An indemnity clause in a disposal contract may give the generator a claim against the vendor, but it does not stop EPA from naming the generator as a Potentially Responsible Party decades later. Vendor selection is therefore a liability decision that the CHMM owns.
1. The Waste Profile (Waste Profile Sheet / Waste Characterization Form)
A waste profile is the generator's certified description of a waste stream, submitted to the receiving facility for pre-acceptance before a single drum ships. It is signed by an authorized representative and is typically recertified annually or whenever the generating process changes.

Follow the receiving facility's profile instructions. Many commercial TSDF profiles require the listed constituents and matrix to total 100 percent. A profile that lists only the hazardous constituents (for example, "40% methanol, 15% toluene") and leaves 45 percent unstated is the most common reason a profile is returned. The TSDF must know the whole matrix to design treatment and to avoid an incompatible-mixing incident in its tank farm.
Why an inaccurate profile is expensive
The receiving facility operates under a waste analysis plan required by 40 CFR § 264.13. Every incoming load is verified against its profile by fingerprint analysis — a rapid battery of tests (pH, flash point, water reactivity, layering, halogen screen, specific gravity) run at the gate. A material discrepancy can lead to rejection or a corrected/reconciled manifest under §§ 264.71 and 264.72. The facility must follow the manifest discrepancy or rejected-load procedures that match what occurred; a fingerprint mismatch does not automatically establish one universal enforcement outcome.
2. Qualifying and Disqualifying a Disposal Facility
The generator's evaluation is normally organized as a desktop review followed by an on-site audit, then repeated on a fixed cycle (commonly every three years, and immediately upon a significant enforcement event).
Desktop review — the disqualifying findings
- Permit status. Does the facility hold a current RCRA Part B permit (or interim status) that expressly authorizes the specific waste codes and the specific management method you intend to use? A permit that covers storage but not treatment does not authorize treatment.
- Compliance history. Query EPA ECHO and RCRAInfo, plus state enforcement dockets, for notices of violation, consent orders, penalties, and Significant Non-Complier status over at least the last three to five years. Look for repeat violations of the same requirement — a pattern is far more predictive than a single citation.
- Financial assurance. Verify closure, post-closure, and liability coverage under 40 CFR Part 264 Subparts G and H. Under § 264.147, minimum liability coverage is $1 million per occurrence with a $2 million annual aggregate for sudden accidental occurrences, and for surface impoundments, landfills, land treatment units, and waste piles an additional $3 million per occurrence with a $6 million annual aggregate for non-sudden accidental occurrences, in each case exclusive of legal defense costs.

On-site audit — what to look at
Container storage condition and aisle space, tank integrity and secondary containment, the laboratory and its fingerprinting throughput, the waste analysis plan in practice, groundwater monitoring well network and recent data, the contingency plan and emergency equipment, personnel training records, closure plan and cost estimate currency, security, and open enforcement correspondence. Many generators pool this effort through cooperative audit programs rather than each sending a separate team.
Documentation that closes the file
Retain the audit report, the permit copy, the financial assurance certificates, the compliance-history search results, and the approval memo. If EPA later names your company as a PRP, this file is the evidence that the selection was reasonable and diligent.

The certificate of disposal is the item candidates most often overlook. The manifest system proves the waste arrived; it does not prove it was destroyed. A drum can sit in a permitted storage building for months under a valid manifest. When a contract, a state P2 statute, or a corporate standard requires proof of final disposition — and especially for PCB waste, where 40 CFR § 761.218 requires a Certificate of Disposal within 30 days of disposal — the certificate is the controlling document.
Exam trap. The 35-day and 45-day figures are LQG deadlines under § 262.42(a), and 60 days is the SQG figure under § 262.42(b). Do not confuse either with the 15-day window a TSDF has under § 264.72 to resolve a significant manifest discrepancy before reporting it to EPA, or with the 3-year manifest retention period.
