1How does Article 1 of the Zakon o odvetništvu (ZOdv) legally characterize the practice of advocacy in the Republic of Slovenia?
A.As an autonomous and independent service that is an integral part of the justice system
B.As a commercial legal activity regulated exclusively under standard company law
C.As an executive administrative agency subordinate to the Ministry of Justice
D.As a judicial office exercising delegated constitutional adjudicatory powers
Explanation: Under Article 1 of the Zakon o odvetništvu (ZOdv), advocacy is defined as an autonomous and independent service that is an integral part of the justice system (samostojna in neodvisna služba, ki je del pravosodja). This constitutional and statutory characterization distinguishes it from ordinary commercial businesses and state administrative offices.
2Which educational credential satisfies the academic requirement for entry into the directory of attorneys (imenik odvetnikov) under ZOdv Article 25(1)(3)?
A.A first-cycle Bologna Bachelor of Laws degree (diplomirani pravnik UN) combined with two years of commercial experience
B.A completed second-cycle Bologna Master of Laws degree (magister prava) or academic university law degree (univ. dipl. prav.)
C.A recognized academic Master of Business Administration degree with a focus on commercial contracts and taxation
D.A state administrative higher-education diploma in public administration and procedural management
Explanation: ZOdv Article 25(1)(3) accepts three Slovenian professional titles: univerzitetni diplomirani pravnik, the combination of diplomirani pravnik (UN) plus magister prava, or magister prava from a single-cycle (enoviti) master's programme. Equivalent education completed abroad also qualifies once it is recognised under the law on the recognition and evaluation of education.
3Under ZOdv Article 25(1)(5), what practical legal experience must an applicant have for entry in the directory of attorneys (imenik odvetnikov)?
A.Three years of continuous employment in the litigation department of a public enterprise or bank
B.Two years of post-graduate traineeship completed only under the supervision of a sole practitioner
C.Four years as a law graduate, at least one of them after the PDI at a qualifying legal institution
D.Five years of practical experience in any legal capacity, with no requirement for any practice after the PDI
Explanation: ZOdv Article 25(1)(5) requires four years of practical experience as a law graduate. At least one of those years must follow the pravniški državni izpit (PDI) and be spent with an attorney or law firm, at a court, the state prosecution service, the state attorney's office, the Odvetniška zbornica Slovenije or a notary. That year must be in regular full-time employment, or a proportionally longer period if the contract is part-time.
4Under ZOdv Article 32, when and before whom does a new attorney take the statutory oath?
A.After entry in the directory, before a notary in the presence of two attorney witnesses
B.Before entry in the directory, before the Minister of Justice at a ministry ceremony
C.After entry in the directory, before the President of the Supreme Court in open court
D.Before entry in the directory, before the President of the Odvetniška zbornica Slovenije
Explanation: ZOdv Article 32 provides that, before being entered in the imenik odvetnikov, the attorney takes the oath before the President of the Odvetniška zbornica Slovenije. The oath is to respect the legal order of the Republic of Slovenia and to practise the profession conscientiously, honestly and with dignity. The Statut OZS (Article 32) also lists receiving these oaths among the President's tasks.
5Which organizational forms for practicing advocacy are recognized under the provisions of the Zakon o odvetništvu?
A.As an individual sole practitioner, in a registered law firm (odvetniška družba), or as an employed attorney
B.Exclusively as a sole proprietor registered under general craft legislation with the local municipality
C.Only as a non-profit civic association or foundation registered with the Ministry of the Interior
D.Solely as a partner in a publicly traded joint-stock corporation listed on the stock exchange
Explanation: ZOdv Article 4 allows an attorney to practise individually or in a law firm (odvetniška družba), and also on the basis of an employment relationship with an attorney or law firm (zaposleni odvetnik). Article 35 then defines the permitted law-firm forms.
6Under ZOdv Article 35, which forms may an odvetniška družba take?
A.Only a public limited company (delniška družba) open to outside capital subscription
B.A civil law firm or a law firm with legal personality (unlimited or limited liability)
C.Any commercial company form, including a partnership limited by shares (komanditna delniška družba)
D.Only a civil-law partnership without legal personality, never a legal person
Explanation: ZOdv Article 35 allows a law firm to be founded as a civil law firm (civilna odvetniška družba) or as a law firm that is a legal person. A law firm with legal personality may be either a company with unlimited personal liability of the partners or one with limited liability. Under Article 36, the company-law rules apply unless ZOdv provides otherwise.
7Under ZOdv Article 37, who may be a partner (družbenik) in an odvetniška družba?
A.Immediate family members of a founding attorney, as passive partners without management rights
B.Non-lawyer investors holding up to 49% of the equity, provided they stay out of management
C.Only attorneys who practise advocacy in that firm, and they may not practise in another law firm
D.Banks that provide the firm with operating credit, through non-voting preference shares
Explanation: ZOdv Article 37 limits a law firm's activity to practising advocacy and allows only attorneys who practise in the firm to be its partners. Partners may not practise advocacy in other law firms, and the firm's management cannot be entrusted to a non-attorney. Law firms may not combine for the joint practice of advocacy.
8Under ZOdv Article 55, how far may an attorney candidate (odvetniški kandidat) substitute for the attorney?
A.Only in out-of-court work; a candidate may never appear at hearings
B.Only before local courts (okrajna sodišča) in minor civil matters
C.In every task and before every court, including the Supreme and Constitutional Courts
D.In all advocacy tasks except representation before the Supreme and Constitutional Courts
Explanation: ZOdv Article 55 allows an odvetniški kandidat, who has already passed the PDI, to substitute for the attorney in all tasks under Article 2. The only exception is representation before the Supreme Court and the Constitutional Court of the Republic of Slovenia. Article 16 adds that substitution by an employed candidate does not require the client's consent.
9Which substitution does ZOdv Article 16.a prohibit?
A.A candidate or trainee substituting for an attorney appointed ex officio in criminal proceedings
B.A colleague from the same law office substituting at a hearing without the client's consent
C.An employed trainee substituting, within legal limits, in a privately retained civil case
D.An attorney candidate substituting for an attorney who provides free legal aid
Explanation: ZOdv Article 16.a overrides the general substitution rule in Article 16(1). An attorney appointed ex officio in criminal proceedings, or in proceedings under the mental health act, may not be replaced by an attorney candidate or trainee. An attorney providing free legal aid may not be replaced by a trainee, although a candidate may still substitute for them.
10How does ZOdv Article 9 arrange an attorney's professional liability insurance?
A.Insurance is optional and needed only if the attorney does not lodge a cash deposit with the central bank
B.The OZS insures the attorney, and the premium is paid from the attorney's insurance contribution to the OZS
C.Insurance is required only for attorneys practising through a law firm with limited liability
D.The state budget insures all practising attorneys through the Ministry of Justice
Explanation: Under ZOdv Article 9, the Odvetniška zbornica Slovenije insures the attorney against liability for damage that may arise for a client in connection with practising the profession. The cover must include damage caused by gross negligence, error or omission of professional duty by the attorney and their employees. The premium is paid from the attorney's insurance contribution to the OZS, and insurers must conclude contracts on these terms.

