1Under Article 1 of the Slovenian General Administrative Procedure Act (Zakon o splošnem upravnem postopku, ZUP), which bodies must apply ZUP when they decide administrative matters by directly applying regulations?
A.Only ministries and administrative units (upravne enote); municipalities apply their own procedural ordinances
B.State administration bodies and the courts, but not holders of public authority, which follow private-law rules
C.State and local community bodies, and holders of public authority (nosilci javnih pooblastil)
D.Any public or private employer when it decides on the rights and obligations of its own employees
Explanation: Article 1(1) of ZUP binds administrative and other state bodies, bodies of self-governing local communities and holders of public authority whenever they decide on the rights, obligations or legal interests of individuals, legal persons and other parties in administrative matters. Article 3(3) adds that ZUP also applies when providers of public services decide on the rights or obligations of their users.
2A sectoral statute authorises a body to decide on an individual's right in an area of administrative law but says nothing about the procedure. Deciding the matter is necessary to protect the public interest. How does Article 2 of ZUP classify it?
A.As an administrative matter, because a matter is also administrative where this follows from its nature to protect the public interest
B.As an administrative matter only if the statute expressly requires an administrative decision (upravna odločba) to be issued
C.As a civil-law matter, because ZUP applies only where a statute names ZUP as the governing procedure
D.As a public-law matter under Article 4, so ZUP applies only by analogy and no decision is issued
Explanation: Article 2(1) defines an administrative matter as deciding on a right, obligation or legal interest of a natural or legal person or other party in the field of administrative law. Article 2(2) treats a matter as administrative if a regulation says the body conducts an administrative procedure or issues an administrative decision, or if this follows from the nature of the matter to protect the public interest.
3A special statute sets its own appeal rules for a particular administrative field but says nothing about service of documents. Under Article 3 of ZUP, which rules govern the procedure?
A.ZUP governs both questions, because a special statute cannot depart from the general procedural code
B.The special statute's appeal rules are void, because only ZUP may regulate procedural questions
C.The special statute governs both questions, and gaps are filled from the Civil Procedure Act
D.The special statute governs the appeal rules, and ZUP governs service because the special statute is silent on it
Explanation: Article 3(1) allows individual procedural questions to be regulated differently in a special statute where this is necessary for that administrative field. Under Article 3(2) the special statute applies to what it regulates, and ZUP applies to all questions the special statute does not regulate (subsidiary application).
4How does ZUP apply under Article 4 to a public-law matter that is not an administrative matter within the meaning of Article 2?
A.Not at all; such matters are always decided under the Civil Procedure Act
B.Appropriately (smiselno), insofar as the field is not governed by a special procedure
C.In full, including the duty to issue a formal decision subject to appeal
D.Only if the parties agree in writing that ZUP will govern the matter
Explanation: Article 4 provides that the administrative procedure applies appropriately (smiselno) in other public-law matters that do not have the character of an administrative matter, insofar as those fields are not governed by a special procedure. Only the provisions that fit the nature of the matter are applied.
5A statute authorises an authority to decide by discretion (prosti preudarek). Which requirement does Article 6 of ZUP impose on such a decision?
A.It may depart from the statute whenever the official considers this fairer to the party
B.It must stay within the limits of the authorisation and serve the purpose for which it was given
C.It may be taken without following ZUP's procedural rules, since only the outcome is discretionary
D.It cannot be challenged by appeal or in an administrative dispute
Explanation: Under Article 6(2), a discretionary decision must be issued within the limits of the authorisation and in line with the purpose for which it was granted, as defined by the statute or local regulation. Article 6(3) requires the authority to follow ZUP even in discretionary matters, and Article 214(4) requires the reasoning to explain how the scope and purpose of the discretion were applied.
6Two measures provided by the regulations would both achieve the purpose of the regulation. Under Article 7 of ZUP, which one must the authority apply to the party?
A.The one that is cheaper for the authority to enforce
B.The one preferred by the party with an opposing interest
C.The stricter one, to deter future breaches
D.The one that is more favourable to the party
Explanation: Article 7(3) of ZUP requires authorities, when deciding on parties' rights, obligations and legal interests, to apply those prescribed measures that are more favourable to the parties, provided the purpose of the regulation is achieved. The same idea appears on appeal: Article 252(2) lets the second-instance authority substitute a measure that is more favourable to the party.
7While discussing an application, an official realises that the applicant would also be entitled to a related right he has not claimed. What does Article 7 of ZUP require of the official?
A.To draw the applicant's attention to the possible right
B.To stay silent, since mentioning unclaimed rights would breach impartiality
C.To grant the unclaimed right on her own initiative in the same decision
D.To reject the application because it was framed incompletely
Explanation: Under Article 7(2), when an official learns or considers from the facts that a party has grounds to claim a right, she must point this out to the party. Article 7(4) adds that the authority must ensure that a party's ignorance or lack of legal knowledge does not harm the rights the party has under the law.
8Under the principle of material truth (Article 8 of ZUP), when may an authority base its decision on facts that are merely shown to be probable (verjetno izkazana dejstva)?
A.Whenever the party with an opposing interest does not dispute them
B.Whenever full proof would make the procedure noticeably more expensive
C.Only where a statute expressly provides for it
D.Only in procedures started ex officio, never in procedures started on request
Explanation: Article 8(1) requires the authority to establish the true state of facts and all facts relevant to a lawful and correct decision. Under Article 8(2), it may decide on the basis of facts shown only as probable solely where a statute so provides; Article 144(1)(3)-(4) is an example within ZUP itself.
9In which situation may an authority decide without first hearing the party on the relevant facts (zaslišanje stranke), consistently with Articles 9 and 144 of ZUP?
A.The party has no lawyer, and the official considers the legal issue to be a simple one
B.The official is fully convinced that nothing the party could say would change the outcome of the case
C.The authority intends to reject the request at the end of a special fact-finding procedure
D.The facts follow from official data it holds, so no hearing is needed to protect the party's rights
Explanation: Article 9 guarantees the party an opportunity to comment before a decision, and Article 9(3) bars relying on facts the parties could not comment on, except as provided by law. One such exception is the summary procedure: under Article 144(1)(2) and (3), no separate hearing is needed where the facts follow from official data and hearing the party is unnecessary to protect its rights.
10How must the official decide which facts are proven under the principle of free evaluation of evidence (Article 10 of ZUP)?
A.By giving every public document automatic priority over all witness statements
B.By careful assessment of each item separately and all items together
C.By counting the witnesses on each side and accepting the version of the majority
D.By accepting the applicant's version unless the opposing party disproves it
Explanation: Article 10 lets the authorised official decide by her own conviction which facts are proven, based on a conscientious and careful evaluation of each piece of evidence separately and all evidence together, and on the outcome of the whole procedure. ZUP sets no fixed rules on the weight of evidence; the reasoning of the decision must explain the evaluation (Article 214(1)).

