1.5 Licenses, Releases, Fonts, and Ethical Use
Key Takeaways
Identify the exact CC license and version before sharing an adaptation.
A stock license and a model release address different rights.
Check font handoff and AI terms for the intended use.
Creative Commons, Stock Licenses, and Releases
Read the exact Creative Commons license
BY requires attribution; NC restricts commercial uses; SA requires shared adaptations to use the same or a compatible license; ND restricts sharing adaptations. In version 4.0, ND allows private adaptations but does not authorize distributing them. Technical format changes do not automatically constitute an adaptation, and whether a crop is an adaptation depends on the change and applicable law. A substantive retouch or composite meant for public advertising should use an adaptation-permitting license or separate permission.
| License | Commercial use | Sharing adaptations |
|---|---|---|
| CC BY | Permitted with conditions | Permitted with attribution and change notice |
| CC BY-SA | Permitted with conditions | Same or compatible license required |
| CC BY-ND | Permitted with conditions | Not permitted under ND |
| CC BY-NC | Restricted to noncommercial purposes | Permitted within NC and other terms |
| CC BY-NC-SA | Restricted to noncommercial purposes | NC plus ShareAlike conditions |
| CC BY-NC-ND | Restricted to noncommercial purposes | Not permitted under ND |
Retain the creator, title when supplied, source URL, license link/version, and a record of changes. Attribution does not cure a prohibited use. A paid client’s advertisement should not use an NC asset without another authorization. A BY license does not grant the depicted person’s publicity rights.
Royalty-free and rights-managed assets
A royalty-free license normally permits reuse within its terms without a new royalty for each authorized use. It can require payment; the term does not mean public domain or copyright ownership. Free-of-charge royalty-free licenses also exist. Check restrictions on impressions, reproductions, merchandise, templates, sensitive uses, and redistribution of the source file. Numerical limits vary by provider and product, so never treat one library’s print ceiling as a universal limit on all web views.
A rights-managed license defines negotiated uses such as territory, medium, term, and quantity. Exclusivity is available only if the actual agreement grants it. Reuse beyond the agreement requires additional clearance. Keep the receipt and license, not just the downloaded image.
People, locations, property, and fonts
A model release documents consent to use a person’s recognizable likeness for specified purposes. Commercial stock suppliers generally require releases for recognizable people. Identifiability can come from a face, tattoo, or distinctive context. Obtain appropriate guardian consent for a minor. A photographer’s copyright license and a subject’s release solve different problems.
A property or location release addresses permission associated with property or access. Requirements depend on the property, artwork, jurisdiction, provider rules, and intended use. Do not assume every photograph of private property legally needs a release, or that editorial use clears every restriction. Check the specific location’s access conditions and any depicted copyrighted art or protected branding.
Restricted fonts require their own license review. A desktop font license may permit static artwork yet prohibit distributing the font software, web embedding, or embedding in editable templates. Outlining text does not grant rights the license withholds. Supply a font list or licensed acquisition path when handing off a layered file; do not package another party’s font files without permission.
Ethical retouching and AI-generated content
Documentary imagery should preserve factual context. Follow the publication’s policy on cropping, exposure correction, object removal, and compositing. Advertising should not misrepresent what a product achieves. A generated demonstration of a result is not proof that a product works. Label synthetic content when required by the client, platform, or applicable rules, and retain provenance information when available.
Generative AI does not automatically clear rights in logos, characters, or identifiable people. Provider terms and indemnity provisions have conditions. Inspect outputs and obtain client approval for substantive changes; a content-provenance record is useful evidence of workflow, not a permission license.
Worked asset-clearance exercise
A client wants a cropped photograph of a musician, decorative lettering, and a generated product background. Start by obtaining the photo’s permitted advertising uses, then verify likeness permission separately. Review whether the font permits the required final file and client handoff. Check the AI provider’s terms, remove unintended trademarks, and document the changes. If the photograph is BY-ND and the planned composite is an adaptation, obtain separate permission or choose another source. A prominent credit line alone does not authorize that adaptation.
Before export, inspect each asset’s rights record, distribution medium, audience, duration, and permitted editing. Preserve the layered master and a copy of the approved brief so later reuse can be assessed against the same facts.
