New Jersey maintains a structured, graduated licensing system designed to ensure that operating personnel possess technical competencies proportional to the capacity, operating pressure, and thermal hazard of the plant equipment under their care. Governed by N.J.A.C. 12:90-8, this hierarchy separates operational personnel into Boiler Operators (Firemen) and Stationary Engineers (Engineers).

2. Detailed Breakdown of License Classifications

Black Seal Low Pressure Boiler Operator (no letter grade)

• Operating Scope: Authorizes the holder to operate low-pressure steam boilers where the working pressure does not exceed 15 psig, and low-pressure hot-water heating or supply boilers where the pressure does not exceed 160 psig and water temperature does not exceed 250°F.
• Plant Capacity Limit: Unlimited boiler horsepower — N.J.A.C. 12:90-3.5(c) says so directly — provided the plant remains strictly within low-pressure parameters.
• Eligibility Requirement (12:90-8.5): Either comply with 12:90-8.4 — at least three months as a helper, apprentice, or assistant to a licensed operator of equipment requiring such a license — or complete 30 full working days of one-on-one intensive training in a program established by the responsible management representative and approved by the Bureau within five days of the training start. The trainee needs written verification from the management representative responsible for daily boiler plant operation.

Black Seal Operator In Charge of High Pressure Boiler (license stamped "in-charge")

• Operating Scope: Authorizes the holder to operate high-pressure steam boilers where operating pressure exceeds 15 psig, and high-temperature water boilers where pressure exceeds 160 psig or temperature exceeds 250°F.
• Plant Capacity Limit (12:90-3.9(f)): May act as chief engineer of an installation of 500 BHP or less; may take charge of a shift under a properly licensed chief engineer in installations not over 1,000 BHP; above 1,000 BHP works as a boiler operator under the direction of, and responsible to, the licensed engineer in charge of the shift.
• Eligibility Requirement (12:90-8.6): Either comply with 12:90-8.4 (three months as helper, apprentice, or assistant), or complete six weeks of Bureau-approved one-on-one intensive training established by the chief engineer. If the applicant already holds a low pressure operator license with six months of experience, the three-month requirement drops to 30 days. A separate special license up to 100 horsepower requires only 30 days of experience with such equipment.

Blue Seal Third Grade Steam Engineer (1-C)

• Operating Scope (12:90-3.9(g)): May act as chief engineer of any plant where total capacity does not exceed 1,000 boiler horsepower, 100 engine horsepower, or 65 tons refrigerating capacity.
• Shift Capacity: May act as an operating engineer above those limits under a properly licensed chief engineer; Table 3.4 lists the 1-C blue seal as the shift engineer license for every high-pressure plant above 1,000 BHP.
• Eligibility Requirement (12:90-8.7): Hold the boiler operator in-charge high pressure license plus at least six months of subsequent experience — either operating equipment that requires third-grade supervision, or assisting on equipment that requires a third-grade license for shift operation. Out-of-state experience may be credited after two years as a boiler operator on high-pressure boilers over 500 horsepower.

Red Seal Second Grade Engineer (1-B)

• Operating Scope (12:90-3.9(h)): May act as chief engineer of any plant not exceeding 3,000 boiler horsepower, 500 engine horsepower, or 300 tons refrigerating capacity.
• Shift Capacity: May act as operating engineer above those limits under a properly licensed chief engineer.
• Eligibility Requirement (12:90-8.11): Hold a third grade license plus at least one year of subsequent practical experience operating equipment requiring second- or first-grade supervision. Equivalent experience from another jurisdiction may be substituted with Bureau approval.

Gold Seal First Grade Engineer (1-A)

• Operating Scope (12:90-3.9(i)): "May act as chief engineer in any plant" — no horsepower, pressure, or capacity ceiling.
• Eligibility Requirement (12:90-8.12): Hold a second grade license and then satisfy any one of three routes: (1) serve one year as chief engineer in a plant requiring second-grade supervision; (2) log two years of subsequent practical experience as an operating engineer in a plant requiring first-grade supervision; or (3) document equivalent experience and licenses from another jurisdiction, with that jurisdiction's licensing and eligibility requirements attached to the application.

