1Under Austrian civil procedure (Zivilprozessordnung — ZPO), which fundamental procedural principle dictates that the parties alone determine the commencement, subject matter, and termination of the civil proceedings?
A.Dispositionsmaxime (Principle of Party Disposition)
B.Untersuchungsgrundsatz (Offizialmaxime / Inquisitorial Principle)
C.Mündlichkeitsgrundsatz (Principle of Orality)
D.Unmittelbarkeitsgrundsatz (Principle of Immediacy)
Explanation: The Dispositionsmaxime (§ 226, § 405 ZPO) establishes that civil proceedings are initiated only upon party petition (nemo iudex sine actore), the court cannot award more or anything other than requested (ne ultra petita), and the parties are free to settle, withdraw the claim, or waive rights at any time.
2Under § 49 of the Austrian Jurisdiktionsnorm (JN), what is the monetary threshold (Streitwertgrenze) distinguishing the subject-matter jurisdiction (sachliche Zuständigkeit) between the Bezirksgericht (District Court) and the Landesgericht (Regional Court) in civil litigations?
A.Claims up to and including €15,000 belong to the Bezirksgericht; claims exceeding €15,000 belong to the Landesgericht (unless specific Eigenzuständigkeit applies)
B.Claims up to and including €5,000 belong to the Bezirksgericht
C.Claims up to and including €50,000 belong to the Bezirksgericht
D.All civil claims regardless of value must start at the Landesgericht
Explanation: Under § 49 Abs. 1 JN, the standard monetary jurisdiction boundary (Wertzuständigkeit) assigns civil disputes with an amount in controversy up to and including €15,000 to the Bezirksgerichte. Claims exceeding €15,000 fall under the jurisdiction of the Landesgerichte in first instance, unless an exclusive subject-matter jurisdiction (Eigenzuständigkeit, e.g., family matters or tenancy law) applies.
3Under § 27 of the Austrian Zivilprozessordnung (ZPO), when is mandatory legal representation by an attorney-at-law (absolute Anwaltspflicht) required in Austrian civil litigation?
A.Before the Bezirksgerichte in matters whose value in dispute exceeds €5,000, and before all higher courts (Landesgericht, Oberlandesgericht, Oberster Gerichtshof)
B.Only in criminal jury trials where life imprisonment is threatened
C.Exclusively before the Constitutional Court (VfGH)
D.Only when both plaintiff and defendant are foreign corporate entities
Explanation: Under § 27 Abs. 1 ZPO, absolute Anwaltspflicht covers proceedings before the Bezirksgerichte where the value in dispute exceeds €5,000 and all proceedings before the higher courts. Do not confuse it with the relative Anwaltspflicht of § 29 Abs. 1 ZPO, which applies where representation is not compulsory at all: the party may then appear in person, but in Ehesachen and in matters exceeding €5,000 (at places with at least two resident attorneys) only an attorney may be appointed as representative.
4Under § 244 of the Austrian ZPO, what is the statutory monetary ceiling for the mandatory automated payment order procedure (Mahnverfahren) for monetary claims?
A.Monetary claims up to and including €75,000
B.Monetary claims up to and including €10,000
C.Monetary claims up to and including €150,000
D.All monetary claims regardless of amount
Explanation: Under § 244 Abs. 1 ZPO, the Mahnverfahren (issuance of a Zahlungsbefehl without prior oral hearing) is mandatory for pure monetary claims (Geldansprüche) up to and including €75,000, provided the claim is payable and the defendant's residence is not abroad or unknown.
5What is the statutory deadline and legal effect of an Einspruch (objection) filed by the defendant against a bedingter Zahlungsbefehl (conditional payment order) under § 248 ZPO?
A.The Einspruch must be filed within four weeks; a timely objection automatically sets aside the payment order and transitions the matter into ordinary trial proceedings
B.The Einspruch must be filed within 14 days and requires advance deposit of the disputed sum into court escrow
C.The Einspruch must be filed within three days and is decided exclusively in an administrative hearing
D.The Einspruch must be approved by the Supreme Court before the trial can open
Explanation: Under § 248 Abs. 2 ZPO the Einspruchsfrist is four weeks running from service of the written Zahlungsbefehl, and it cannot be extended. Under § 248 Abs. 1 ZPO the Einspruch must have the content of a Klagebeantwortung. A timely Einspruch removes the conditional payment order for the contested part and opens standard contentious civil proceedings.
6Under § 179 of the Austrian ZPO, until when may the parties bring new factual allegations and new evidence in first-instance civil proceedings, and on what condition may the court reject them?
A.Up to the close of the oral hearing; the court may reject the submission only if it was withheld through gross fault (grob schuldhaft) and admitting it would considerably delay the disposal of the case
