1Under Austrian land register law (Grundbuchsrecht), which fundamental principle establishes that rights in rem (dingliche Rechte) over immovable property are acquired, modified, or extinguished exclusively upon entry in the main book (Hauptbuch)?
A.Eintragungsgrundsatz (Principle of Registration)
B.Vertrauensgrundsatz (Principle of Public Faith)
C.Prioritätsgrundsatz (Principle of Priority)
D.Spezialitätsgrundsatz (Principle of Specificity)
Explanation: Under § 431 ABGB and § 4 of the Grundbuchsgesetz (GBG), the Eintragungsgrundsatz (intabulation principle) dictates that property rights, mortgages, and other rights in rem in real estate can only be created, transferred, or extinguished through registration in the land register (Hauptbuch). Without entry, only an in personam obligatory claim exists against the transferor.
2Which type of land register entry (Grundbuchseintragung) creates, transfers, or extinguishes a right in rem unconditionally and definitively?
A.Einverleibung (Intabulation)
B.Vormerkung (Pre-notation)
C.Anmerkung (Annotation)
D.Rangordnung (Priority Notice)
Explanation: An Einverleibung (§ 8 Z 1 GBG) is the unconditional, definitive acquisition or cancellation of a right in rem in the land register. It requires an unconditional registration clause (Aufsandungserklärung) executed in proper public or certified form.
3Under § 55 of the Austrian Grundbuchsgesetz (GBG), how long does an Anmerkung der Rangordnung für die beabsichtigte Veräußerung (priority notice for an intended sale, applied for under § 53 GBG) stay effective?
A.One year from the date of the land registry court's approval decision
B.Six months from the date of filing the application
C.Two years for commercial real estate transactions
D.Three months from the issuance of the certified resolution
Explanation: § 53 Abs. 1 GBG entitles the registered owner to apply for the Anmerkung so that the rank of the rights to be registered dates from the moment of that application. § 55 GBG then provides that the Anmerkung der Rangordnung loses its effect on expiry of one year after its Bewilligung, and the decision must state the calendar day on which that period ends.
4In Austrian notary practice, how many official certified copies (Rangordnungsbeschlüsse) of an approved priority notice for intended sale are issued by the land registry court to the registered owner?
A.Exactly one single original copy (Einzige Ausfertigung)
B.Two copies, one for the seller and one for the notary
C.Three copies, including one for the tax authority
D.As many copies as there are registered co-owners
Explanation: Under § 54 GBG only one Ausfertigung may be issued of the decision granting the Rangordnung application, and § 79 Abs. 1 last sentence GOG is expressly disapplied; the Ausfertigung must bear confirmation that the Anmerkung has been carried out. Because any later registration using that reserved rank requires physical production of this single document, control of the Ausfertigung is central to secure notarial escrow processing.
5Under § 364c ABGB, what formal requirement must be satisfied for a contractual prohibition of alienation or encumbrance (Veräußerungs- und Belastungsverbot) to be registered as a right in rem in the land register?
A.It must be established between spouses, registered partners, parents, or children, and entered in the land register
B.It can be established between any commercial parties provided it is executed as a notarial deed
C.It is valid against third parties automatically upon signature of a private written agreement
D.It requires court approval from the guardianship court in all instances
Explanation: Pursuant to § 364c ABGB, a prohibition against alienation or encumbrance binds third parties with in rem effect only if it is established between specific close relatives (spouses, registered partners, parents and children/grandchildren, or foster parents/children) and registered in the land register (C-sheet / Lastenblatt). Between unrelated parties, it produces only obligatory in personam effects.
6What is the legal nature of a Höchstbetragshypothek (maximum amount mortgage) under § 14 Abs. 2 of the Austrian Grundbuchsgesetz (GBG)?
