1Which activity is incompatible with practice as an advocate under Tunisia's rules on professional independence?
A.Occasional contractual teaching
B.Directly operating a commercial trading business
C.Acting as an arbitrator
D.Providing legal training
Explanation: The professional statute prohibits advocates from engaging directly or indirectly in commerce. Occasional or contractual teaching and authorized professional services must be distinguished from operating a trading business.
2A graduate seeks a trainee placement with an advocate enrolled at the Cour d'Appel. What minimum period of enrolment at that level does the professional statute require of this supervisor?
A.Two years
B.Three years
C.Five years
D.Ten years
Explanation: The placement may be with a practising advocate enrolled at cassation level or one enrolled at appellate level for at least five years. The five-year condition concerns the appellate route; it is not a requirement for five years of cassation practice.
3Which proposed activity is prohibited for an avocat stagiaire even when the supervising advocate authorizes it?
A.Representing a client before the Cour de Cassation
B.Attending a criminal hearing
C.Preparing submissions within the supervising office
D.Attending professional training conferences
Explanation: The trainee cannot represent parties before the Cour de Cassation, even in the supervisor's name. The statute separately permits specified appearances and requires participation in office work and professional training.
4Which information falls within the advocate's duty of professional secrecy under the Tunisian professional statute?
A.Only information stated during a court hearing
B.Only information marked confidential by the client
C.Only information about criminal defense
D.Secrets entrusted by the client or learned through professional practice
Explanation: The duty covers secrets entrusted by the client and those learned in the course of professional practice. It is not restricted to a particular field of law or to documents bearing a confidentiality label.
5An advocate advised Company A on a contract, then ended that mandate. Company B now asks the advocate to challenge A's performance of that same contract. What should the advocate do?
A.Accept after removing A's documents from the current file
B.Accept because the first mandate has ended
C.Decline assistance to B in this dispute
D.Accept if a colleague signs the submissions
Explanation: The statute prohibits assistance to the adverse party in the same or a connected dispute after advising or acting for the original client. Ending the mandate or changing the person who signs the submissions does not remove that conflict.
6Alongside an advance fee agreement, an advocate proposes a written cash success fee equal to 25% of the result obtained. Which objection follows from Tunisia's professional statute?
A.Every success-related fee is prohibited
B.The proposed share exceeds the permitted 20% ceiling
C.The agreement needs the opposing advocate's signature
D.The fee must instead be paid in property
Explanation: The statute permits a written agreement for a share in results subject to a ceiling of 20%, exclusion of payment in kind, and professional dignity requirements. The proposed 25% share exceeds that ceiling; a blanket prohibition would also misstate the law.
7A client disputes the amount of an advocate's fees. Which authority initially makes the reasoned assessment of those fees under the professional statute?
A.The president of the competent regional bar section
B.The disciplinary council
C.The president of the Tribunal de Première Instance acting as fee assessor
D.The national bar's treasurer
Explanation: The fee dispute is submitted to the president of the competent regional section for a reasoned assessment. The first-instance court president gives that decision enforceability, which is a different function from assessing the fee.
8Which statement correctly distinguishes disciplinary sanctions available under Tunisia's professional statute?
A.Temporary suspension may last three years, and temporary removal is unavailable
B.The council may impose only warning, reprimand or permanent removal
C.Loss of cassation status is always a criminal sentence
D.Temporary suspension is capped at two years, while temporary removal from the roll may last up to three years
Explanation: The statutory list distinguishes suspension for up to two years from removal from the roll for up to three years. It also includes warning, reprimand, demotion from cassation to appellate status, and permanent removal.
9Which sequence identifies the judicial appeal and subsequent cassation route for a bar disciplinary decision under the professional statute?
A.Tribunal de Première Instance, then Cour de Cassation
B.Special chamber of the Cour d'Appel de Tunis, then Tribunal Administratif
C.Tribunal Administratif, then Cour de Cassation
D.Cour d'Appel of the advocate's region, then the national bar council
Explanation: The disciplinary appeal goes to the specially constituted chamber of the Cour d'Appel de Tunis. Cassation of its disciplinary judgment lies before the Tribunal Administratif, so the ordinary civil cassation route must not be substituted.
10In a flagrant-offense investigation, an investigating judge plans to search an advocate's office. The advocate is available. Which procedure meets the professional statute's specific safeguards?
A.Notify the regional section president, then let police search without the judge
B.Obtain the advocate's consent instead of involving the regional section
C.Inform the regional section president and search in the presence of the advocate, investigating judge, and section president or delegate
D.Notify the national bar treasurer and search any client file that may be useful
Explanation: The statute conditions an office search on flagrance, information to the regional section president, and the specified attendance safeguards. The investigation and seizure must remain connected to the offense; the advocate's attendance exception concerns an advocate who has fled.

Frequently Asked Questions

How does the CAPA differ from the Concours ISPA?

The entrance concours selects candidates for ISPA. The CAPA is the assessed professional qualification awarded following successful second-year examinations within the required programme. The study regime describes a two-year route and a qualifying second-year entry route; the two assessments have different purposes and results.

Does this bank reproduce the official assessment?

No. It is an independent English-language MCQ study adaptation for selected knowledge and professional decisions. ISPA requires written papers, oral work including advocacy from judicial files, continuous assessment, research work, visits and practical placements. Practice those components separately in the form required by ISPA.

Which languages are officially permitted for assessment?

Article 7 of Décret n° 2009-2259 specifies Arabic teaching for fundamental and practical subjects, with foreign-language teaching possible by scientific-council decision. The programme also includes legal French and legal English. These sources do not establish a complete rule on permitted examination-response languages, so confirm subject-specific permissions with ISPA. This English-language bank is not evidence of an English sitting or an official translation.

Does the bank cover every official subject in its examination weighting?

No. It selects core legal knowledge and professional judgment from the programme. The 2014 order specifies subject groups, paper selection, assessment coefficients and practical work rather than a single fixed MCQ topic blueprint. Computing, accounting, language performance and the full scope of human-rights and practical training require additional study.

Does the CAPA alone authorize unrestricted legal practice?

No. It supports the ordinary application route to the trainee bar roll, subject to separate statutory admission conditions. Exemptions exist for specified applicants, and progression through the professional rolls has its own requirements.
