4.1 Acceptable Identification and Local Rules
Key Takeaways
Use the applicable regulator’s accepted-document rules and lawful house policy.
A genuine credential must still belong to the person presenting it and establish the required age.
Photo, description, expiration, temporary-document, and mobile-ID rules are not identical nationwide.
Document acceptance and eligibility for a particular legal defense are separate questions.
Start with the right rule
Bona fide evidence of age and identity is a legal concept used in some jurisdictions. It is not a nationwide checklist requiring every acceptable document to have exactly the same six features. The applicable law determines which evidence is recognized and what reliance on it may establish.
Before a shift, know the regulator's current rules, your venue's license conditions, and lawful house policy. The employer should provide a clear accepted-document list and an escalation process for unfamiliar documents. A server should not invent a rule at the counter or accept a questionable document merely because another venue accepted it.
Separate four decisions
An ID check answers several different questions:
- Document category: Is this type of evidence permitted for this transaction?
- Authenticity and validity: Does the evidence appear genuine, current where required, and unaltered?
- Presenter match: Is the person using their own evidence?
- Age: Has the person reached the required age on the date of service?
Passing one question does not answer the others. A genuine adult license borrowed by a younger sibling is not proof of the sibling's age. A clearly readable date on an unaccepted document does not automatically establish a legal defense. A scan that calculates age does not prove who is holding the card.
Common document categories
| Category | What to verify |
|---|---|
| State driver license or non-driver ID | Issuer, applicable format and validity, age, and presenter match |
| Passport or passport card | Whether that specific document type is recognized locally and matches the bearer |
| Military credential | The applicable accepted category and features; do not invent missing-field requirements |
| Tribal credential | Local recognition and required evidence; acceptance is jurisdiction-specific |
| Temporary paper document | Whether it is recognized and whether accompanying evidence is required |
| Official mobile credential | Whether the jurisdiction and venue support an authorized verification method |
This table identifies questions, not a list of documents universally accepted everywhere. Passports and military credentials illustrate why a driver's-license template cannot be applied mechanically. California ABC, for example, recognizes military identification without a physical description under its stated rules. A rule requiring every acceptable ID to show height, weight, and eye color would incorrectly reject that category.
What supporting documents cannot establish alone
A credit card, employee badge, or student card may show a name or photo but should not be assumed to satisfy alcohol age-verification requirements. A birth certificate records a birth but does not by itself provide the same presenter-photo comparison as a photo credential. Follow the actual accepted-evidence rules rather than combining miscellaneous cards and declaring them equivalent.
Do not request a Social Security number as a substitute for age evidence. Do not claim a federal law universally prohibits all identity-related uses of Social Security cards; that is not the reason to reject one as inadequate alcohol age evidence. Keep the decision connected to the accepted-document rule for the sale.
Expiration, damage, and unfamiliar formats
Check expiration when required by law, defense criteria, or policy. An expired credential can fail those requirements even though the person's birthday has not changed. However, do not tell every adult nationwide that accepting an expired card is the same criminal offense as selling to a minor. Document acceptance, actual age, and legal defenses are distinct issues.
TABC's current age-verification guidance explicitly separates what certain sellers may accept from the identification conditions for a criminal-liability defense. It also distinguishes businesses and transaction types, including separate requirements for certain off-premises sales. A rule learned for a restaurant therefore should not be transferred automatically to a package store or delivery transaction.
Damage can obscure information or suggest alteration, but ordinary wear is not conclusive proof of fraud. Pause service and consult the reference or manager when a required field cannot be read. Do not damage the document further in an attempt to test it.
Temporary and digital evidence
A temporary driving privilege is not automatically valid identification for alcohol. Some jurisdictions recognize specified combinations of temporary paperwork and accompanying evidence. Others do not. Verify the applicable procedure before accepting it; do not universally require a voided old license or universally reject every paper document as counterfeit.
A photograph or screenshot of a license is not the same as an authorized mobile credential verified through an approved process. Do not accept a phone image merely because it resembles a card. If the venue lacks a lawful supported method, request accepted evidence and pause or refuse the alcohol transaction according to policy.
Worked service decisions
The unfamiliar military card. A credential lacks height and weight. The server checks the locally approved category and guide rather than declaring it fake because it differs from a state license.
The expired card. House policy requires current accepted identification. Explain that policy calmly and ask for another permitted credential. Do not accuse the guest of being underage solely because the card expired.
The borrowed adult license. The document appears genuine, but the photograph clearly does not match. Decline the sale and obtain support. A valid document belonging to someone else does not establish this guest's age.

Which statement about accepted alcohol identification is accurate?
Every credential must show the same six fields nationwide
Every expired card makes the presenter a minor
Use the applicable document rules and verify the presenter and age
Every government-issued card is automatically accepted everywhere
A genuine adult license clearly belongs to someone other than the presenter. What should the server do?
Serve because the plastic is authentic
Decline the sale and follow the support procedure
Accept a larger tip as secondary evidence
Let the scanner decide whether the faces match
House policy requires current accepted ID, and the guest presents only an expired license. What is appropriate?
Explain the policy and request another accepted credential or decline the transaction
Declare the guest automatically guilty of underage possession
Claim all jurisdictions impose the same offense for an expired card
Ask for a Social Security number instead
