Why group size is an LRE decision, not a schedule leftover
Performance Indicator 0004c asks how students with disabilities succeed academically in one-to-one, small-group, and large-group settings. On the CST 060, the trap is treating group size as a staffing convenience ("we have a para, so pull him") instead of matching the format to the IEP, the task, and New York's continuum rules in 8 NYCRR § 200.6. Least restrictive environment (LRE) is not only which classroom. It is also whether today's grouping still lets the student practice the skill with the peers and curriculum the Committee on Special Education (CSE) intended.
One-to-one: intensive SDI versus isolation
When 1:1 is instructional. One-to-one time is appropriate when the task needs a high rate of active responses, immediate error correction, or a communication mode that cannot be shared yet: beginning phoneme blending with a student who needs 10–15 correct trials per minute; errorless teaching of a new AAC symbol; a discrete new motor or safety skill; or a brief reteach of a misconception before the student returns to the group. Direct consultant teacher (CT) services under § 200.6 may be delivered to an individual student in general education. A resource room program may also be individual for a portion of the day. The IEP should say frequency, duration, and location—not "as needed when staff are free."
When 1:1 isolates. Isolation looks like this: the student is pulled during the only class where peers are doing the same lab or novel; a paraprofessional becomes the de facto teacher of record in the hallway; 1:1 is used because the master schedule has an extra adult, not because the skill requires it; or the student never rehearses the skill in the group size named on the IEP. A 1:1 aide who completes work, answers for the student, or sits as a social wall is not SDI. It is a more expensive form of learned helplessness.
CT time floors (for grouping math). Each student recommended for consultant teacher services must receive direct and/or indirect CT for a minimum of two hours per week. If the student also receives resource room, the combined CT and resource room time must be not less than three hours per week. The IEP must still specify frequency, duration, and location for each service. CT caseload may not exceed 20 students with disabilities assigned to a consultant teacher.
Small groups: homogeneous skill work versus heterogeneous cooperation
Homogeneous skill grouping puts students together because they currently need the same instructional target (for example, silent-e decoding, two-digit regrouping, or a social script for joining a game). It is short-term, flexible, and data-driven. It is not a year-long track labeled by disability. New York resource room composition must be based on similarity of individual needs in four areas: academic or educational achievement and learning characteristics; social development; physical development; and management needs (8 NYCRR § 200.6). Similarity of need is not "all students with autism in period 3" if their reading levels and management needs do not match.
Heterogeneous cooperative groups mix skill levels for a shared product, discussion, or lab. Roles (recorder, materials manager, summarizer) and individual accountability keep the student with a disability from becoming the group's silent guest. Parallel teaching in ICT should not become a special education island: Friend and Cook's parallel groups are heterogeneous halves, not "IEP group with the special educator." Alternative teaching is fluid reteach or preteach, not a daily back-table special class.
If homogeneous groups never change membership, they have become tracking. If heterogeneous groups have no roles or accessible materials, they have become social promotion. The CST wants the teacher who can name which format matches today's objective.
Large-group access: spectators versus responders
Whole-class time fails students with disabilities when the only legal response is a long oral recitation. Universal Design for Learning (UDL) in a large group means multiple ways to respond in the same minute: choral response, mini-whiteboards, response cards, think-pair-share, and digital polls. Those tools raise the response rate for everyone; they are not a consolation prize for the student with an IEP. A student who cannot yet produce a paragraph can still show a claim on a whiteboard. A student who needs wait time can still join a choral read of a key sentence after seeing it in print.
Large-group access also means the special educator is teaching, not hovering. One-teach-one-assist used all period is a grouping failure disguised as inclusion.
New York resource room: the five-student instructional group
A resource room program is specialized supplementary instruction in an individual or small-group setting for a portion of the school day. It supplements general education or special class instruction; it is not provided in place of the student's regular academic instruction, and NYSED's continuum guidance is explicit that a resource room cannot be treated as a study hall. Classroom assignments may be the vehicle for SDI, but the period is not homework dump time.
