Beyond the scheduled cycle, 50-74-209(2) makes it the duty of each inspector to examine, at proper times and whenever in the inspector's opinion an examination is necessary, all boilers that have become unsafe from any cause, and to notify the owner or user of any defect and what repairs are necessary to render the boiler safe.

50-74-209(3) supplies the enforcement teeth: if a boiler is found on inspection to violate the safety standards in the rules referred to in 50-74-101, the department orders the owner to comply. Note the asymmetry in the penalty structure. Operating without an operator's license under 50-74-315 draws $50 to $100 and up to 60 days. Operating without a boiler certificate, or failing to notify the department when a boiler is opened, draws $100 to $500 and 30 to 90 days under 50-74-208 — several times heavier, with a minimum jail term written into the statute.


4. What the Inspector Examines — MCA 50-74-215 and 50-74-217

MCA 50-74-215 requires the inspector to determine by thorough examination, interior and exterior, that the boiler is well made, of suitable material, that the water and steam passages are of proper dimension and free from obstruction, and that the boiler may be safely employed without danger to life. Practically, that means the two-part cycle every stationary engineer knows:

  1. External (on-line) inspection — the boiler under steam pressure: safety valve condition and seals, gauge glass and water column, low-water fuel cutoff operation, burner and flame safeguard function, controls, piping, supports, and general condition.
  2. Internal (out-of-service) inspection — the boiler cooled, drained, opened, and cleaned: fireside for soot, refractory, tube ends, and warpage; waterside for scale, pitting, grooving, cracked ligaments, and deposit accumulation in the lowest points.

MCA 50-74-217 authorizes other inspection requirements as the department prescribes by rule.


5. Hydrostatic Testing — MCA 50-74-216

"When necessary, the boiler inspector shall subject boilers, except those exempted by 50-74-103, to hydrostatic pressure, which hydrostatic pressure shall not exceed 150% of the steam pressure allowed on the boilers, providing there are no such leaks on such boilers which prevent the inspector from applying such hydrostatic pressure."

Three things follow from that sentence:

  1. The ceiling is 150 percent of the allowed steam pressure. A boiler permitted at 150 psig may be tested to no more than 225 psig. This aligns with the familiar ASME Section I shop test at 1.5 × MAWP, but Montana states it as a statutory maximum on the inspector.
  2. The test is discretionary, not routine. The statute says "when necessary." Hydrostatic testing follows repair, alteration, suspected leakage, or a condition the inspector wants to resolve — not every inspection.
  3. Pre-existing leakage defeats the test. If the boiler leaks badly enough that the inspector cannot hold pressure, the hydrostatic test is not performed; the leak is the finding.

Standard engineering practice still governs execution: fill completely with water between 70 °F and 120 °F to stay above the ductile-to-brittle transition of the carbon steel while avoiding thermal stress and scald hazard, vent all trapped air, and gag safety valves hand-tight or blank them off — never tighten the compression screw, which permanently alters the set pressure and can bend the spindle.


6. Safe Working Pressure Factors — MCA 50-74-218

Montana's safe-working-pressure section is written for riveted and stayed construction, which is exactly what an inspector faces on Montana's surviving historic and traction boilers. The safety factor is the divisor applied to the material's ultimate strength when computing allowable pressure — a higher factor means a lower permitted pressure.

Why lap seams get the heavier penalty

In a lap seam the two plates overlap and the rivet line is offset from the plate centerline, so internal pressure applies an eccentric bending moment at the joint. Repeated flexing at that offset is the classic origin of seam grooving and caustic-embrittlement cracking along the rivet line. A butt strap seam butts the plates edge to edge and covers the joint with straps, keeping the load nearly in-plane. Montana's higher 4½ factor for lap seams — and the jump to 5 when a lap seam is fired or when the boiler's own weight hangs on the seam — reflects that mechanical reality.

Worked example. A riveted boiler with butt strap horizontal seams and sound stay bolts carries a factor of 4. Re-set the same shell on lugs so the weight pulls against the horizontal seam and 50-74-218(4) raises the factor to 5. Because allowable pressure varies inversely with the factor, the permitted pressure drops by 4 ÷ 5, that is by 20 percent. A 100 psi allowance becomes 80 psi with no change to the metal at all.
