8.2 Owner, Operator & Instructor Roles, License Scope and Conduct

Separate the Licensed Roles

A driving school owner, operator, and instructor have related but different authority. The owner holds the business license and is responsible for the established business, bond, vehicles, and insurance duties assigned by law. The operator manages instructional operations and must meet separate qualifications. The instructor directly teaches students for compensation and must hold the instructor credential plus an appropriate California driver license.

Instructor Scope and Possession

Current 13 CCR section 340.00 requires the instructor license to be available in the driving school's office, and the instructor must carry the instructor identification card while accompanying a student. A student or parent may ask to see it. The credential belongs to the licensee and cannot be lent to another person.

An instructor works under a licensed school's employment and authorization. When employed by more than one school, current regulation requires appropriate acknowledgment letters and license handling. When transferring schools or when the employing school's name or location changes, follow DMV's modification procedure and fee rather than simply continuing under old records. Vehicle Code section 11108.5 requires an instructor or operator to report a residence-address change to DMV within five days.

The underlying driver license must be valid and appropriate for the vehicle. A classroom-only restriction does not authorize behind-the-wheel teaching. A license for ordinary passenger-vehicle instruction does not automatically authorize motorcycle, commercial, or all-terrain-vehicle instruction. Confirm the exact license and school authorization before accepting an assignment.

Owner and Operator Boundaries

The owner must maintain an established place of business open to the public, provide required equipment, file the $10,000 bond, designate a qualified operator if the owner does not operate the school, and satisfy the applicable licensing and worker-compensation conditions. The operator supervises instruction and compliance on behalf of the school. These responsibilities do not erase an instructor's personal duty to teach safely and keep accurate records.

An independent driving instructor license under Vehicle Code section 11105.5 is a narrow, separate category with location, population, school-availability, and teaching-credential conditions. Do not use the phrase "independent instructor" casually for an ordinary instructor who works without supervision, and do not assume every instructor carries the insurance duties that section 11103 places on a school owner or qualifying independent instructor.

Professional Conduct

The instructor controls a safety-sensitive learning environment. Maintain calm language, appropriate boundaries, nondiscrimination, privacy, and objective records. Never teach while impaired, use a handheld phone while supervising moving instruction, or allow schedule pressure to override safety. Do not promise a student will pass the DMV test, impersonate a DMV employee, or imply influence over examiners.

Protect student records and discuss performance only with authorized people. For a minor, follow school procedures for parent or guardian communication, pickup, and emergencies. Avoid conflicts of interest, cash arrangements outside school records, and any request to sign a certificate for uncompleted instruction.

Decision Check Before Teaching

When unsure, pause the assignment and contact the school operator or DMV Occupational Licensing. Performing first and correcting paperwork later can expose the student and public to risk.

Escalate Without Improvising

If a license, ID card, employment acknowledgment, restriction, or vehicle class is unclear, pause instruction and ask the operator or DMV Occupational Licensing for resolution. Do not borrow another instructor's credential, edit a restriction, or use a student's payment as pressure to continue. Professional authority includes saying no to an unsafe or unauthorized assignment. Record the referral and resume only after evidence is available. This protects the student, the instructor, and the owner while keeping each role's responsibility visible.

Use role language precisely in records and exam analysis. "The school" may conceal whether a duty belongs to the owner, operator, or instructor. Rewrite the scenario with a named actor, then match the action to the license. This technique is especially useful for bond, insurance, employment, vehicle, and student-record questions.

Professional Traits Become Observable Conduct

The OL 235 traits list is best studied as behavior rather than personality slogans. Analysis means isolating the reason for an error; communication means giving timely directions the learner can use; patience means preserving composure through repeated practice; listening means checking the learner's explanation before correcting it. Neatness, preparedness, and a lawful driving example reinforce trust. None of these traits enlarges the license scope, excuses a safety lapse, or permits an instructor to conceal incomplete training.
