1According to the majority of Islamic jurists (Jumhur al-Fuqaha), what are the fundamental pillars (Arkan) of a valid contract of sale (Aqd al-Bay')?
A.The offer and acceptance (sighah) only; the parties and object are mere conditions
B.The two parties, the object of sale and its price, and the offer and acceptance
C.The two parties, two upright witnesses and a written, notarised document
D.The object of sale, its physical delivery, and payment of the full price
Explanation: The majority of jurists (the Maliki, Shafi'i, and Hanbali schools) define three essential pillars for a contract of sale: the contracting parties (buyer and seller), the subject matter comprising goods and price, and the formula comprising offer and acceptance. In contrast, the Hanafi school formally considers only the formula (al-Sighah) as the singular intrinsic pillar, categorizing the parties and subject matter as prerequisites.
2Which of the following conditions must be fulfilled regarding the subject matter (al-Ma'qud 'Alayh) for a commercial sales contract to be deemed valid in Islamic jurisprudence?
A.It must be a luxury good valued for its beauty rather than its use
B.It may be delivered at any time in the future without a fixed date
C.It must be pure, of lawful benefit, owned, deliverable and known
D.It may be sold by anyone, even if it belongs to the whole community
Explanation: In Islamic commercial jurisprudence (Fiqh al-Mu'amalat), the subject matter of a sale must fulfill rigorous criteria: it must be ritually pure (Tahir), usable in a Sharia-compliant manner (Mutaqawwam), possessed or deliverable by the vendor (Maqdur 'ala Taslimihi), and clearly known in quantity and quality to avoid Gharar. Selling impure goods such as carrion or undeliverable goods such as fish in open waters renders the transaction void (Batil).
3Under the classical Hadith regarding the six Ribawi commodities (gold, silver, wheat, barley, dates, and salt), what legal rule governs the direct exchange of dates for dates?
A.Hand-to-hand exchange in equal measure, whatever the quality difference
B.The owner of the better dates may ask for 20% more to balance the quality
C.One side may be delayed for three days if both sign a receipt
D.It is forbidden in every case and must be done as a lease instead
Explanation: When exchanging items of the same Ribawi genus (such as dates for dates or gold for gold), Islamic law mandates two strict conditions: spot hand-to-hand delivery (Taqabud / Yadan bi-Yad) and exact equality in measure or weight (Tamathul / Mithlan bi-Mithl). Any inequality in quantity constitutes Riba al-Fadl, regardless of disparities in quality. To exchange different qualities lawfully, one must sell the inferior dates for currency and purchase the superior ones.
4A merchant sells 10 grams of gold bullion in exchange for 120 grams of silver bullion, agreeing that the silver will be transferred one week after the gold is handed over. How is this contract classified in Islamic law?
A.A valid salam sale, because gold and silver are different kinds
B.A defective contract that is put right by giving the profit to charity
C.A permitted deferred exchange, because merchants commonly do it
D.Unlawful riba al-nasi'a, because both sides were not received at once
Explanation: Gold and silver share the common legal effective cause ('Illah) of monetary value / medium of exchange (Thamaniyyah). Under the rules of Sarf (currency exchange), when items differ in genus (gold for silver) but share the same monetary 'Illah, disparity in quantity is permitted, but immediate hand-to-hand receipt (Taqabud fi al-Majlis) is strictly mandatory. Deferring the delivery of the silver introduces Riba al-Nasi'ah (deferment usury), rendering the contract void.
5Which of the following scenarios constitutes an impermissible contract of hazard and excessive uncertainty (Bay' al-Gharar)?
A.Buying a sealed sack of graded wheat after inspecting a sample
B.Buying the unborn offspring of an animal before it is born
C.Renting an apartment for a year at a fixed monthly rent
D.Ordering tailored uniforms with the fabric and sizes specified
Explanation: Bay' Habal al-Habalah (selling the unborn foal of a camel or livestock, or selling what the unborn offspring will bear) is an explicit example of Bay' al-Gharar al-Fahish (excessive uncertainty). The subject matter does not currently exist, may never come into being, and cannot be guaranteed for delivery. The Prophet (PBUH) explicitly forbade this sale to eliminate fraud and severe financial dispute.
