an exam does not remove those conditions.

A person whose application is pending should not hold out as already authorized. The agent must confirm active status before undertaking activities requiring a licence.

Sponsorship is jurisdiction specific

Ontario FSRA application guidance requires sponsorship during the first two years for a new life and A&S agent. Eligible agents can later use the non-sponsored route while continuing to meet applicable obligations.

Other provinces have their own recommending-insurer, contracting, supervision, or sponsorship requirements. Do not say every Canadian agent needs one insurer sponsor throughout their entire career.

Ending a required sponsorship can affect authorization. The result and reporting procedure depend on local rules; do not invent one automatic nationwide suspension mechanism. The agent should contact the regulator and establish permitted status before continuing sales.

Individual and business licences

An incorporated agency can require a separate business licence, designated representative, and other requirements. Individual licensing and corporate licensing answer different questions.

An employee's active licence does not necessarily cure the corporation's missing authorization. Conversely, an agency licence does not allow an unlicensed employee to carry out activities reserved to licensed agents.

The agency should maintain a clear record of which entities and individuals are licensed, their jurisdictions, classes, restrictions, and responsible representatives.

MGA roles and current Ontario status

A managing general agency can support distribution through contracting, application processing, training, supervision, and administration. Its precise obligations depend on activities, contracts, and regulation.

Ontario's proposed new dedicated MGA licensing framework should not be described as already implemented merely because a target date appeared in a proposal. FSRA's current MGA rule page states that implementation is paused.

That pause does not eliminate existing licensing or conduct obligations for an entity carrying out regulated activity. Determine the current rule rather than claiming either that all MGAs are unregulated or that a proposed licence has become mandatory.

Non-resident licensing

An agent serving clients in another province or territory may require that jurisdiction's non-resident licence. Residency, client location, solicitation, delivery, and the activity can matter under the local framework.

A home-province licence does not provide automatic national portability. Harmonized application processes can simplify qualification evidence, but the receiving regulator still grants and conditions authorization.

A remote video meeting is not an exemption merely because the agent stays physically at home. Confirm where the activity is regulated before accepting an interprovincial application.

Financial planner and other titles

Professional credentials and protected titles can have separate qualification or credentialing rules. A licence permits activities within its class; it does not automatically confer every financial-planning designation.

Accurately state the credentials actually held. Avoid logos, titles, or descriptions implying broader qualifications. Referral to a specialist can be the competent response where a client's legal, tax, pension, or securities question exceeds the agent's expertise.

Consider an Ontario agent planning to advise a resident of another province remotely. Being physically in Ontario does not establish that the Ontario licence alone covers the transaction. Confirm the other jurisdiction's requirements, non-resident application route and any conditions before soliciting or advising. A sponsoring insurer's national business presence is likewise not a national individual licence. The client should receive accurate information about the agent's authorization, and the agency should verify that the proposed product and servicing activities are within scope.

Apply an authorization checklist

Before a new line of business, confirm:

  • Product classification and required licence class.
  • Individual and business active status.
  • Sponsorship, supervision and representative conditions.
  • Each relevant jurisdiction's authorization.
  • Separate credentials or registrations for adjacent services.

This checklist supports lawful service expansion. The agent should resolve missing authority before transacting rather than rely on the client signing a waiver. Client willingness cannot authorize activity the law reserves to a licensed person.
