Custom Applicators, Aerial Application & Drone Licensing

Core Principle: Applying pesticides for hire, and applying them from the air, each add a licensing layer on top of certification — and Arizona licenses the equipment as well as the person. An operation can hold every personal credential correctly and still be unlicensed because a rig was never registered.


The Custom Applicator Licence

A custom applicator applies pesticides for hire to land the applicator does not own or control. The licence costs $100 per year, the highest of the agricultural credentials, and its examination path is its own: Custom Core plus a Ground or Air category exam, grouped by the department at a $100 fee tier.

The Equipment Mandate

The department states it explicitly: all aircraft and ground equipment used for pesticide application by a custom applicator must be licensed separately.

This catches operations out. A custom applicator who buys a second rig mid-season, or borrows an aircraft to cover a workload spike, has added an unlicensed piece of equipment to a licensed operation. Practical controls:

  • Maintain an equipment register that mirrors the licence file, with each unit’s identification.
  • License new equipment before its first pesticide application, not at the next renewal.
  • Treat borrowed or leased equipment as requiring the same check.

Agricultural Aircraft Pilot Licence

Flying the aircraft for pesticide application requires the Agricultural Aircraft Pilot (AAP) licence at $50 per year. The department groups agricultural pilots at a $50 exam tier for the final certification exam, and directs preparation to the National Aerial Applicator’s Manual, provided as a free PDF.

The AAP sits on top of, not instead of, the underlying certification and the FAA credentials that govern the aircraft operation itself. Three separate regulatory systems apply to the same flight: FAA for airworthiness and pilot certification, EPA and FIFRA for the label, and AZDA for the state credential and equipment licence.


Drone Pilot Licence

Arizona’s fee schedule now lists a Drone Pilot Licence at $50 per year alongside the Agriculture Aircraft Pilot Licence. The separate line matters: unmanned aerial application is treated as its own regulated activity, not as an unlicensed variation of ground application or an incidental use of a hobby aircraft.

Unmanned application does not soften any label or buffer obligation. If anything the risk profile is distinctive:

  • Low flight height and rotor downwash produce a different droplet transport pattern from either a boom or a fixed-wing aircraft.
  • Small tank volumes mean frequent mixing and loading cycles, multiplying the highest-exposure step in the job.
  • Ease of deployment invites application in conditions a pilot would refuse. The wind, inversion and Delta T limits from Chapter 7 apply unchanged.

Aerial Application and the Arizona Buffer Zones

A.R.S. § 3-365 distinguishes aircraft from ground equipment explicitly, and the aerial distances are the larger ones:

Two further aerial-specific points from the statute:

  • A responsible individual at a school, child care group home or child care facility must be notified of daylight aerial applications of pesticides other than highly toxic pesticides or paraquat.
  • Distances are measured from the property boundary of the protected site nearest the field to the area of the field that is to be sprayed — not to the field boundary.

Operational Drift Control from the Air

Everything in Section 7.2 tightens when the release height increases:

  • Release height is the dominant drift variable. Fly as low as the aircraft and terrain safely allow.
  • Droplet spectrum. Select nozzles, orientation and airspeed to shift the spectrum coarser; the ASABE S572 classes and the sub-150 µm driftable-fines threshold apply identically.
  • Swath displacement. Offset the swath upwind so the deposit lands on target; do not simply fly the field boundary in a crosswind.
  • Boom length relative to wingspan or rotor. Keeping the boom within roughly three-quarters of the wingspan keeps the outer nozzles out of the wingtip vortices that loft fine droplets.
  • Shut off over the buffer. Nozzle shut-off discipline at the field edge is what actually protects the buffer distance; the number on paper does nothing by itself.
  • Inversions. Calm, clear, cool mornings are inversion conditions, and an inversion can carry fine droplets for miles. Wind below 3 mph is a warning sign, not an opportunity.
