1Under Article 216 of the Constitution of the Republic of Mozambique (CRM), to what are judges subject in the exercise of their judicial functions?
A.They are independent, but must follow binding guidance from the Conselho Superior da Magistratura Judicial on how to decide pending cases
B.They must follow the directives of the Procurador-Geral da República in criminal matters
C.They are independent and owe obedience only to the law
D.They must apply interpretive circulars issued by the Ministry of Justice
Explanation: Article 216(1) CRM states that, in the exercise of their functions, judges are independent and owe obedience only to the law ('apenas devem obediência à lei'). Article 216(2) adds the guarantees of impartiality and irresponsibility, and Article 216(3) adds irremovability. The CSMJ manages and disciplines judges (Article 219) but does not tell them how to decide cases.
2A provincial court judge is moved to another province as a punishment for an unpopular judgment, without any procedure provided for by law. Which guarantee in Article 216 CRM does this most directly violate?
A.Irremovability (inamovibilidade)
B.Irresponsibility (irresponsabilidade)
C.Impartiality (imparcialidade)
D.The participation of elected judges (juízes eleitos)
Explanation: Under Article 216(3) CRM, judges are irremovable: they cannot be transferred, suspended, retired or dismissed except in the cases provided for by law. A transfer imposed as a sanction for the content of a judgment, outside any legal procedure, attacks this guarantee directly.
3According to Article 217 CRM, when may judges be held civilly, criminally or disciplinarily responsible for acts performed in the exercise of their functions?
A.Whenever a higher court reverses their decision on appeal
B.Never, because the guarantee of irresponsibility is absolute
C.Only after the Assembly of the Republic lifts their immunity by resolution
D.Only in the cases specially provided for by law
Explanation: Article 217(1) CRM provides that judges answer civilly, criminally and disciplinarily for acts performed in the exercise of their functions only in the cases specially provided for by law. Article 217(2) adds that a career judge can be removed from judicial office only under the terms established by law.
4Under Article 218 CRM, which activity may a serving judicial magistrate carry on, subject to prior authorisation by the Conselho Superior da Magistratura Judicial (CSMJ)?
A.Acting as a paid arbitrator in private commercial disputes
B.Teaching or legal research, or scientific, literary, artistic or technical publication
C.Serving as legal adviser to a provincial government
D.Holding a non-executive seat on the board of a state-owned company
Explanation: Article 218 CRM forbids serving judicial magistrates from performing any other public or private function. The only exceptions are teaching or legal research, or other scientific, literary, artistic and technical dissemination and publication, and these require prior authorisation from the CSMJ.
5Under Article 220 CRM, how many members of the Conselho Superior da Magistratura Judicial (CSMJ) are elected by the Assembly of the Republic?
A.Two, alongside the two members designated by the President of the Republic
B.Seven, matching the number of judges elected by their peers
C.Five, according to the criterion of proportional representation
D.None; the Assembly only ratifies the President's nominees
Explanation: Article 220(1) CRM sets the CSMJ's composition: the President and Vice-President of the Tribunal Supremo, two members designated by the President of the Republic, five members elected by the Assembly of the Republic by proportional representation, and seven judicial magistrates elected by their peers. The President of the Tribunal Supremo chairs the Council (Article 220(2)).
6Which body does the CRM define as the management and disciplinary organ of the judicial magistracy, competent to appoint, place, transfer, promote and discipline judicial magistrates?
A.The Ministry of Justice, Constitutional and Religious Affairs
B.The Conselho Constitucional
C.The Tribunal Supremo sitting in plenary
D.The Conselho Superior da Magistratura Judicial (CSMJ)
Explanation: Article 219 CRM defines the CSMJ as the management and disciplinary organ of the judicial magistracy. Article 221(a) gives it power to appoint, place, transfer, promote and dismiss judicial magistrates, assess their professional merit and exercise disciplinary action over them.
7Which of the following does Article 222 CRM prohibit?
A.Creating, by law, a tier of courts between the provincial courts and the Tribunal Supremo
B.Creating first-instance courts with specific competence or specialised courts
C.Creating labour, maritime or customs courts
D.Creating courts with exclusive competence to try certain categories of crimes, without prejudice to the rules on military courts
Explanation: Article 222(6) CRM prohibits courts with exclusive competence to try certain categories of crimes, without prejudice to the provisions on military courts. Under Article 223, military courts are constituted only while a state of war is in force, to try strictly military crimes. The other options are expressly allowed by Article 222(2), (3) and (5).
8Under Article 225 CRM, which requirements apply to a candidate for Juiz Conselheiro of the Tribunal Supremo?
A.Appointment by the President of the Republic on the CSMJ's proposal, after a public curricular competition; at least 35 years of age and at least ten years of forensic activity or law teaching
B.Election by the Assembly of the Republic by a two-thirds majority from among provincial judges with at least five years' service
C.Direct appointment by the CSMJ from among career judges aged at least 40
D.Appointment by the President of the Republic from among any law graduates, without competition
Explanation: Article 225(3) CRM: Juízes Conselheiros are appointed by the President of the Republic on the CSMJ's proposal, after a public curricular competition open to magistrates and other citizens of reputed merit holding a law degree. Article 225(4) requires them to be at least 35 and to have at least ten years of forensic activity or law teaching. The President and Vice-President of the Tribunal Supremo are appointed by the President of the Republic after hearing the CSMJ (Article 225(2)).
9What role do elected judges (juízes eleitos) play under Article 215 CRM and the Lei de Organização Judiciária?
A.They sit in the Tribunais Superiores de Recurso to decide questions of law on appeal
B.They may take part only in first-instance trials and only in deciding matters of fact
C.They replace professional judges in district courts whenever there is a shortage of career judges
D.They decide both fact and law, and their votes prevail over the professional judge's
Explanation: Article 215(2) CRM states that elected judges intervene only in first-instance trials and in deciding matters of fact. Article 17 of the Lei de Organização Judiciária (Lei n.º 24/2007, as amended) confirms that their participation is restricted to discussing and deciding the facts. It makes two elected judges mandatory, in addition to the professional judge, in cases of voluntary homicide, rape of minors and minors' jurisdiction other than maintenance.
10How is the Conselho Constitucional composed under Article 241 CRM?
A.Nine judges, all elected by the Assembly of the Republic by a two-thirds majority
B.Seven judges: three appointed by the President of the Republic, three by the Assembly and one by the Ordem dos Advogados
C.Five judges chosen from among the Juízes Conselheiros of the Tribunal Supremo
D.Seven judges: one appointed by the President of the Republic, who presides; five designated by the Assembly of the Republic by proportional representation; and one designated by the CSMJ
Explanation: Article 241(1) CRM gives the Conselho Constitucional seven juízes conselheiros. One is appointed by the President of the Republic and presides. Five are designated by the Assembly of the Republic by proportional representation, and one by the CSMJ. They serve renewable five-year mandates (Article 241(2)) and must be at least 35 with at least ten years of professional experience in the magistracy, forensic activity or law teaching (Article 241(3)).

