1Under Article 750 of the Código Civil para el Distrito Federal (the civil code applied in Mexico City), which of the following is a bien inmueble (real property)?
A.A water heater the owner bought but has not yet installed
B.The soil and the constructions adhered to it
C.Loose furniture the seller leaves inside the apartment after closing
D.The seller's shares in the company that built the development
Explanation: Article 750 lists the soil and the constructions adhered to it as real property (section I), together with anything fixed to a property so that it cannot be separated without deterioration (section III). Uninstalled equipment, loose furniture and company shares remain bienes muebles.
2Under Article 73 of the Ley Federal de Protección al Consumidor (LFPC), real estate transactions fall under PROFECO's consumer-protection rules when the provider is:
A.Any private individual selling their own home directly to a neighbor, with no intermediary involved
B.Only the commercial bank that grants the buyer's mortgage loan for the purchase
C.A developer, builder, promoter or other person who advises on and sells homes to the public
D.Only the Notario Público who formalizes the deed and calculates the taxes
Explanation: Article 73 applies the LFPC to real estate when the providers are fraccionadores, constructores, promotores and others who intervene in the asesoría y venta al público of housing, or who sell timeshares. Their contracts must be registered with PROFECO, so an advisor who markets homes to the public works inside this consumer-protection framework.
3Which description best fits the Asociación Mexicana de Profesionales Inmobiliarios (AMPI)?
A.A private trade association, founded in 1956, that groups, trains and certifies real estate practitioners
B.The federal agency, under the Secretaría de Economía, that issues mandatory real estate broker licenses
C.The college of notaries that supervises property deeds and appoints Notarios Públicos in each state
D.A government housing fund that grants mortgage credit to private-sector workers through payroll deductions
Explanation: AMPI, founded in 1956, is the principal trade association of Mexico's real estate sector. It groups, trains and certifies agents, administrators, appraisers and consultants, who commit to its Code of Ethics. It is not a government regulator, and Mexico has no single federal broker license.
4Within AMPI, which body hears ethics complaints between associates or from clients against an associate?
A.PROFECO's arbitration unit, which has exclusive jurisdiction over broker ethics
B.The Procuraduría Social de la Ciudad de México (PROSOC)
C.The local Colegio de Notarios
D.The Comisión de Honor y Justicia
Explanation: AMPI associates commit to the association's Code of Ethics, and its Comisión de Honor y Justicia handles ethics grievances and sanctions inside the association; AMPI CDMX lists this commission among its member benefits. Consumers can still complain to PROFECO, but internal ethics discipline belongs to the commission.
5A buyer's lawyer explains that a registered mortgage (hipoteca) is a derecho real, while the seller's promise to hand over the keys early is a derecho personal. What is the key practical difference?
A.A derecho real can arise only from a court judgment, whereas a derecho personal can arise only from a contract
B.A derecho personal must always be recorded in the Registro Público, while a derecho real needs no registration
C.A derecho real is direct power over the asset, opposable to third parties; a derecho personal binds only the obligor
D.A derecho real expires after one year unless it is renewed, whereas a derecho personal lasts until it is paid
Explanation: Real rights such as ownership, usufruct, servitude and mortgage attach to the thing itself and, once registered, can be opposed to third parties; a mortgage follows the property into a new owner's hands. Personal rights are claims against a particular debtor, such as the seller's obligation to deliver early.
6In Mexican civil law, which situation is an acto jurídico rather than a mere hecho jurídico?
A.The death of a property owner, which opens the succession
B.A river gradually depositing soil on a riverside lot (aluvión)
C.A tenant's accidental fire that damages the leased apartment
D.Two parties signing a promise to buy and sell a lot
Explanation: An acto jurídico is a manifestation of will made precisely to create, transfer, modify or extinguish rights, and signing a contract is the typical example. Death, natural accretion and an accident also produce legal consequences, but nobody willed those consequences, so they are hechos jurídicos.
7Under the Código Civil para el Distrito Federal, when does a natural person acquire legal capacity (capacidad de goce), and at what age does majority, which brings general capacidad de ejercicio, begin?
A.Capacity at birth, protected from conception; majority begins at 18
B.Capacity at age 16, when the person can work; majority begins at 21
C.Capacity upon registration in the Civil Registry; majority begins at 18
D.Capacity at birth, protected from conception; majority begins at 21
Explanation: Article 22 says legal capacity is acquired by birth and lost by death, and a conceived child is already protected by law. Article 646 sets majority at 18, after which a person without a legal incapacity can personally sign contracts such as a compraventa.
8A married seller wants to sell an apartment that is a common asset of the couple under the sociedad conyugal regime. Whose consent is required for the sale?
A.Only the spouse who appears as buyer on the original purchase deed, since title is in that spouse's name
B.Only the spouse designated as administrator of the common assets in the capitulaciones matrimoniales
C.Both spouses, since ownership of the common assets resides in both of them
D.Neither spouse alone; a Family Court judge must authorize every sale of the couple's common assets
Explanation: Under Articles 172 and 194 of the Mexico City civil code, ownership of the sociedad conyugal's common assets resides in both spouses, and acts of dominion over them need the other spouse's consent. The advisor should confirm the marital regime early and plan for both signatures at the notary.
9A woman married under separación de bienes wants to sell a house that belongs only to her. What does the Mexico City civil code imply for the transaction?
A.She may sell alone, since she keeps ownership and administration of her own assets
B.Her husband must sign, because a house becomes common property once the couple lives in it
C.She may sell only with prior authorization from the Family Court judge
D.She may sell, but half of the proceeds belong by law to her husband
Explanation: Article 212 provides that under separación de bienes each spouse keeps ownership and administration of their own assets, and Article 172 lets spouses dispose of their own property without the other's consent. The notary will still review the marriage certificate and capitulaciones to confirm that the asset really is separate.
10Parents who exercise patria potestad want to sell an apartment their 12-year-old child inherited. What does the Mexico City civil code require?
A.A private sale contract signed by both parents is enough, because they legally represent the child
B.The child must personally sign the deed alongside the parents once they turn 14
C.The notary can authorize the sale if both parents appear and sign together
D.Absolute necessity or evident benefit, plus prior authorization from the judge
Explanation: Article 436 bars those who exercise patria potestad from selling or encumbering a child's real estate except for absolute necessity or evident benefit, and only with the competent judge's prior authorization. Until that authorization exists, the advisor should not present the property as ready to close.

