1Under Taiwan's Civil Code reform effective January 1, 2023, at what age does a natural person reach the age of majority (成年)?
A.18 years of age
B.20 years of age
C.21 years of age
D.16 years of age if married with parental consent
Explanation: Civil Code Article 12 sets the age of majority at 18. The amendment took effect on January 1, 2023 under the Enforcement Act for the General Principles of the Civil Code. Article 13 instead concerns the capacity of minors; adulthood does not override a separate guardianship declaration.
2A and B enter into an agreement whereby A pays B NTD 500,000 to induce a municipal councilor to vote for a specific development zoning change. What is the legal status of this contract under Taiwan's Civil Code?
A.Void ab initio (無效) as contrary to public order and good morals (公共秩序或善良風俗)
B.Voidable (得撤銷) upon notice by either party within one year
C.Valid, but the agreed fee is unenforceable in court
D.Valid because the payment is made to an intermediary rather than directly to the councilor
Explanation: Under Article 72 of the Civil Code, a juridical act which is contrary to public order or good morals is void. Bribery or paying consideration to improperly influence public voting functions violates fundamental public order, rendering the contract null and void ab initio.
3Party C fraudulently induces Party A to sell real property to Party B at an artificially depressed price. Party B has no knowledge of C's fraud and is not negligent in failing to know. Under Article 92 of Taiwan's Civil Code, may Party A revoke the declaration of intent against B?
A.No, because fraud perpetrated by a third party allows revocation only if the counterparty knew or ought to have known of the fraud
B.Yes, because fraud always renders a declaration of intent unilaterally revocable regardless of counterparty knowledge
C.Yes, but A must pay complete compensation for reliance damages before revoking
D.No, because third-party fraud can never affect a contract, even if the counterparty knows about it
Explanation: Under Article 92, Paragraph 1, proviso of the Civil Code, where the fraud was committed by a third party, the expression of intent may be revoked only if the relative (counterparty) knew or ought to have known of the fraud. Because B was bona fide and not negligent, A cannot revoke the declaration against B.
4Without authority, Agent X purports to sell Principal P's luxury vehicle to Buyer B. Buyer B was aware at the time of contracting that X possessed no power of attorney. Which right may Buyer B exercise under Articles 170 and 171 of Taiwan's Civil Code?
A.Buyer B may fix a reasonable period and demand that Principal P clarify whether P ratifies the contract (催告權)
B.Buyer B may unilaterally rescind (撤回) the contract before Principal P ratifies it
C.Buyer B may recover damages from Agent X for unauthorized agency despite B's prior knowledge
D.Buyer B may compel Principal P to ratify because B has already accepted the offer
Explanation: Under Article 170, Paragraph 2, the counterparty may demand that the principal confirm ratification within a reasonable time limit. Under Article 171 proviso, the counterparty's right of rescission (撤回權) is unavailable if the counterparty knew that the agent lacked authorization at the time the act was performed.
5Principal P hands his registered chop (印鑑章) and real property deed certificates to Associate A for the sole purpose of applying for a building permit. Associate A uses these documents to execute a mortgage over P's land with bona fide Bank M. Under Article 169 of the Civil Code and Taiwan Supreme Court precedents, what determines P's liability for apparent agency (表見代理)?
A.P is liable only if P's manifestation or entrustment of documents led Bank M reasonably to believe A had authority to mortgage, unless Bank M was negligent
B.P is strictly liable as guarantor whenever an agent holds the principal's registered chop
C.P is never liable because handing over documents for administrative permits can never constitute apparent authority for financial encumbrances
D.P is liable only if P subsequently received and retained a financial benefit from the mortgage loan
Explanation: Article 169 requires an appearance of authority attributable to the principal and excludes a third party who knew or could have known of the lack of authority. Supreme Court precedent 70台上字第657號 distinguishes entrusting a seal for a particular purpose from authorizing every transaction undertaken with it. P's liability therefore depends on the relevant outward appearance and M's justified reliance, rather than possession of the chop alone.
6Landlord L leases a commercial apartment to Tenant T. Tenant T fails to pay monthly rent for six consecutive months in 2024. Under Article 126 of Taiwan's Civil Code, what is the extinctive prescription (消滅時效) period for L's claim to recover accrued rent arrears?
A.5 years
B.15 years
C.2 years
D.1 year
Explanation: Article 126 provides a five-year prescription period for rent and the other listed periodic payments falling due at intervals of a year or less. That specific period takes priority over Article 125's residual fifteen-year rule. The fact that six monthly installments are unpaid does not change the applicable period for each installment.
7Seller S offers in writing to sell 100 industrial machines to Buyer B for NTD 1,000,000, specifying that acceptance must reach S by May 1. B posts acceptance on April 25, but due to postal congestion, the letter arrives on May 5. S immediately notifies B that the acceptance arrived late. Under Taiwan's Civil Code, what is the legal effect of B's late acceptance?
A.The acceptance is deemed a new offer by Buyer B (新要約)
B.The contract was concluded on April 25 under the postal mailbox rule
C.The contract was formed on May 1 despite the postal delay
D.The late acceptance is legally incapable of operating as a new offer without a second letter from B
Explanation: Under Article 160, Paragraph 1 of the Civil Code, an acceptance which arrives late is deemed to be a new offer. Furthermore, under Article 158 and Article 159, because S dispatched an immediate notice of delayed arrival to B, the late arrival prevents contract formation and converts the acceptance into a new offer.
8Artist A personally contracts to paint an original portrait for Patron P. Before work begins, A dies in an unavoidable accident for which neither contracting party is responsible. The contract permits no substitute artist, and no work has been delivered. Under Taiwan's Civil Code, what happens to the reciprocal obligations?
A.A is relieved of the obligation to paint, and P is relieved of the obligation to pay under risk of price rules (危險負擔)
B.A remains obligated to deliver the painting through an appointed substitute artist
C.P must pay the full contract price because the accident was not attributable to Patron P
D.A must pay compensatory damages for breach of contract to P regardless of fault
Explanation: Under Article 225, Paragraph 1, the debtor is relieved of the obligation to perform if performance becomes impossible due to circumstances for which the debtor is not responsible. Under Article 266, Paragraph 1, if one party is relieved of performance due to impossibility not attributable to either party, the other party is also relieved of counter-performance (bearing the risk of price).
9Debtor D is in default (給付遲延) for delivering a specific antique vase to Creditor C. During D's delay, an unprecedented 7.5-magnitude earthquake destroys D's warehouse and shatters the vase. Under Article 231, Paragraph 2 of Taiwan's Civil Code, how is D's liability determined?
A.D is liable for damages unless D proves that the vase would have perished even if performance had been delivered on time
B.D is completely exempt from liability because an earthquake is a force majeure event
C.D is liable only if Creditor C can prove that D acted with gross negligence during the earthquake
D.D's liability for the loss is automatically capped at the original delivery price
Explanation: Article 231, Paragraph 2 makes a debtor in delay responsible even for loss caused by force majeure during that delay. The debtor can avoid that heightened responsibility by proving the same loss would have occurred with timely performance. The earthquake therefore does not by itself exempt D; the counterfactual inevitable-loss defense must be established.
10Feed Supplier F negligently contaminates poultry feed and delivers it to Farmer P. The defective feed kills P's existing flock and contaminates the farm soil. The losses are proved to result from F's negligent performance. Under Article 227 of Taiwan's Civil Code, what remedy is available to P?
A.Farmer P may claim damages for incomplete performance (不完全給付), covering both defect damages and consequential damages (加害給付損害)
B.Farmer P is limited strictly to demanding replacement bags of feed under warranty rules
C.Farmer P cannot recover consequential damages unless the sales contract explicitly contained a product liability clause
D.Farmer P may recover the price of the defective feed but never damage to other property under contract law
Explanation: Article 227 concerns incomplete performance attributable to the debtor, a condition satisfied by F's negligence. Its first paragraph refers to remedies for delay or impossibility; its second permits compensation for additional loss caused by incomplete performance. Proven consequential harm to P's flock and soil is therefore not limited to the value of the feed.

