8.4 Student Records, Completion Certificates & Enforcement

Key Takeaways

  • CVC section 11108 lists the required student-instruction record and sets a minimum three-year retention period.
  • OL 214 accounts for completion certificates; it is not a collision report.
  • Issue OL 237, OL 238, or OL 239 only after the required approved instruction is complete.
  • Formal application refusal or revocation and ordinary failure of three exam attempts have different consequences.

Records Must Reconstruct What Was Taught

Vehicle Code section 11108 specifies the core driving-school record. It must show the school name, address, and license number; each student's name and address; permit or driver-license number and permit issue date; each instructor's name and license number; the particular type and date of instruction; time devoted to each type; total hours; and total student cost. Do not add a student signature, birth date, telephone number, exact route, or session-end time to the statutory list unless another current rule or school policy requires it.

Retention, Access, and Closure

Keep required records for at least three years and make them open to DMV inspection at reasonable times for the department's confidential use. If the licensee suspends or terminates the licensed activity, surrender the records for DMV examination no later than the end of the third day, excluding weekends and legal holidays. DMV must return the records within the statutory period after surrender. Preserve privacy and restrict ordinary access even though DMV has inspection authority.

Correct a record transparently under school policy; do not erase history or backdate. Digital systems should preserve identity, timestamps, and backups. Reconcile scheduled time, actual time, instructor assignment, payment, and certificate issuance before certification.

Completion Certificates

Current 13 CCR section 340.27 governs forms OL 237, OL 238, and OL 239 and requires schools to account for certificates received from DMV on form OL 214. Record each issued certificate on the log and maintain accountability for the controlled forms. A certificate may not be issued unless the student completed the required instruction.

The current DMV driver-training page states that minor driver training consists of at least six hours behind the wheel with a professional instructor and may not exceed two hours per day. Time spent merely observing another student does not count. Driver education and integrated programs have separate approved curricula and certificates. Use the current form names; do not casually substitute outdated DL form numbers.

For a minor's permit, current DMV guidance says the student must wait to use it until driver training begins and the instructor validates it. Validation reflects the actual start of instruction; never pre-sign a permit or completion form.

Course and Test Integrity

Under 13 CCR section 340.25, a minor's approved classroom course may not count more than seven instructional hours in a day and must use approved facilities, lesson plan, and materials. Under section 342.02, instructor-training materials and curriculum require DMV approval. Under section 340.45, required behind-the-wheel minor training may not exceed two hours per day, the student must have the valid permit or license in immediate possession, and a school may not teach on a specific course used by DMV for its drive test.

Do not reproduce unpublished DMV questions, use DMV forms as the specific test, or promise a pass. General instruction in safe testable skills is permitted and required.

Discipline and Process

Vehicle Code section 11110 permits suspension or revocation after notice and hearing for grounds including failure to qualify, missing records, fraud, noncompliance, misleading DMV-like advertising, solicitation within 200 feet of a DMV office, specified convictions, teaching DMV's specific tests, unsafe training, use of an unlicensed instructor, missing owner bond, lending a license, and prohibited student recruitment by a credentialed teacher. In a public-safety case DMV may suspend immediately and must conduct the hearing within 30 days.

Section 11107 is about refusing an application: the applicant may demand a hearing within 60 days of notice, and a person formally refused or revoked generally waits at least one year before reapplying. Do not confuse that with failing three written-exam attempts.

Compliance eventRequired action
Each lessonRecord type, date, time, instructor, and totals accurately
Course completionIssue only the correct controlled certificate after all requirements
Certificate issueEnter it on OL 214 and preserve accountability
Activity suspension/terminationSurrender records by end of third qualifying day
Address or employment changeFollow the applicable DMV notice/modification rule
Safety or integrity violationStop the conduct, preserve records, notify responsible operator

Accurate records protect students and demonstrate that the school delivered the training it certified.

Reconciliation Practice

At regular intervals, compare the certificate inventory on OL 214 with issued certificates and the underlying student records. Each issuance should trace to completed approved hours, dates, instructor authority, and the correct program. Investigate a skipped, spoiled, or duplicated serial number without inventing instruction to make the totals match. Preserve the audit trail. If an error could affect a student's certification or DMV record, notify the operator and follow DMV direction promptly. Accurate correction is safer than concealment and is consistent with the recordkeeping purpose.