About the AMPI PIC Exam

Independent practice questions by OpenExamPrep for the Profesional Inmobiliario Certificado (PIC), the certification AMPI Ciudad de México has granted since 2003. The PIC is an online exam on the nine basic knowledge areas of AMPI CDMX's temario: general concepts, civil and notarial law, procedures before Mexico City authorities, taxes, valuation, commercialization, financing, leasing and property administration. Candidates need at least one year of real estate experience. The official temario still uses Distrito Federal-era names, so these questions apply current Mexico City rules, such as the 2024 cap on annual rent increases. The official materials and exam are in Spanish; this bank is an English-language multiple-choice study adaptation that keeps the Spanish legal terms, not an official translation or a simulation of the exam.

AMPI PIC: Suggested Study Strategy

1The temario is written for the former Distrito Federal: study today's Mexico City rules, including the 28 August 2024 reform that caps annual rent increases at the previous year's inflation.
2Know the ISR home-sale exemption in Article 93, section XIX(a), of the LISR: up to 700,000 UDIs, formalized before a fedatario público, and not used for another home sale in the prior three years.
3Practice the valuation and financing calculations the temario lists: straight-line and Ross-Heidecke depreciation, income capitalization, present value, TIR and level-payment amortization.
4Learn Mexico City's condominium rules: quarterly ordinary assemblies, 75% attendance on the first call, fees by indiviso, and the executive title for unpaid fees under Article 59.
5Review foreign acquisitions: the 100 km border and 50 km coastal restricted zone, bank trusts of up to 50 extendable years, and the Calvo-clause agreement and SRE permit outside the zone.

Frequently Asked Questions

What is the AMPI PIC certification?

The Profesional Inmobiliario Certificado (PIC) is a certification that AMPI Ciudad de México has granted since 2003. It is earned by passing an online exam on nine basic areas of knowledge for real estate advisors, and AMPI CDMX says two external companies oversee the process's transparency.

What are the requirements to take the PIC?

The AMPI CDMX temario asks for at least one year of experience in real estate activity, an application, a CV describing that experience, copies of the RFC, CURP and voter credential or passport, and photographs. The original official ID must be brought on exam day.

How much does the PIC cost in 2026, and how many attempts are included?

AMPI CDMX's September 2026 PIC program lists MXN 3,900 for associates, MXN 4,200 for convenio members and MXN 4,500 for the general public, delivered in three 3-hour sessions via Zoom. AMPI CDMX states that candidates have two opportunities to pass the exam.

Does AMPI publish the number of questions, time limit or passing score?

No. AMPI CDMX describes an online exam on nine areas but does not publish an item count, a time limit or a passing score, and it gives no weighting between the areas.

Is this OpenExamPrep bank an official AMPI exam?

No. It is independent practice by OpenExamPrep in English, built from the public AMPI CDMX temario and current Mexico City and federal law. It is an English-language multiple-choice study adaptation, not an official translation or a simulation of the Spanish-language exam, and it is not affiliated with or endorsed by AMPI.
