IJA Jalisco Persona Facilitadora: Suggested Study Strategy

1Know the difference between mediation and conciliation in Jalisco: the mediator makes no suggestions, while the conciliador must propose fair solutions (Articles 3 and 47).
2Memorise the procedure's deadlines: two months plus one for the procedure, three business days to decide on a proposal, three business days to request sanction, and five days to cure a defective convenio.
3Study what makes a convenio enforceable: the Article 63 requirements, sanction and registration by the Instituto, and enforcement before a Juez de Primera Instancia.
4Review the LGMASC rules that now apply alongside the state law: five-year certification, the support-debtor requirement, the Sistema de Convenios, validation of convenios involving children, and practice in other states.

Frequently Asked Questions

Who can be certified as a facilitator in Jalisco?

Professionals of any discipline with a title and cédula, at least 120 hours of MASC training from an institution the IJA approves, full civil and political rights, no conviction for an intentional crime carrying prison, and no entry as a defaulting support debtor. Collaborative lawyers also need a law degree and 40 hours of collaborative negotiation.

How is the certification evaluated?

The IJA applies a theoretical exam and, once it is passed, a recorded practical exam and a practical exam drafting a final convenio. A failed evaluation may be requested again within 15 business days, and a second failure closes the file. The IJA then inspects the proposed office before resolving. It does not publish question counts, time limits or passing scores.

How long does the certification last, and what does renewal require?

The IJA issues certifications valid for five years, in line with the LGMASC. Renewal requires a certification that is current or expired less than a year, 100 training hours in the previous five years, a no-sanctions document, the fee, and passing theoretical and practical exams. Article 17 of the 2007 state law still refers to a refrendo every two years.

Is the evaluation available in English, and what does this bank cover?

No. The evaluations are conducted in Spanish. This bank is an independent English-language MCQ study adaptation, not an official translation or format simulation. It keeps the Spanish legal terms and reviews the state law, the IJA procedures and the LGMASC.
