1Article 6 of the Ley Federal de Correduría Pública (LFCP) lists the functions of a corredor público. Which statement describes those functions correctly?
A.A corredor may authenticate any civil or mercantile act, including real estate transfers and wills, with the same scope as a notario público
B.A corredor acts only as a fedatario in mercantile acts and contracts; valuation and arbitration are reserved to other professionals
C.A corredor may act as commercial mediator, perito valuador, adviser to merchants, arbitrator and fedatario in mercantile matters
D.A corredor resolves commercial disputes as a first-instance judge whose rulings are appealed before the state superior court
Explanation: Article 6 of the LFCP gives the corredor público a bundle of functions: agente mediador (fraction I), perito valuador (II), legal adviser to merchants (III), arbitrator in mercantile and consumer disputes (IV), and fedatario for mercantile contracts, acts and facts (V–VII). The last paragraph adds that these functions are not exclusive to corredores. The fe pública function is limited to mercantile matters and excludes real estate.
2Which of the following activities is PROHIBITED to a practicing corredor público under Article 20 of the LFCP?
A.Trading on their own account or acting as a comisionista (commission agent)
B.Teaching law at a university or serving as an independent board member of a company
C.Acting as an arbitrator in a dispute between a supplier and a consumer
D.Preparing an appraisal report ordered by a court in commercial litigation
Explanation: Article 20, fraction I of the LFCP prohibits corredores from trading on their own account or acting as comisionistas, which protects their impartiality as auxiliaries of commerce. The same article also bars them from acting as factors or dependents, serving as public servants, or practicing judicial representation (mandato judicial). Article 5 of the Reglamento lists activities that are expressly not prohibitions.
3According to Article 18 of the LFCP, what is the difference between a póliza and an acta authorized by a corredor público?
A.A póliza is used only to incorporate commercial companies, while an acta is used for every other mercantile contract the corredor authorizes
B.An acta records contracts that the parties sign before the corredor, while a póliza records facts such as notifications and protests
C.Both terms are synonyms that the LFCP uses interchangeably for any instrument the corredor authorizes as fedatario
D.A póliza records a mercantile act or contract in which the corredor acts as fedatario; an acta records a mercantile juridical fact
Explanation: Article 18 of the LFCP defines the póliza as the instrument drafted by the corredor to record a legal act, agreement or mercantile contract in which the corredor may act as fedatario, and the acta as the written account of a mercantile juridical fact. Both are public instruments. Article 35 of the Reglamento confirms that notifications, protests, ratifications and cotejos are recorded by acta.
4Which authority examines candidates, issues habilitaciones, supervises corredores públicos and imposes the sanctions provided in the LFCP?
A.The Colegio de Corredores of each plaza
B.The Secretaría de Economía
C.The Secretaría de Hacienda y Crédito Público
D.The Tribunal Superior de Justicia of the corresponding state
Explanation: Article 2 of the LFCP assigns application of the law to the Federal Executive through the Secretaría de Economía, and Article 3 lists its powers: examining aspirants and candidates, issuing and revoking habilitaciones, supervising corredores and colegios, and imposing sanctions. State authorities participate only as the law provides, for example through a representative on the definitive-exam jury.
5What professional practice must a law graduate prove to request the Examen de Aspirante a Corredor Público?
A.At least one year of practice in the office of a corredor or notario público
B.At least five years of litigation practice before federal courts in commercial matters
C.At least two years of professional practice in a correduría pública or notaría
D.Any university degree plus completion of a valuation diploma approved by the Secretaría
Explanation: Article 9, fraction I(a) of the LFCP requires a law degree and at least two years of professional practice for the aspirante exam, and Article 9-III of the Reglamento specifies that the practice must be in a correduría pública or notaría. The candidate must also be Mexican by birth, hold a cédula and have no conviction for an intentional offense (Article 8). The November 2025 convocatoria repeats these requirements.
