1Under Article 1 of Taiwan's Trust Law (信託法), which of the following is the statutory definition of a trust?
A.A legal relationship where the settlor transfers or disposes of property rights to the trustee, who manages or disposes of the trust property for the benefit of a beneficiary or for a specified purpose
B.A contract where a debtor pledges property to a creditor to secure a debt obligation
C.An agency agreement where a principal authorizes an agent to conduct transactions on the principal's behalf without transferring property rights
D.A bailment contract where a bailee holds personal property for safekeeping without acquiring ownership
Explanation: Trust Law Article 1 involves a transfer or disposition of property rights to a trustee for management under the trust's terms. The trustee acts for beneficiaries or a specified purpose, rather than becoming free to use the property for personal benefit.
2Under Trust Law Article 4, what formality is required for a trust of Taiwan land and buildings to be asserted against third parties?
A.Trust registration (信託登記) with the competent land registry office
B.Notarization by a court notary only without land registry record
C.Signing the trust deed without completing trust registration
D.Registering only a mortgage in favour of the beneficiary
Explanation: Trust Law Article 4 requires trust registration for registrable property rights before the trust may be asserted against third parties. Signing or notarizing the trust act alone does not replace the required land registration for this real estate.
3Under Article 12 of the Trust Law, what is the core legal rule regarding compulsory execution (強制執行) against trust property by creditors?
A.Execution is generally prohibited, with exceptions for pre-existing rights in the property, rights arising from trust administration, and other statutory exceptions
B.Creditors of the settlor can freely seize trust property at any time
C.Creditors of the trustee can attach trust property to satisfy the trustee's personal private debts
D.Trust property is subject to automatic court seizure upon bankruptcy of the beneficiary
Explanation: Article 12 generally protects trust property from execution. It preserves execution based on pre-existing rights in that property, rights arising from trust administration and other exceptions provided by law, so segregation does not eliminate every creditor right.
4Under Article 11 of the Trust Law, what happens to trust property if the trustee is adjudicated bankrupt?
A.Trust property does not belong to the trustee's bankruptcy estate (破產財團) and cannot be distributed to the trustee's personal creditors
B.Trust property is liquidated and distributed pro rata to the trustee's personal creditors
C.Beneficiaries lose their rights in the continuing trust and receive only ordinary unsecured claims against the bankrupt trustee
D.The trust property immediately reverts to the settlor's personal estate
Explanation: Article 11 excludes trust property from the trustee's bankruptcy estate. This segregation protects the trust from the trustee's personal insolvency, without erasing valid claims against the trust property itself.
5Under Article 6 of the Trust Law, what legal remedy is available to a creditor if a settlor creates a trust knowing that it will harm the rights of the creditor (fraudulent conveyance)?
A.The creditor may apply to the court for revocation (rescission / 撤銷) of the trust
B.The creditor may unilaterally take possession of the trust property without court order
C.The trust is automatically void without any court proceeding
D.Only the trustee may seek a remedy; the harmed creditor has no standing
Explanation: Article 6 permits a creditor to seek court revocation of a trust act harmful to the settlor's creditors. The provision does not make knowledge by the settlor an additional express condition for that basic remedy; protection of benefits already received has separate conditions.
6Under Article 7 of the Trust Law, what is the statute of limitations for a creditor to exercise the right of revocation against a fraudulent trust?
A.1 year from the time the creditor knows of the cause for revocation, or 10 years from the creation of the trust
B.6 months from the date of the trust contract
C.2 years from the date of bankruptcy
D.5 years from the date of court judgment
Explanation: Article 7 extinguishes the revocation right one year after knowledge of its cause or ten years after the trust act. The knowledge-based period does not extend the outside ten-year limit.
7Under Article 22 of the Trust Law, what standard of care is a trustee legally obligated to exercise in managing trust affairs?
A.The duty of care of a good administrator (善良管理人之注意義務)
B.The same care the trustee exercises in their own personal affairs (具體輕過失 / 與處理自己事務為同一之注意)
C.Strict absolute liability without fault defense
D.No duty of care unless gross negligence is proven
Explanation: Article 22 requires the care of a good administrator (善良管理人之注意義務) when administering the trust. Serving without remuneration does not lower that statutory standard of care.
8Under Article 24 of the Trust Law, how must a trustee handle trust property relative to the trustee's personal property and other trust properties?
A.Separate trust property from personal property and generally from other trusts, subject to permitted pooling and separate-accounting rules for money
B.Commingle all trust funds with the trustee's personal checking account for convenience
C.Pool different trusts without the required trust-term permission and without records identifying each trust's interest
D.Treat the trust assets as proprietary capital while retaining a separate client list
Explanation: Article 24 requires separation from the trustee's own property and other trusts. Money may be separated through accounting records, and the trust terms may permit joint administration between different trusts; these exceptions do not convert trust money into the trustee's proprietary funds.
9Under Trust Law Article 35, which statement correctly describes a trustee acquiring trust property for their own account?
A.Generally prohibited, with exceptions including written beneficiary consent and market-price acquisition, competitive exchange-market acquisition, or unavoidable circumstances approved by a court
B.Freely permitted at the trustee's sole discretion
C.Permitted whenever an independent appraisal confirms a fair price, even without another statutory condition
D.Permitted solely because the trustee's board approves it
Explanation: Article 35 prohibits conversion of trust property into the trustee's own property or acquisition of rights over it unless a statutory exception applies. Written beneficiary consent must be paired with market-price acquisition; the other specified routes include competitive exchange-market acquisition and court permission for unavoidable circumstances.
10Under Trust Law Article 28, co-trustees disagree on a non-routine transaction. No trust term permits individual action and no preservation measure is involved. How is the disagreement resolved?
A.Obtain all beneficiaries' consent; if beneficiaries disagree, apply for a court ruling
B.Use a simple majority of co-trustees, regardless of beneficiary views
C.Allow the co-trustee administering the largest asset to decide alone
D.Treat disagreement as automatic termination of the trust
Explanation: Article 28 generally requires joint administration, subject to its routine-business, preservation and trust-term exceptions. If trustees disagree, all beneficiaries' consent is required; if the beneficiaries disagree, a court ruling can be sought. It does not provide a simple majority rule among co-trustees.

