Mental Health Crises: Health Officer Holds (MN Stat. § 253B.051)

When responding to individuals experiencing mental health crises, peace officers prioritize safety, de-escalation, and medical intervention.

The Hold Standard

Under the Minnesota Civil Commitment Act, a peace officer (or a health officer, such as a licensed doctor or social worker) may take an individual into custody and transport them to an appropriate treatment facility for emergency admission if the officer has reason to believe that:

1. The person has a mental illness, developmental disability, or chemical dependency; and
2. The person is in imminent danger of injuring themselves or others if not immediately detained.

The Emergency Hold Process

This process, commonly referred to as a "Peace Officer Hold" or "Health Officer Hold," is not an arrest. It is a civil protective custody procedure.

• Documentation: The officer must complete a written application for emergency admission. This application must state the specific circumstances and observable behaviors under which the person was taken into custody. It cannot be based on hearsay alone; the officer must detail the articulable facts indicating imminent danger.
• Duration: The receiving facility may hold the patient for up to 72 hours, excluding Saturdays, Sundays, and legal holidays. During this time, the patient must be examined by a medical professional to determine if civil commitment proceedings are necessary.

Gang Identification Criteria (MN Gang Pointer File)

To track and combat gang-related crime, Minnesota law enforcement agencies utilize the Minnesota Gang Pointer File, managed in accordance with standards set by the Minnesota Department of Corrections and the Department of Public Safety.

Classification Threshold

To classify an individual as a gang member and enter their name into the Gang Pointer File, a peace officer must document that the individual meets three or more of the established gang identification criteria within a specified timeframe.

The Ten Criteria

The established criteria for identifying gang membership are:

1. Self-Admission: The individual admits to being a member of a gang.
2. Reliable Source: A reliable informant or source identifies the individual as a gang member.
3. Untested Source with Corroboration: An untested source identifies the individual, and the information is corroborated by independent physical or circumstantial evidence.
4. Style of Dress / Colors: The individual wears clothing, colors, or accessories associated with a specific gang.
5. Graffiti / Symbols: The individual is observed writing, using, or possessing gang-specific graffiti, logos, or symbols.
6. Hand Signs: The individual uses hand signs or gestures unique to a specific gang.
7. Tattoos / Brands: The individual has tattoos, brands, or physical markings associated with gang membership.
8. Arrested with Known Members: The individual is arrested in the company of known gang members for gang-related activity.
9. Association: The individual is observed associating or hanging out with known gang members.
10. Written / Electronic Communication: The individual corresponds with known gang members through letters, electronic messages, or photos showing gang association.