B.Only up to the end of the preparatory hearing (vorbereitende Tagsatzung); anything later is automatically precluded and the court has no discretion
C.Only up to service of the statement of defence; the court may never admit later factual submissions
D.At any time up to the close of the hearing, and the court may never reject late submissions even if they delay the proceedings
Explanation: § 179 ZPO expressly allows the parties to bring new factual allegations and evidence relating to the subject matter of the hearing up to the close of the oral hearing. The court may reject such submissions — on application or ex officio — only if they were not made earlier through gross fault and if admitting them would considerably delay the disposal of the case; no separate appeal lies against that ruling. This discretionary preclusion is the sanction attached to the Prozessförderungspflicht in § 178 Abs. 2 ZPO. The strict Eventualmaxime, under which all attack and defence means must be raised at one fixed stage, does not govern ordinary Austrian civil proceedings.
7Under § 396 of the Austrian ZPO, under what circumstances may a Versäumungsurteil (default judgment) be entered against a party?
A.If the defendant fails to file a timely written statement of defense (Klagebeantwortung) when ordered, or if a party fails to appear at the preparatory hearing, upon application by the appearing party
B.Whenever the judge considers the plaintiff's arguments to be morally superior without hearing evidence
C.Automatically if the litigation lasts longer than six months
D.Only in maritime disputes involving foreign shipping vessels
Explanation: Under § 396 and § 398 ZPO, a default judgment (Versäumungsurteil) is rendered upon application if the defendant fails to submit a timely Klagebeantwortung (§ 396 ZPO in the written preliminary procedure) or fails to appear at the first hearing (Säumigkeit). The court assumes the factual assertions of the non-defaulting party to be true, unless they are manifestly impossible.
8Under § 482 of the Austrian ZPO, what is the Neuerungsverbot (prohibition of new allegations and evidence in appellate proceedings)?
A.In the Berufungsverfahren (appeal), parties are prohibited from introducing new factual allegations (neue Tatsachen) and new evidence (neue Beweismittel) that were not presented in the first-instance trial
B.Parties cannot hire new attorneys on appeal
C.The appellate court cannot cite newly published legal commentaries
D.The appellant cannot demand a reduction of the disputed sum
Explanation: Under § 482 ZPO, the Neuerungsverbot restricts the appellate court (Berufungsgericht) to reviewing the judgment based on the factual and evidentiary material existing at the close of the first-instance oral hearing (Schluss der mündlichen Verhandlung). New facts and evidence are inadmissible (nova reperta / nova producta), except in limited statutory exceptions.
9Under § 502 of the Austrian ZPO, what is the statutory prerequisite for the admissibility of an ordentliche Revision (ordinary second appeal) to the Austrian Supreme Court (Oberster Gerichtshof — OGH)?
A.The resolution of the legal dispute must depend on the solution of a substantial question of law (erhebliche Rechtsfrage) concerning legal unity, legal certainty, or legal development, and the dispute value must generally exceed €5,000
B.The plaintiff must prove that the first-instance judge was under 30 years old
C.The claim must exceed €1,000,000 in cash without any legal controversy
D.The appeal must be signed by the Federal Minister of Justice
Explanation: Under § 502 Abs. 1 ZPO, a Revision to the OGH is only admissible if the decision depends on an 'erhebliche Rechtsfrage' — meaning the appellate court departed from established OGH jurisprudence, such jurisprudence is lacking, or the existing rulings are inconsistent. Under § 502 Abs. 2 ZPO, if the amount in dispute does not exceed €5,000, a Revision is absolutely inadmissible (absolute Revisionsunzulässigkeit).
10Under § 1 of the Austrian Exekutionsordnung (EO), what is an Exekutionstitel (enforceable title)?
A.An official document endowed with legal authority (e.g., final court judgment, judicial settlement, enforceable payment order, enforceable notarial deed) confirming an enforceable claim
B.A private debt collection letter sent by a commercial credit agency
C.An unconfirmed invoice issued by an Austrian merchant
D.An informal email requesting refund of money
Explanation: Pursuant to § 1 EO, execution (enforcement) can only be granted on the basis of a recognized statutory Exekutionstitel, such as a final judgment (rechtskräftiges Urteil), a court settlement (gerichtlicher Vergleich), an enforceable payment order (Zahlungsbefehl), or an enforceable notarial deed (§ 1 Z 17 EO).