Instructional group size. An instructional group that includes students with disabilities in a resource room shall not exceed five students per teacher, except that in the city school district of the City of New York the commissioner shall allow a variance of up to 50 percent rounded up to the nearest whole number from that maximum of five—NYSED's continuum Q&A states New York City may increase a resource room instructional group to a maximum of eight students to one teacher. With only one special education teacher assigned, the group cannot exceed five (or the approved NYC/commissioner variance).
Caseload (not the same as group size). The total number of students with a disability assigned to a resource room teacher shall not exceed 20, except that a teacher serving grades seven through twelve or a multi-level middle school program operating on a period basis shall not exceed 25. New York City's 50 percent caseload variance, as restated by NYSED, may increase elementary assignment to 30 and multi-level middle or secondary assignment to 38. Upon application and documented educational justification, the commissioner may also grant a variance from instructional group size and caseload.
Minimum time. Each student requiring a resource room program shall receive not less than three hours per week in that program, unless the student also receives CT, in which case the combined resource room and CT minimum is three hours per week, with each service still specified on the IEP.
Nondisabled students. A resource room may include nondisabled students provided the instructional group that includes students with disabilities still does not exceed five (or the approved variance). You cannot "fill the table" with general education students in a way that blows the SWD group cap.
Related service groups. When a related service is provided to several students at once, the group shall not exceed five students per teacher or specialist, with the same NYC 50 percent variance structure.
ICT: twelve students with disabilities, counted honestly
Under 8 NYCRR § 200.6(g), integrated co-teaching means specially designed instruction and academic instruction provided to a group of students with disabilities and nondisabled students by, at minimum, one general education teacher and one special education teacher. The maximum number of students with disabilities in such a class shall not exceed 12, unless a variance is provided under § 200.6(g)(1)(i)–(ii).
NYSED's continuum guidance is the fact pattern the CST loves: the total of 12 includes any student with a disability in that class, regardless of whether every student is recommended for ICT. Example: two students recommended for resource room and related services plus ten recommended for ICT still equal 12 students with disabilities in that classroom. A variance by notification may temporarily increase the maximum to 13; a further temporary increase to 14 requires the commissioner's prior approval after the notification variance is already in use. Temporary increases do not rewrite the September starting cap of 12.
There is no regulatory maximum number of nondisabled students, but NYSED states the number of nondisabled students should be more than or equal to the number of students with disabilities so the class is not a de facto special class wearing an ICT label. Match the roster to IEP need and intended integration—not to "we had 14 open ICT seats."
Matching group size to the IEP and the task
Ask three questions before you group:
- What does the IEP actually recommend? Frequency, duration, location, and service type (CT, resource room, ICT, special class) are legal statements, not suggestions.
- What does this task need? A new decoding pattern may need 1:1 or a homogeneous group of three. A lab conclusion may need a heterogeneous pair with roles and accessible text. A vocabulary review may need whole-class whiteboards.
- Would this grouping still exist if staffing were awkward? If the only reason for 1:1 is a free adult, it is convenience. If the only reason for a group of seven in resource room outside NYC is overflow, it is noncompliant.

New York classroom example
A Buffalo CSE recommends resource room 5×40 minutes weekly for decoding SDI and ICT for grade-level science. Period 3 science has 11 students with IEPs plus one student with an IEP who receives only resource room and speech in that section—12 students with disabilities, which meets the ICT cap only if no thirteenth SWD is added. The special educator cannot legally run a resource room table of six during period 4 with one teacher outside NYC. She groups three students with similar decoding needs for 40 minutes of supplementary SDI, then returns them to ICT science where whiteboards and choral response keep them in the large-group academic conversation. Pulling the same three students out of the science lab every day because "1:1 is easier" would isolate them from the IEP's ICT recommendation.