Taiwan Trust Business Specialist Examination: Suggested Study Strategy

1Study trust-property independence together with Article 12 exceptions for pre-existing rights, trust-administration claims and other statutory cases.
2Distinguish non-discretionary specific money trusts (特定金錢信託), discretionary mandates, collective management accounts (集合管理運用帳戶) and common trust funds (共同信託基金).
3Trace Trust Enterprise Act Article 38 to Banking Act Article 50 for the ordinary 30% legal-reserve appropriation and its exceptions; distinguish this from the Article 34 compensation reserve.
4Review the tax rules applying to trusts under Taiwan's Income Tax Act, Land Tax Act, and Estate and Gift Tax Act, especially when the beneficiary is not the settlor (gift tax implications).

Frequently Asked Questions

What is the passing requirement for the Trust Specialist Examination?

Candidates must achieve an aggregate score of at least 140 points across the two subjects (out of 200 total), provided that neither subject score falls below 60 points.

How often is the examination offered?

TABF lists paper and computer-based sittings in 2026. Availability and locations vary; consult the current registration listing rather than assuming every center offers a test each week.

Is the official test entirely multiple-choice?

Yes. There are 50 four-option single-answer questions in Trust Laws and Regulations and 80 in Trust Practice, in Traditional Chinese. Each subject is worth 100 points. The handbook specifies no essay, oral, practical or assignment component; this English MCQ adaptation is not an official translation or simulation.

Does passing this test fully license someone to practice?

No. A new entrant using the examination route generally also needs the Financial Markets Knowledge and Professional Ethics common subject unless exempt, plus applicable personnel registration and employment requirements. Other statutory qualification routes exist, so this examination is not the only route for every trust employee.