CFJJ Magistratura Judicial e Ministério Público: Suggested Study Strategy

1Study the current texts: the Penal Code is Lei n.º 24/2019 (amended by Lei n.º 17/2020) and the Código de Processo Penal is Lei n.º 25/2019 (amended by Lei n.º 18/2020), with the new instrução and audiência preliminar phases.
2Quote articles precisely in the practical case: the official papers reward correct citation of the applicable provisions, and earlier competitions allowed unannotated legislation to be consulted.
3Do not neglect the general-knowledge paper, which counts 20%: judicial organisation, the statutes of the magistracies and the Ordem dos Advogados, human rights, African Union law and children's rights.

Frequently Asked Questions

What is the CFJJ magistrates' entrance competition?

It is the public competition (concurso público) the Centro de Formação Jurídica e Judiciária runs to select law graduates for the Curso de Formação Inicial for the judicial magistracy and the Ministério Público. It follows the CFJJ's 2022 Regulamento dos Concursos de Ingresso. The latest completed cycle found is the XXII course, which graduated 194 judges and 117 prosecutors in February 2024.

What does the official exam consist of?

After a documentary assessment, candidates sit written technical-legal papers in constitutional law, criminal law and procedure, and civil law and procedure, plus a general-knowledge paper. Each paper has a multiple-choice group and a practical case, graded from 0 to 20. Successful candidates then have a professional interview, a psychotechnical and psychological exam and, if admitted, a medical exam. The final grade weights the technical papers at 50%, general knowledge at 20% and the interview at 30%.

Who may apply?

Mozambican citizens with full civil and political rights who hold a law degree that includes civil law and procedure, criminal law and procedure, and constitutional law, among other subjects. Candidates must be at least 25, or reach that age before placement by the magistracy councils. The 2022 rules exclude candidates who have failed three or more earlier competitions.

Is this practice bank an official translation of the CFJJ exam?

No. The official papers are written in Portuguese, and the CFJJ assesses mastery of Portuguese, including penalties for spelling errors. This bank is an independent English-language MCQ study adaptation of the legal content. It does not simulate the practical case, the interview or the psychotechnical exam, so candidates should also practise writing reasoned answers in Portuguese citing the applicable articles.