Rechtsanwaltsprüfung (RAP) Study Tips from Top Performers

1Master Austrian civil appellate procedure: understand the differences between Berufung, Revision (§ 502 ZPO erhebliche Rechtsfrage, with the €5,000 and €30,000 thresholds) and Rekurs.
2Know the remedies in Austrian criminal procedure: Einspruch wegen Rechtsverletzung (§ 106 StPO), the 48-hour judicial decision on Untersuchungshaft (§ 174 Abs. 1 StPO) and the Nichtigkeitsgründe of § 281 StPO.
3Drill the administrative-law paper: Bescheidbeschwerde to the Landesverwaltungsgericht or BVwG, Revision to the VwGH, and complaints and applications under Art. 139, 140 and 144 B-VG — § 13 Z 2 RAPG makes this a written subject in its own right, alongside tax law.
4Memorise the core professional rules: confidentiality (§ 9 RAO), the ban on representing conflicting interests (§ 10 RAO), the prohibition of the pactum de quota litis (§ 879 Abs. 2 Z 2 ABGB, § 16 Abs. 1 RAO), and the Einheitssatz of § 23 RATG at 60% up to a value in dispute of €10,170 and 50% above it.
5Know the examination statute itself: the four-member senate (§ 11 RAPG), the eight-hour design of the written papers (§ 15 RAPG), the result scheme of § 23 RAPG, and the repetition rules of § 25 RAPG.

Frequently Asked Questions

What is the Rechtsanwaltsprüfung (RAP) in Austria?

It is the statutory Austrian bar examination governed by the Rechtsanwaltsprüfungsgesetz (RAPG). Under § 1 RAPG it must show that the candidate has the skills and knowledge needed to practise as an attorney, including the ability to draft legal instruments and opinions. Passing it is one of the requirements for entry in the list of attorneys under § 1 Abs. 2 RAO.

How is the Austrian bar examination structured?

Three written papers under § 13 RAPG — one in civil law, one in administrative law including tax law, and one in criminal law — each set so that an averagely able candidate can solve it within eight hours (§ 15 RAPG). The oral examination follows no earlier than three weeks later before a four-member senate of two judicial commissioners and two attorneys (§ 11 RAPG) and should last about two hours per candidate (§ 18 Abs. 1 RAPG).

What does the Rechtsanwaltsprüfung cost, and how often can it be repeated?

The examination fee is €695 under the BMJ fee ordinance issued on the basis of § 28 Abs. 3 RAPG, payable to the competent Oberlandesgericht before the application for admission and payable again for each repetition. Under § 25 RAPG a failed candidate must wait between three and twelve months before sitting again, and the examination may be repeated twice — three attempts in total.

Is this practice bank in the same format as the real examination?

No. The real Rechtsanwaltsprüfung consists of written drafting papers and an oral senate examination in German, with no multiple-choice component. This bank is an English-language multiple-choice study adaptation of the statutory curriculum in §§ 13 and 20 RAPG, built to drill the underlying rules and judgments. It is not an official translation and cannot substitute for drafting practice or for oral examination preparation.