Slovenia ZUP Exam: Suggested Study Strategy

1Learn the basic principles in Articles 6-14 of ZUP and be able to apply them to short scenarios, for example when a decision may be issued without hearing the party (Articles 9 and 144).
2Practise drafting the acts the written part asks for: requests to remedy a submission, invitations to a hearing, procedural resolutions (sklepi) and first-instance decisions with all parts from Article 210.
3Know when the authority dismisses by resolution (zavrže s sklepom) and when it rejects on the merits by decision (zavrne z odločbo), for example Articles 67, 129 and 240.
4Calculate time limits under Articles 100-101 (day of service not counted, month periods by calendar date, expiry moved to the next working day), using the ZUP-I periods: 21 days for appeal and 7 days for electronic service.
5Keep track of ZUP-I changes and the April 2026 Constitutional Court suspension of mailbox delivery, and revise extraordinary remedies and the ZUS-1 rules (30-day action, Article 28) if you are sitting level 2.

Frequently Asked Questions

What is the Strokovni izpit iz upravnega postopka?

It is the professional examination in administrative procedure that Article 31 of the General Administrative Procedure Act (ZUP) requires of officials who conduct or decide administrative procedures. These include officials in state bodies, local community bodies and holders of public authority. Upravna akademija organises it at two levels: level 1 for conducting first-instance procedures, deciding simple matters and administrative enforcement, and level 2 for conducting and deciding administrative matters generally.

What is the official exam format and how is it graded?

The written part, of up to four pedagogical hours (180 minutes), tests practical drafting of procedural acts or decisions, and candidates may use the ZUP and other regulations provided. The oral part follows, normally on the same day, lasts up to 30 minutes, and covers the written task and theoretical questions from the programme for the chosen level. A three-member commission rates each part »uspešno« or »neuspešno«; a pass requires all members to agree, and a failed written part ends the exam.

How much does the exam cost and how do I register?

The fee is €117 and is paid after the exam; no VAT is charged (Article 42, point 8, ZDDV-1), and the exam is free for direct users of the state budget. Candidates e-mail the registration form to gp.mnzju@gov.si at the latest 30 days before the exam date, and may withdraw up to 7 days before.

Which ZUP version is examined in 2026?

From 7 February 2026, Upravna akademija examines both parts under the ZUP as amended by ZUP-I (Uradni list RS, No. 85/2025). Key changes include a 21-day appeal period, six months to pass the exam after starting a post that requires it, informative decisions, decisions without reasoning, and a seven-day deemed service for electronic delivery. In April 2026 the Constitutional Court suspended the new mailbox-delivery rule of Article 86.b pending its final decision (U-I-51/26).

Who is exempt from the exam?

A passed state legal examination (pravniški državni izpit) or inspector professional examination counts as the level 2 exam. The government's decree also lists simple matters, such as issuing identity cards, passports and driving licences, for which no exam is needed. Issuing certificates from official records and authenticating signatures and copies are also exempt.

How does this OpenExamPrep practice bank relate to the official exam?

It is independent practice by OpenExamPrep and is not affiliated with or endorsed by Upravna akademija or the ministry. The official exam is a written drafting task and an oral examination, with Slovenian-language materials and examiners. This bank is an English-language multiple-choice study adaptation of the published programme. It helps you practise ZUP and ZUS-1 rules, but it is not an official translation and does not replace drafting or oral practice.
