8.1 Instructor Eligibility, Application, Examination & Renewal

Know the Current Instructor Credential

The California driving school instructor license authorizes a qualified person to provide driver education and driver training for a DMV-licensed driving school. It is an occupational credential, distinct from the person's California driver license and from owner or operator licenses. The current DMV licensing page and Vehicle Code section 11104 are the controlling starting points.

Statutory Qualifications

An applicant must be at least 21, have a high-school education or equivalent, and complete a DMV-acceptable course in teaching driver education and driver training. The DMV lesson plan allocates a minimum 40 classroom hours and 20 laboratory/behind-the-wheel hours across required subjects. The applicant must be physically able to operate and train safely and hold a valid California driver license in the class appropriate for the training vehicle. A physical disability may support a DMV-discretionary license restricted to classroom driver education when the driving requirements cannot be met.

The applicant may not be on DMV negligent-operator probation and must satisfy the current driving-record condition stated in section 11104. Do not replace that language with an invented rule such as "no more than one point in the last year." All qualifying requirements must be completed within one year of the application date or a new application, examination, and fee are required.

Application Evidence

Current DMV instructions identify these major items:

• Online application and the required fees.
• A valid California driver license.
• Live Scan fingerprints using DMV form 8016.
• Physician's Health Report, form DL 546A.
• High-school diploma, equivalent, or accepted alternative evidence.
• The employing driving school's occupational-license number and signed employment letters from the owner and operator.
• Evidence of satisfactory completion of the required instructor training course.

An independent instructor applicant has additional requirements. Forms and submission methods change; use the current DMV page and form checklist rather than an old handbook address.

Written Examination

DMV currently lists six content areas: traffic laws; safe driving practices; safe operation of motor vehicles; first aid; teaching methods and techniques for driver education and driver training of minors; and statutes and regulations for those minor programs. Section 11104 allows three attempts. If all three are failed, DMV's current page requires a new application, fees, and examination. It does not impose a one-year wait merely for three failed attempts. A one-year bar can follow a formal license refusal or revocation under section 11107, which is a different event.

DMV does not publish an official question count or passing score on the instructor page. Do not treat a third-party estimate or an unsupported 80 percent as official. Prepare for the published domains and current sources.

Fees, Term, and Renewal

The current DMV page lists an original application fee of $30, a $1 Family Support Program fee, and a $30 additional license fee, totaling $61 for the ordinary original transaction. It lists a $30 renewal plus the $1 program fee. Verify amounts at filing because fee pages can change.

An instructor license is valid for three years unless canceled, suspended, or revoked. Renewal must be completed before expiration. DMV requires the renewal examination during each succeeding three-year period, but may accept approved continuing professional education instead. Current regulation section 342.05 describes 18 hours of acceptable courses or seminars completed in the preceding three years; it also provides a qualifying two-semester-unit college-course route under its timing conditions. Section 340.10 requires the medical report at renewal every three years.

Build a personal renewal calendar; an expired instructor license cannot be renewed after expiration under section 11105.1.

Build an Application File

Use a checklist keyed to the current DMV page and retain submission confirmations. Match names across the driver license, education evidence, Live Scan request, health report, and employer letters. Track the one-year qualification window and the license expiration separately. Before renewal, verify whether the applicant will test or use acceptable continuing education and whether the medical report is due. Do not wait for the last day: Vehicle Code section 11105.1 says renewal cannot occur after expiration. Questions about an old form should be answered from the current DMV checklist, not memory.
