1Which description best expresses intention (เจตนา) under the Thai Criminal Code?
A.A conscious act accompanied by a desire for its result or foresight of that result.
B.Failure to take care that the actor could and should have taken, without intention.
C.An adverse result alone, regardless of the actor's awareness.
D.A breach of a civil agreement alone, regardless of any mental element.
Explanation: Criminal intention involves conscious action and either desiring or foreseeing its result. Negligence concerns a failure to exercise the required available care and is a distinct basis of liability where the law provides for it.
2An unlawful attack has ended and the attacker is no longer threatening anyone. The victim later pursues and strikes the attacker solely in revenge. Which requirement of lawful defense is missing?
A.The defender's ownership of the place where the earlier attack occurred.
B.Imminent unlawful danger against which the defensive act is necessary.
C.A prior civil judgment confirming the earlier injury.
D.A requirement that the earlier attacker and defender be strangers.
Explanation: Lawful defense concerns protecting rights against imminent danger arising from unlawful aggression, using means reasonable in the circumstances. Retaliation after the danger has ended does not become defense merely because the person retaliating was previously attacked.
3For ordinary supporter liability (ผู้สนับสนุน), what fraction of the punishment provided for the supported offense does the Thai Criminal Code prescribe?
A.One-third.
B.One-half.
C.Two-thirds.
D.The same punishment as a joint principal.
Explanation: The supporter provision prescribes two-thirds of the punishment provided for the offense. It concerns assistance or facilitation before or during commission and must be distinguished from joint-principal liability.
4Three people act together in a theft using threats of immediate violence to obtain the property. Assuming all other elements are proved, which classification distinguishes this conduct from ordinary theft?
A.Fraud, solely because the owner handed over the property.
B.Embezzlement, solely because the offenders possessed the property after taking it.
C.Ordinary theft, because actual bodily injury is always necessary for robbery.
D.Gang robbery (ปล้นทรัพย์), because robbery is committed by at least three people together.
Explanation: Robbery includes theft using violence or threats of immediate violence for the statutory purposes. Commission of robbery by three or more people acting together constitutes gang robbery; actual bodily injury is not a necessary baseline element.
5A covered employee paid THB 500 per day has completed seven continuous years of service. The employer terminates the employee in circumstances entitling them to ordinary statutory severance, with no applicable exclusion. What is the severance amount?
A.THB 45,000.
B.THB 90,000.
C.THB 120,000.
D.THB 150,000.
Explanation: The six-years-to-less-than-ten-years service band provides 240 days of the latest wage. Thus 240 × THB 500 = THB 120,000; this calculation concerns ordinary severance, not any separate payment in lieu of notice.
6An individual receives a salary and employment bonus from their employer. Which assessable-income classification under the Revenue Code ordinarily covers those receipts?
A.Section 40(1), employment income.
B.Section 40(4), investment income.
C.Section 40(5), income from letting property.
D.Section 40(7), qualifying contracts of work involving essential materials.
Explanation: Salary and an employment bonus are receipts from employment within Section 40(1). Classification depends on the source and character of the income, not merely on whether payment is monthly or annual.
7A person relies on the constitutional provision allowing a petition about a violation of constitutional rights or liberties. Which further inquiry is essential before treating that provision as an unrestricted direct route to the Constitutional Court?
A.Whether the person can replace every ordinary civil appeal with a constitutional petition.
B.Whether a public disagreement alone establishes a personal rights violation.
C.Whether the petition seeks a remedy against a private debtor rather than payment in the ordinary courts.
D.Whether the claim meets the conditions and procedures prescribed by the Organic Act governing the Constitutional Court.
Explanation: The constitutional rights-petition provision expressly operates subject to the governing Organic Act's rules and procedures. It does not create an unrestricted substitute for ordinary proceedings merely because a party uses constitutional language.
8Counsel reviews an ordinary administrative-order annulment claim for which no special filing period applies. Which approach correctly identifies the general limitation rule?
A.Use the general civil residual limitation without examining administrative legislation.
B.Examine the general 90-day period from knowing or having reason to know the cause of action, together with any required administrative-remedy steps.
C.Assume that making any informal complaint suspends every deadline indefinitely.
D.Treat every administrative claim as having the same period as an administrative-contract damages claim.
Explanation: The Administrative Court legislation provides a general 90-day filing rule, while statutory remedies and the nature of the claim matter to when proceedings are available and time runs. Counsel should not transplant periods for other claim types or assume an informal complaint stops time.
9The Civil and Commercial Code distinguishes mistake about an essential element of a juristic act from a qualifying mistake about a person's material qualities. Which pairing states the ordinary legal effects?
A.Both are necessarily valid acts giving rise only to damages.
B.Essential-element mistake is voidable; material-qualities mistake is void.
C.Essential-element mistake is void; qualifying material-qualities mistake is voidable.
D.Both automatically become valid when the other party files a defense.
Explanation: The code distinguishes voidness for a mistake about an essential element from voidability for a mistake about qualities that satisfies the statutory materiality test. The distinction matters because void and voidable acts have different legal consequences.
10A building's defective maintenance causes injury. Its possessor establishes that they exercised proper care to prevent that damage. Under the Civil and Commercial Code's building-liability rule, who then bears the compensation liability?
A.The owner of the building.
B.The injured person automatically, because proper care is a defense for everyone.
C.The possessor alone, despite the established statutory care defense.
D.No one can be liable unless the owner personally caused the defect.
Explanation: The building rule places liability on the possessor, with a defense for proper preventive care. Where the possessor satisfies that defense, the owner is liable under the statutory allocation; the defense does not simply leave the victim without this remedy.

Frequently Asked Questions

Is this the same as a Lawyers Council license?

No. The Thai Bar qualification and the Lawyers Council's advocacy training and licensing route are distinct. Passing this examination alone does not issue a lawyer's license.

Is the official assessment exclusively Thai?

The legal curriculum and written problems are mainly Thai, but the fourth examination group includes English for Lawyer. This is not evidence of an alternative all-English sitting.

What can English MCQs help me practice?

They can support legal classification, procedural choices, evidence analysis and legal-English reading. This bank is an independent English-language MCQ study adaptation, not an official translation or a substitute for written and oral performance.

Which fees are confirmed?

The written fee is THB 600 per group, or THB 2,400 across four. The 2026 amendment separately sets regular education at THB 2,500 per academic session and specifies student, digital ID, handbook, library and applicable membership charges.

Are topic counts guaranteed?

No. The handbook supplies indicative subtopic counts and reserves examiner discretion to change them. This smaller bank samples the four groups and does not reproduce every topic or official question allocation.