Frequently Asked Questions

What is the examination structure of the Taiwan Lawyer Exam?

Stage 1 is a one-day, 300-question single-choice test worth 600 marks across four sessions. Stage 2 covers six subjects worth 1,000 marks over two days: constitutional and administrative law; civil law and civil procedure; criminal law and criminal procedure; company, insurance and securities law; Chinese composition; and one elective from intellectual property, labor and social law, fiscal and tax law, or maritime and ocean law. Stage 2 uses essay answers, typed on computers from 2026. The regulations do not prescribe a fixed essay subquestion count.

What are the passing criteria for Stage 1 and Stage 2?

Under Article 19 of the examination rules, Stage 1 passes the top 33% of candidates who complete all first-stage papers. Stage 2 passes the top 33% within each elective subject track, provided no single paper receives zero marks and the candidate achieves at least 400 out of 800 marks across the compulsory legal subjects (excluding Chinese composition and the elective subject).

What are the dates, fees, and major changes for the 2026 examination?

According to the MOEX 2026 schedule, Stage 1 takes place on 1 August 2026 with a registration fee of NTD 1,000. Stage 2 takes place on 25–26 October 2026 with a registration fee of NTD 2,300. Starting in 2026, Stage 2 transitions to computer-based testing (CBT), with testing centers established in Taipei, Taichung, and Kaohsiung.

Who is eligible to sit for the Taiwan Lawyer Examination?

Article 5 includes recognized junior-college-or-higher qualifications in the listed legal disciplines; equivalent qualifications with at least seven listed legal subjects and 20 counted credits, subject to the three-credit-per-subject cap and prescribed core-law requirement; specified judicial-administration examination and four-year service qualifications; or a specified higher qualifying examination. Article 20 permits foreign nationals meeting the first two educational routes, subject to disqualifications. Use MOEX's eligibility table to check the exact degree titles, subjects, credits, and documentary evidence.

What languages are used in the official examination?

The official papers use Traditional Chinese and include a Legal English (法學英文) component worth 30 Stage 1 marks. Article 4 of the Professional and Technical Personnel Examinations Act generally requires Chinese written responses, except foreign-language subjects, technical terms, or special rules. It also permits foreign nationals and overseas Chinese candidates to answer in Chinese or English. This response-language permission is not evidence of a separately translated English question paper.

Are oral assessment, assignments, or practical training part of the qualification?

The lawyer examination rules specify two written stages, with essay case analysis in Stage 2; they do not prescribe an oral examination, coursework portfolio, or practical test as an exam stage. Passing alone is not unrestricted authority to practice. Lawyers Act Article 3 also requires pre-service training unless a statutory substitute applies; the training rules generally prescribe one month of foundation training and five months of practical training, with their own assessment requirements.

How should this English-language practice question bank be used?

This 100-question bank is an independent English-language MCQ study adaptation by OpenExamPrep. It helps international candidates, bilingual legal practitioners, and law students test their conceptual comprehension of Taiwan statutory law, procedure, and judicial doctrine. It is not an official MOEX translation or format simulation, and cannot substitute for descriptive essay writing and Chinese legal drafting practice required for Stage 2.