Slovenia Bar Admission Test: Suggested Study Strategy

1Review the consolidated text of the Zakon o odvetništvu (ZOdv), giving special attention to the 2026 ZOdv-H amendments regarding commercial communication, incompatibilities, and disciplinary enforcement.
2Master the general principles of the Odvetniška tarifa, including the €0.60 point value, flat-rate material cost calculation thresholds (2% up to 1,000 points, 1% above), and the 15% statutory cap on quota litis contingency fee agreements.
3Learn the refusal and conflict rules in ZOdv Article 5 and Kodeks Articles 43, 47, 48 and 56, together with the professional secrecy rules in Kodeks Articles 51–53.
4Practice solving concrete tariff billing scenarios for civil lawsuits, hearings, preparatory briefs, and appeals to ensure quick calculation of points and cash values.
5Practise explaining each rule aloud and naming the article it comes from, because the test is oral and each of the three areas is graded separately.

Frequently Asked Questions

What is the difference between the Pravniški državni izpit (PDI) and this Bar test?

The Pravniški državni izpit (PDI) is the state legal examination administered by the Ministry of Justice through its Judicial Training Centre (CIP), covering substantive and procedural law. The OZS Preizkus is a separate statutory test administered by the Slovenian Bar Association (OZS) under ZOdv Article 25(1)(9). It assesses the Attorneys Act, the OZS Statute, the Attorney Tariff, and the Code of Professional Ethics. Both are conditions for entry in the directory of attorneys.

What is the format of the official OZS knowledge examination?

Under Article 4 of the Ministry of Justice Rulebook (Pravilnik PRAV9867), the examination is entirely oral. There is no written examination component. Candidates appear before a three-member commission of attorneys appointed by the OZS Management Board, which examines them across three designated areas: (1) the Attorneys Act and OZS Statute, (2) the Attorney Tariff, and (3) the Code of Professional Ethics.

How is the examination graded and what happens if a candidate fails an area?

Under Articles 5, 7 and 9 of Pravilnik PRAV9867, each area is graded either 'je opravil' (passed) or 'ni opravil' (failed), and there is no numeric mark. An overall pass requires passing all three areas. A candidate who fails one area repeats only that area on the next attempt, and the rulebook does not limit the number of attempts.

What fees are associated with the OZS Bar admission test?

Under Article 10 of Pravilnik PRAV9867, the Slovenian Bar Association (OZS) covers the full cost of a candidate's first attempt. The candidate bears the costs of each later attempt, and the OZS does not publish a price for a repeat attempt. The separate OZS entry fee (vpisnina) for the directory of attorneys is not a test fee.

Does this practice question bank simulate the official examination?

No. This bank is an independent English-language multiple-choice study adaptation for reviewing the statutory rules, tariff calculations and ethical principles behind the test. It is not an official translation of the Slovenian legal texts. The official assessment is an oral examination before a three-member attorney commission. The rulebook does not state a test language, but ZOdv requires active command of Slovenian for entry in the directory.