6What is the defining legal characteristic that distinguishes a contract of Ijarah (leasing of usufruct) from a contract of Bay' (sale)?
A.Ijara transfers permanent ownership of the asset to the lessee
B.Ijara requires the rent to be paid only in grain and never in money
C.Ijara sells only the use of an asset for a period; ownership stays
D.Ijara lets the lessor raise the rent mid-term without the lessee's consent
Explanation: Ijarah is formally defined as a contract over permissible, known usufruct (Manfa'ah) or labor for a determined period in exchange for a specified compensation (Ujrah). Unlike a sales contract (Bay') which transfers ownership of the underlying physical asset ('Ayn) permanently, Ijarah transfers only the temporary right of use, keeping asset title and its associated ownership risks with the lessor.
7Which procedural condition is strictly mandatory for the validity of a Salam (forward sale) contract in Islamic jurisprudence?
A.Full payment of the price in the contract session before parting
B.Delivery of the goods within forty-eight hours of the agreement
C.Limiting it to unique items such as rare antique manuscripts
D.Deferring both the payment of the price and the delivery of goods
Explanation: A fundamental condition for a valid Salam contract is the full spot payment of the purchase price (Ra's al-Mal) at the contracting assembly before the parties separate. This requirement ensures that the contract does not degenerate into Bay' al-Kali' bi-al-Kali' (the forbidden sale of debt for debt). The subject matter must be fungible goods whose genus, quality, and quantity are meticulously specified for future delivery at a fixed date.
8How does an Istisna' (manufacturing commission) contract fundamentally differ from a standard Salam (forward purchase) contract?
A.Istisna' can be used only for raw crops such as wheat and barley grain
B.Istisna' requires the maker to deliver the item free of charge
C.Istisna' forbids any change to the specifications once talks begin
D.Istisna' is for manufactured goods and needs no full advance payment
Explanation: While Salam requires immediate full advance payment in the contract session and can apply to agricultural produce and raw commodities, Istisna' is a contract with a manufacturer to produce specific manufactured goods. Jurists (predominantly in the Hanafi school and modern standards) do not require full advance payment at the session for Istisna'; payments may be structured in installments linked to manufacturing milestones or deferred until delivery.
9What is the legal effect of the Option of the Session (Khiyar al-Majlis) according to the Shafi'i and Hanbali schools?
A.It obliges the buyer to pay a fee for inspecting goods in the shop
B.Either party may cancel the sale as long as they have not separated
C.It makes every spoken sale void until a magistrate approves it
D.It lets the seller take the goods back at any time within one whole year
Explanation: Based on the authentic Prophetic Hadith ('The two parties to a sale have the option to revoke as long as they have not separated'), the Shafi'i and Hanbali jurists hold that both buyer and seller retain the legal power (Khiyar al-Majlis) to unilaterally annul or finalize the transaction as long as they remain in the contracting meeting. Once they physically separate or explicitly waive the option, the sale becomes irrevocable (Lazim).
10In the fiqh of contracts, what is the effect of insanity (junun) on a person's legal capacity?
A.It removes the capacity of obligation, so the person can no longer own property
B.It has no effect on contracts as long as a witness is present
C.It removes the capacity of performance, so his own contracts are void
D.It only delays the contract until the person's family approves it
Explanation: Jurists distinguish the capacity of obligation (ahliyyat al-wujub), which every living person has, from the capacity of performance (ahliyyat al-ada'), which requires a sound mind. Insanity is an impediment to capacity ('arid min 'awarid al-ahliyya) that removes the capacity of performance, so contracts the insane person makes are void and his guardian acts for him, although he still owns property.

Tawjihi Sharia Stream: Suggested Study Strategy

1Study from the Grade 12 MOEHE textbooks: the Fiqh paper covers contracts and transactions, not family law or worship.
2For each contract (sale, ijara, kafala, hawala, rahn), learn its definition, pillars and one worked example of what makes it void.
3Memorise the Grade 12 hadiths word for word in Arabic, together with the narrator, the source and two lessons from each.
4For tafsir, read Surat al-Nisa 1-31 with the textbook's explanation and be able to state the inheritance share in each verse.
5In Arabic, practise i'rab of short sentences and identify the meter of a verse from its prosodic transcription.
