1Which combination describes the substantive patentability requirements under Turkey's Sınai Mülkiyet Kanunu?
A.Novelty, inventive step, and industrial applicability
B.Novelty, commercial success, and industrial applicability
C.Individual character, novelty, and registration
D.Inventive step, distinctiveness, and commercial success
Explanation: A patentable invention must be new, involve an inventive step, and be industrially applicable. These are separate requirements; satisfying one does not establish the others.
2For the ordinary prior-art inquiry in Turkey, which disclosure can be relevant?
A.Only an earlier Turkish patent
B.Only an earlier written publication
C.Public use abroad before the relevant date
D.Only a disclosure made within the previous five years
Explanation: The state of the art includes publicly accessible disclosures anywhere in the world, including use and oral disclosure. National borders and publication medium do not by themselves exclude prior art.
3Which subject matter is excluded as such from the statutory concept of an invention?
A.A new mechanical fastener
B.A mathematical method
C.A temperature-control apparatus
D.A chemical composition
Explanation: Mathematical methods as such are among the exclusions in SMK Article 82. A technical implementation must still be assessed on its own features and the other patentability requirements.
4An invention can be made or used in agriculture. How does that affect industrial applicability?
A.It qualifies only after commercial sales begin
B.Agricultural use is outside the industrial-applicability test
C.It qualifies only if a factory also uses it
D.Agriculture is expressly included in the test
Explanation: SMK Article 83(6) includes agriculture within industrial applicability. Actual manufacture or demonstrated sales before filing are not required by that criterion.
5From which event is the ordinary 20-year Turkish patent term measured?
A.Publication of the search report
B.Filing of the application
C.Publication of the grant
D.First sale of the patented product
Explanation: SMK Article 101 measures the patent term from the application date. Examination time therefore forms part of the term rather than starting a new 20-year period at grant.
6What is the ordinary protection term for a Turkish faydalı model?
A.Five years, renewable once
B.Twenty years from grant
C.Ten years from filing, without extension
D.Ten years from publication, renewable once
Explanation: SMK Article 101 gives utility models ten years from the application date. The term cannot be extended; it is distinct from the 20-year patent term.
7An inventor receives a favorable PCT written opinion and plans to seek Turkish protection. What is the proper significance of that opinion?
A.It assists evaluation but does not bind the national office's grant decision
B.It makes entry into the Turkish national phase unnecessary
C.It requires the national office to grant every original claim
D.It converts the application into a registered Turkish utility model
Explanation: The PCT written opinion is a preliminary, nonbinding patentability assessment. A favorable result can help the applicant evaluate prospects, but the national-phase requirements and the competent office's grant decision remain separate.
8A competitor argues that a product falls outside a Turkish patent solely because it lacks an optional feature found in a descriptive example. What does SMK Article 89(7) require the analysis to avoid?
A.Considering the claims at all
B.Using the description to interpret claim language
C.Considering any equivalent element
D.Automatically restricting the claims to the descriptive examples
Explanation: Article 89(7) prevents interpreting claims as limited to the patent's examples. Whether the product meets the properly interpreted claims still requires analysis; absence of an optional example feature alone does not establish exclusion.
9An independent researcher publicly described every feature of a claimed device before its effective filing date. No disclosure exception applies. Which objection is most direct?
A.Lack of unity
B.Lack of novelty
C.Failure to name the inventor
D.Lack of industrial applicability
Explanation: A prior public disclosure of all claimed features directly challenges novelty. Unity, inventorship, and industrial applicability ask different questions.
10An earlier-filed national application is published only after a later application's filing date and qualifies under SMK Article 83(3). How is its original content treated?
A.It is irrelevant until grant
B.It is used only for inventive step
C.It can affect novelty, but is excluded from inventive-step assessment
D.It automatically transfers the later application to the earlier applicant
Explanation: Article 83 includes qualifying earlier applications in the novelty prior art. Paragraph 5 excludes their content from the inventive-step assessment, separating these two inquiries.

Frequently Asked Questions

Is there an oral or technical-specialty examination?

The 2026 announcement specifies multiple-choice testing and does not require a separate oral examination, technical-department paper, practical assessment or submitted assignment.

Does this qualify me as a trademark attorney too?

No. Patent and trademark examinations have separate results. Taking both uses a combined 100-question arrangement, but passing the patent examination alone does not confer the separate trademark qualification.

Is a technical degree compulsory?

The 2026 entry condition is a four-year higher-education degree or recognized foreign equivalent, together with the stated citizenship, capacity, residence and criminal-record conditions. It does not restrict entry to science or engineering graduates.

Is this bank an official translation?

No. It is independent English-language MCQ study practice. Exact Turkish names and legal terms are retained when useful, and the official assessment language remains Turkish.