A.A mortgage registered up to a specified maximum monetary ceiling that secures fluctuating claims arising from a specific legal relationship
B.A fixed-rate mortgage where the exact principal sum and all daily interest must be calculated in advance
C.A statutory judicial lien that arises automatically upon the filing of a civil enforcement petition
D.A mortgage that can only be granted to public credit institutions for residential social housing
Explanation: Under § 14 Abs. 2 GBG, a Höchstbetragshypothek secures claims up to a defined numerical maximum monetary ceiling arising from a specified underlying legal relationship (e.g., an ongoing credit facility, overdraft line, or warranty obligations). Individual advances and repayments within the facility do not require separate entries.
7Under the Austrian Wohnungseigentumsgesetz (WEG 2002), what is an Eigentümerpartnerschaft?
A.The joint ownership of a single condominium unit (Wohnungseigentumsobjekt) by exactly two natural persons
B.A partnership of all apartment owners in a building organized as an Offene Gesellschaft (OG)
C.A legal entity comprising the condominium property management company and the developer
D.A commercial joint venture between up to four co-owners of commercial business premises
Explanation: Under § 2 Abs. 10 and § 13 WEG 2002, an Eigentümerpartnerschaft is defined as the joint ownership of one single condominium property share by exactly two natural persons. Their shares in the minimum unit (Mindestanteil) are indivisible and connected as joint owners (je zur Hälfte).
8Under § 14 WEG 2002, what happens to the half-share of a deceased partner in an Eigentümerpartnerschaft upon their death?
A.The surviving partner acquires the deceased's half-share by operation of law (Anwachsung), subject to a potential statutory compensation payment (Übernahmspreis) to the estate
B.The deceased's share is automatically sold at public auction by the probate court
C.The share is transferred exclusively to the Austrian state as an escheat (heimfälliges Gut)
D.The surviving partner is evicted unless they hold a testamentary appointment as sole heir
Explanation: Pursuant to § 14 Abs. 1 WEG 2002, the deceased partner's half-share passes directly to the surviving partner by special statutory succession (Sonderrechtsnachfolge / Anwachsung). However, under § 14 Abs. 2 and 3 WEG 2002, the surviving partner must generally pay an Übernahmspreis (acquisition price) into the probate estate for the benefit of heirs and forced share claimants, unless specific exemptions (e.g., privileged spouse relief under § 14 Abs. 3) apply.
9Under the Austrian Baurechtsgesetz (BauRG), what is the statutory minimum and maximum duration for which a Baurecht (heritable building right) may be granted?
A.Not less than 10 years and not more than 100 years
B.Not less than 25 years and not more than 99 years
C.Not less than 5 years and not more than 50 years
D.Indefinite duration (in perpetuity) only
Explanation: According to § 3 Abs. 1 of the Baurechtsgesetz (BauRG), a Baurecht must be established for a fixed period of not less than 10 years and not more than 100 years. It cannot be granted for an indefinite duration.
10What is a Superädifikat (superstructure) under § 435 ABGB, and how is property ownership in a Superädifikat transferred?
A.A building erected on third-party land without the intention of remaining there permanently; ownership is transferred by document deposit (Urkundenhinterlegung)
B.A permanent building whose ownership is transferred exclusively by entry in the main land register book (Hauptbuch)
C.An underground mining facility whose title is held in the Bergbuch
D.A temporary agricultural crop transferred by physical handover of the harvest
Explanation: Under § 435 ABGB, a Superädifikat is a building constructed on third-party land with the intention that it not remain permanently (fehlende Belassungsabsicht). Because it is not an accession to the land (exception to superficies solo cedit), ownership and rights in rem are acquired through judicial document deposit (Urkundenhinterlegung) under the Urkundenhinterlegungsgesetz, rather than registration in the land register Hauptbuch.