[!TIP] The 50 percent substitution rule. N.J.A.C. 12:90-8.13(a) lets an applicant substitute non-operating experience — servicing, maintenance, repair, or installation of the equipment — or proof of completed formal education or academic study covering such equipment, for up to 50 percent of the experience required by 12:90-8.4 through 8.12. It cannot replace all of it.

[!WARNING] Read the code the right way round. 2-C is a third grade refrigeration engineer (12:90-8.8), not a "combined steam and refrigeration" license. 3-C is a nuclear engineer's license, which requires a United States Nuclear Regulatory Commission qualification (12:90-8.9) — it has nothing to do with a black seal. Any table that maps A/B/C to specialties instead of grades is inverted.

4. Examination Rules, Renewal & Disciplinary Procedures

Examination Scoring (N.J.A.C. 12:90-8.15)

New Jersey does not use one universal cut score. The passing grade depends on which license you sat for:

Re-Examination (N.J.A.C. 12:90-8.16)

• An applicant who fails may not be re-examined for at least three months, but may be allowed one re-examination without additional charge within six months of the original examination.
• If unsuccessful again, the applicant may be re-examined within three months. Failing to appear after being called for re-examination a third time cancels the application.
• After a third failure or a cancelled application, wait three months, then submit a completely new application form with the appropriate fee.
• Neither failure to appear nor a failing grade entitles an applicant to any refund (12:90-8.14(d)).

License Renewal (N.J.A.C. 12:90-8.19)

• Renewal is done by returning the signed identification card with a fee of $80.00 for a one-year renewal or $160.00 for a three-year renewal — the licensee chooses the term; there is no mandatory triennial cycle.
• A license may be renewed within 60 days prior to its expiration date, and expires unless renewed before or during the anniversary month shown on the license. Changing grade or adding a classification does not move that anniversary date.
• A late renewal is approved if the fee is $120.00 for one year or $240.00 for three years when no more than four months late, the application is made within three years of expiration, and all penalties under N.J.S.A. 34:7-6 are paid.
• A license expired more than three years is treated as an original application, and the Bureau may destroy the records after three years and one day (12:90-8.19(d)).
• Under 12:90-8.18(d), a license is automatically cancelled on the last day of its expiration month, and performing licensee duties on an expired license carries a penalty of $500 minimum to $5,000 maximum per day — for the supervisor and employer as well.

Administrative Penalties, Suspension, and Revocation

Under N.J.A.C. 12:90-8.18, the Commissioner may suspend or revoke any license, and a licensee may request a hearing before one or more members of the Examining Board under N.J.S.A. 34:7-3, with appeal to the Commissioner under N.J.A.C. 12:90-9:

[!CAUTION] Grounds for Suspension or Revocation (N.J.A.C. 12:90-8.18):

1. Incompetence or Negligence: Unsafe operating practices or a lack of technical knowledge resulting in equipment damage or life-safety risk (12:90-8.18(a)).
2. Intoxication or Drug Abuse While on Duty: Named explicitly in 12:90-8.18(a).
3. Any Other Valid Reason establishing that the licensee is unfit to hold a license — the catch-all in 12:90-8.18(a) that covers abandoning an operating high-pressure boiler.
4. Loss of Personal Control of the License: Under 12:90-8.18(b), a license or identification card that is loaned, abandoned, or allowed to pass from the personal control of the named holder must be surrendered and is immediately revoked.
5. Fraud: Under 12:90-8.18(e), obtaining a license by fraudulent means invalidates the license and exposes the holder to prosecution and a penalty up to $5,000.
6. Failure to Appear at a Hearing: Under 12:90-8.18(f), not appearing for a requested hearing suspends the license indefinitely.
