1Which statement correctly describes popular sovereignty under the Constitution of the Republic of Serbia (Ustav Republike Srbije)?
A.Citizens exercise sovereignty only through elected representatives
B.Sovereignty belongs to the National Assembly for the duration of its mandate
C.Sovereignty originates from citizens, who exercise it through referendums, citizens' initiatives, and freely elected representatives
D.Sovereignty is shared equally between the Government and the Constitutional Court
Explanation: Sovereignty originates from citizens. The Constitution recognizes both direct participation, through referendums and citizens' initiatives, and participation through freely elected representatives.
2A proposed rule would let the Government direct how a court decides an individual engineering-liability case. Which constitutional principle is most directly threatened?
A.Judicial independence within the separation of legislative, executive, and judicial powers
B.The Government's power to determine national policy
C.The National Assembly's power to adopt the budget
D.The right of municipalities to organize local services
Explanation: The Constitution separates legislative, executive, and judicial power and declares judicial power independent. Executive responsibility for policy does not authorize instructions determining a court's judgment in an individual case.
3Which Serbian state body decides whether a law conforms to the Constitution?
A.The Supreme Court (Vrhovni sud)
B.The Administrative Court (Upravni sud)
C.The High Judicial Council (Visoki savet sudstva)
D.The Constitutional Court (Ustavni sud)
Explanation: The Constitutional Court protects constitutionality and legality and reviews the conformity of laws with the Constitution. It is a distinct constitutional body, rather than an ordinary appeal court.
4Which body is the highest representative body and holder of constitutional and legislative power in Serbia?
A.The Government (Vlada)
B.The National Assembly (Narodna skupština)
C.The President of the Republic (Predsednik Republike)
D.The Constitutional Court (Ustavni sud)
Explanation: The National Assembly is the highest representative body and holds constitutional and legislative power. The Government exercises executive power, while the Constitutional Court protects constitutionality and legality.
5A municipality adopts a general act that conflicts with a national law. Which statement correctly describes the constitutional hierarchy?
A.The municipal act prevails because it is more geographically specific
B.The later act always prevails, regardless of the issuing authority
C.Municipal general acts must conform to the Constitution and national laws
D.The conflict is resolved solely by a vote of affected property owners
Explanation: Local self-government operates within the constitutional and statutory framework. A municipal general act must conform to the Constitution and national laws; local specificity does not give it superior legal rank.
6Under the Law on General Administrative Procedure (Zakon o opštem upravnom postupku — ZUP), how must an authority use discretion expressly granted by law?
A.Within the limits of the authorization and for the purpose for which it was granted
B.By choosing whichever outcome produces the greatest administrative revenue
C.By following local custom even when it contradicts the authorization
D.By treating discretionary decisions as exempt from legal reasoning
Explanation: Discretion remains a legally bounded power. The authority must stay within its authorization and use it for its statutory purpose, rather than treating discretion as freedom from legality.
7Which statement best distinguishes a rešenje from a zaključak under ZUP?
A.A rešenje is issued by a court, while a zaključak is issued by a municipality
B.A rešenje must be electronic, while a zaključak must be on paper
C.A zaključak always grants the requested substantive right
D.A rešenje decides an administrative matter or another issue the law assigns to it; a zaključak manages the proceedings where a rešenje is not prescribed
Explanation: ZUP uses rešenje to decide rights, obligations, legal interests, and other matters assigned to that form. A zaključak manages proceedings when the law does not require a rešenje, so the distinction is more precise than simply calling every procedural issue a zaključak.
8In an ordinary written administrative decision requiring full reasons, where should an authority explain its factual findings, assessment of evidence, and legal grounds?
A.Only in the introductory identification of the parties (uvod)
B.In the statement of reasons (obrazloženje)
C.Only in the instruction on legal remedies (uputstvo o pravnom sredstvu)
D.Only in an internal case note that is withheld from the party
Explanation: The obrazloženje explains the facts, evidence, and legal reasoning supporting the operative decision. The legal-remedy instruction instead tells the party how the decision may be challenged.
9Which part of a written rešenje should state clearly the authority's decision and any imposed deadline, condition, or order?
A.The operative part (dispozitiv / izreka)
B.The introduction (uvod)
C.The list of evidence within the reasoning
D.The instruction on legal remedies
Explanation: The dispozitiv contains the clear and concise decision. Where applicable, its separate points also state deadlines, conditions, orders, costs, and whether an appeal suspends execution.
10Unless a law prescribes a different period, what is the ZUP deadline for appealing a first-instance decision after the party is notified of it?
A.3 days
B.8 days
C.15 days
D.30 days
Explanation: The general ZUP appeal period is 15 days from notification of the decision. A special law may prescribe a different period, so this default must not be applied automatically to every construction procedure.

Serbia Engineering Professional Exam: Suggested Study Strategy

1Use the IKS syllabus and current primary legislation to prepare all four general-part areas; this focused bank does not exhaust them.
2Distinguish the ordinary ZUP appeal from the special prigovor against location conditions, including its different deadline and competent body.
3Explain the different purposes of IDR, PGD, PZI, and PIO, and distinguish design technical control from inspection of a constructed object.
4For numerical exercises, state assumptions, track units, and check the applicable Serbian standards and national provisions before selecting design values.
5Prepare your own specialty professional work with the appointed mentor, and rehearse explaining its evidence, decisions, regulations, and limitations orally.
6Read local terminology in the official sources and confirm permitted response languages with IKS; English MCQs do not reproduce the language environment of the assessment.

Frequently Asked Questions

What is the official assessment format?

The general part is oral. The special part comprises preparation of a stručni rad and oral defense; knowledge checking may also be conducted through a test depending on the work and professional field. No fixed item count or fixed examination duration is published in the cited instructions and Rulebook.

Is this an official English translation or a complete specialty simulation?

No. OpenExamPrep provides an independent English-language MCQ study adaptation, not an official translation or a simulation of the exam's format or language environment. The official sources reviewed specify Serbian-language supporting documents in relevant procedures but do not explicitly enumerate all permitted assessment-response languages; confirm arrangements with IKS. This bank does not replace Serbian legal reading, specialty preparation, professional work, or oral-defense practice.

Who can apply?

The ordinary route requires relevant studies of at least 300 ESPB or an accepted equivalent, at least three years of relevant experience, and documented professional results. A restricted construction/execution route permits at least 180 ESPB with at least five years of relevant experience. Energy-efficiency candidates also need the prescribed training. The exact specialty, professional-result evidence, and foreign-qualification provisions must be checked with IKS.

What fee does IKS currently publish?

The published whole-exam fee, including the license-issuance decision, is 35,000 RSD. Listed partial-exam routes cost 25,000 RSD and a corrective exam costs 10,000 RSD. The separate foreign-authorized-person partial route costs 50,000 RSD, with a 25,000 RSD category for Republika Srpska as specified by IKS. These are different routes, rather than a universal foreign-candidate full-exam fee.

Does passing alone authorize every kind of engineering work?

No. The exam forms part of the professional licensing process. The relevant license, its professional scope, registration, and other applicable conditions determine which work a person may undertake; passing does not provide unrestricted authority across disciplines.

What happens after failing one part?

The Rulebook provides a corrective exam in the first following examination term for an unpassed part. A candidate who fails the corrective exam in two consecutive terms is directed to retake the whole exam.