6Can a corredor público formalize the incorporation of a Sociedad Anónima (S.A.)?
A.No; only a notario público may incorporate an S.A., and corredores may only formalize the minutes of later shareholder meetings
B.Yes; the LGSM requires incorporation before a fedatario público, and the LFCP authorizes corredores to act in LGSM acts
C.Only if the company is incorporated as, or later converted into, a Sociedad por Acciones Simplificada
D.Yes, provided the corporate purpose is limited to buying and selling movable goods and services
Explanation: Article 5 of the Ley General de Sociedades Mercantiles says companies are incorporated before a fedatario público and that the fedatario will not authorize the 'escritura o póliza' if the bylaws violate the law, which expressly contemplates corredores. Article 6-VI of the LFCP lets corredores act as fedatarios in the incorporation and other acts governed by the LGSM, including organic representation. The SAS is the exception: it is incorporated through the electronic procedure in Chapter XIV of the LGSM.
7Under Article 18 of the LFCP, what evidentiary value do the pólizas and actas authorized by a corredor within their competence have?
A.They are private documents that become public instruments only once they are registered in the Registro Público de Comercio
B.They have full probative value only once the parties ratify their content before a notario público
C.They are circumstantial evidence (indicio) that a judge must corroborate with witnesses or other documents
D.They are public instruments, and entries and certified copies issued from them make full proof of the acts and facts recorded
Explanation: Article 18 of the LFCP provides that actas and pólizas authorized by corredores are public instruments, and that the entries in their libro de registro and the certified copies they issue are public documents that make full proof (prueba plena) of the contracts, acts and facts recorded. This is why a corredor's póliza can support a juicio ejecutivo when it records an exigible and liquid obligation.
8How do Articles 4 and 5 of the LFCP limit where a corredor público may exercise their functions?
A.They may act as fedatario only in the plaza for which they were habilitated; their other functions are not limited to it
B.Their fe pública is valid throughout Mexico, because the habilitación is issued by a federal authority, the Secretaría de Economía
C.They may act as fedatario in their plaza and in any neighboring state that has no Colegio de Corredores of its own
D.All of their functions, including valuation and advice, are limited to the municipality where their office is located
Explanation: Article 4 divides the country into plazas, one per state and one for Mexico City. Article 5 lets corredores exercise their functions outside their plaza, but when acting as fedatarios they may do so only within the plaza for which they were habilitated, although the acts may refer to any other place. Changing plaza requires authorization from the Secretaría de Economía.
9Under Article 16 of the LFCP, which record must a corredor público keep for the pólizas and actas they authorize?
A.A protocolo of bound folios in which the full text of every instrument is written and signed, as notaries do
B.An archive of pólizas and actas plus a libro de registro in which an extract of each instrument is entered by date and number
C.A libro mayor that summarizes each month the instruments authorized and the fees charged for them
D.An index held by the Colegio de Corredores of the plaza, which records the instruments authorized by all of its member corredores
Explanation: Article 16 of the LFCP requires corredores to file their pólizas and actas daily, by date and progressive number, and to enter an extract of each in a special book called the libro de registro. Each volume has 250 numbered sheets and may not contain erasures or abbreviations, and electronic files must also be kept. Article 50 of the Reglamento requires the archive and books to be kept for ten years from the closing of each book.
10In commercial real estate appraisal, what does the cost approach (enfoque de costos) measure?
A.The stabilized net operating income of the property, capitalized at a rate taken from the market
B.Recent sale prices of comparable properties, adjusted for their differences with the subject
C.The current cost new of the improvements, less accrued depreciation, plus the market value of the land
D.The historical acquisition cost shown in the owner's books, less the accumulated depreciation taken for tax purposes
Explanation: The cost approach estimates value as the land's market value plus the current cost to replace or reproduce the improvements, minus accrued depreciation (physical deterioration and functional or economic obsolescence). It is especially useful for special-purpose or recently built properties with few comparable sales.