About the Notariatsprüfung Exam

The Notariatsprüfung is the statutory professional examination required to qualify as a civil-law notary in Austria under the Notariatsprüfungsgesetz (NPG). Under § 1 NPG it must demonstrate the theoretical and practical knowledge and skills needed to practise as a notary. Administered by the examination commissions at the Higher Regional Courts, it covers succession and probate work as Gerichtskommissär, land register and property law, notarial Beurkundungsrecht, family and contract law, company and commercial law, tax law and notarial professional law.

Assessment

Erste Teilprüfung (after at least 18 months of candidate service): written tasks under § 13 Abs. 1 NPG — a deed from the notary's work as Gerichtskommissär, a testamentary disposition, a Wechselprotest and a further notarial certification, plus an appellate brief in Austrian land register law on the basis of court files — and an oral examination on the eight areas of § 20 Abs. 1 NPG. Zweite Teilprüfung (after passing Part 1 and at least one further year of service): written tasks under § 13 Abs. 2 NPG — a contract or other deed in Austrian civil law and one in company and commercial law with tax and tariff assessment and the applications needed for the public registers, the latter replaceable by a Firmenbuch appellate brief — and an oral examination on the seven areas of § 20 Abs. 2 NPG. Written tasks are set for eight hours (§ 15 NPG); statute editions, case collections and literature are provided but no Formbücher or precedent collections (§ 16 Abs. 1 NPG). Each oral part follows within four weeks and lasts about two hours per candidate (§ 18 Abs. 1 NPG).

Notariatsprüfung Study Tips from Top Performers

1Master the land register principles: the Eintragungsgrundsatz, the Vertrauensgrundsatz (§ 1500 ABGB, §§ 61 ff. GBG), the Prioritätsgrundsatz and the Spezialitätsgrundsatz reflected in §§ 12 and 14 GBG.
2Know the Rangordnung mechanics precisely: the application right in § 53 GBG, the single Ausfertigung rule in § 54 GBG, and the one-year expiry in § 55 GBG — these three sections are routinely confused.
3Understand the formal requirements for wills: holograph wills (§ 578 ABGB), allograph wills with three simultaneous witnesses and a handwritten nuncupatio (§ 579 ABGB), and the witness disqualifications of §§ 587 and 588 ABGB.
4Work through the 2017 Erbrechtsreform: the one-year point for demanding the Geldpflichtteil (§ 765 Abs. 2 ABGB), deferral under §§ 766 and 767 ABGB, and the two-year window for gifts to persons outside the forced-share circle (§ 782 ABGB).
5Know the notarial deed formalities: mandatory Notariatsakt cases under § 1 NotAktsG, the Aktszeugen triggers in § 56 Abs. 1 NO, the foreign-language rules in § 62 NO, and the enforceability conditions and the dwelling-eviction carve-out in § 3 NO.

Frequently Asked Questions

What is the Notariatsprüfung in Austria?

It is the statutory two-part professional examination governed by the Notariatsprüfungsgesetz (NPG). Under § 1 NPG it must demonstrate the theoretical and practical knowledge and skills needed to practise as a notary, and passing it is one of the requirements for appointment to a notarial office under § 6 Abs. 1 Z 5 NO.

How is the Notariatsprüfung structured?

It is divided into two Teilprüfungen, each with a written and an oral part (§ 2 Abs. 1 NPG). Part 1 can be taken after at least one year and six months of candidate service, Part 2 after passing Part 1 and at least one further year. Written tasks are set for eight hours (§ 15 NPG); each oral part follows within four weeks, lasts about two hours per candidate and is taken before a four-member senate of two judges and two notaries (§§ 11 and 18 NPG).

What does the Notariatsprüfung cost, and how often can it be repeated?

The fee is €480 for each Teilprüfung — €960 across both — as a Justizverwaltungsgebühr under the BMJ ordinance issued on the basis of § 28 Abs. 3 NPG, payable again for each repetition. Under § 25 NPG a failed candidate must wait between three and twelve months, and the Erste Teilprüfung may be repeated once while the Zweite Teilprüfung may be repeated twice.

What role does the notary play as Gerichtskommissär in Austria?

Austrian civil-law notaries act as Gerichtskommissäre under the Gerichtskommissärsgesetz and the Außerstreitgesetz for probate proceedings. The notary conducts the Todesfallaufnahme, queries the Österreichisches Zentrales Testamentsregister, identifies the heirs, takes their declarations of inheritance, prepares the inventory where one is required and drafts the material for the judicial Einantwortung. Falllösung in that role is expressly the first oral subject of Part 1 (§ 20 Abs. 1 Z 1 NPG).

Is this practice bank in the same format as the real examination?

No. The real Notariatsprüfung consists of written deed-drafting tasks and oral senate examinations in German, with no multiple-choice component. This bank is an English-language multiple-choice study adaptation of the statutory curriculum in §§ 13 and 20 NPG. It is not an official translation and cannot substitute for practising deed drafting or the oral examination.
