12.1 Professional Development and Establishing a Compliant Practice

Technical knowledge decays quickly in migration practice. OCS Standard 7 therefore treats professional development as an evidence-based cycle. Standard 8 applies the same discipline to establishing a business capable of delivering ethical services.

Standard 7: a development cycle

Begin with a written self-assessment against the OCS and the actual work performed. Use file audits, missed issues, research time, complaints, questions deferred to others, and changes in law to identify gaps. Be specific: “improve employer-sponsored practice” is weaker than “update SID salary-instrument research and nomination evidence review before accepting the next Core Skills matter.”

Seek external assessment from peers, supervisors, staff, clients, mentors, and professional networks. Feedback should be objective and recorded. Compare it with the self-assessment; recurring communication problems may matter even if legal outcomes were successful.

Create a plan with learning outcome, activity, provider or mentor, deadline, practice exercise, and evidence that competence improved. Formal CPD can contribute, but so can structured reading, supervised work, peer review, simulation, and reflection. Keep the records required for registration and a separate learning log explaining what changed in practice.

The current CPD minimum does not define full competence. Passing a one-point course cannot justify accepting a complex matter without adequate skill and supervision.

Business plan and identity

OCS 8.1 requires a business plan suited to the practice: clients, services, demand, pricing, capacity, capital, cash flow, compliance cost, technology, risks, and review cycle. Stress-test low-volume periods, refunds, cyber incidents, illness, and legislative change. Update the plan when evidence contradicts assumptions.

OCS 8.2 requires a lawful identity and positioning. Select specialisations that match competence. Branding must display MARNs correctly and avoid implying government affiliation, superior access, or guaranteed results. Search and register business names and obtain intellectual-property or other professional advice where needed.

Structure and office systems

Under OCS 8.3 and 8.4, choose a structure after appropriate legal, tax, accounting, employment, and insurance advice. A company does not remove the individual RMA’s professional duties. Define responsible agents, supervision, delegations, complaint handling, authority during absence, and business-continuity arrangements.

Premises and remote-work systems must preserve privacy and accessibility. Establish secure telephone, email, portal, mail, video, and document processes. Use multi-factor authentication, least-privilege access, tested backups, patching, device management, incident response, and secure disposal. Design intake and file templates around the current Code, then review them when law changes.

Filing, money, and marketing

OCS 8.5 requires a reliable filing system with naming, version control, deadline alerts, retention, backup, and recovery tests. OCS 8.6 requires appropriate client-money accounts and records. Section 50 controls must be reflected in the banking setup and ledgers; stronger reconciliation procedures may be adopted as risk controls without misdescribing them as express Code rules.

OCS 8.7 requires target-market research and an ethical marketing plan. Obtain written authority before using a testimonial or client story, avoid revealing immigration status, disclose material commercial interests, monitor lead generators, and ensure translated promotion is accurate. Measure whether marketing attracts matters the practice is competent and resourced to handle.

Scenario

An RMA launches a home-based practice using a personal email, shared family laptop, generic agreement, and paid testimonials copied from messages. The business may be registered, but the operational design fails privacy, security, records, informed-consent, and marketing controls. Before taking clients, the agent should obtain structural advice, implement secure systems and backups, tailor compliant documents, create client-money controls, obtain specific testimonial consent, and test the continuity plan.

Readiness test before opening

Before accepting the first client, simulate an end-to-end matter: conflict search, identity verification, consumer guide, agreement, payment, client-money deposit, document upload, deadline alert, advice note, invoice, refund, original return, complaint, staff absence, backup restoration, and seven-year archive retrieval. Record failures and repeat the test after remediation. Maintain a vendor register for cloud storage, practice software, interpreters, translators, accountants, and lead generators, with privacy, security, continuity, and access-offboarding checks. The business plan should calculate the number and complexity of matters one responsible RMA can genuinely review, not merely the number sales can acquire. Establish an emergency custodian or succession arrangement consistent with confidentiality and client instruction. Review templates and marketing against the current Code and 2026 Regulations. A practice is ready when its controls work under test and named people know their responsibilities, not when its website and company registration are complete.
