The purpose of the FAIS Act and subordinate legislation, key definitions (financial product, financial service, advice versus intermediary service), the roles of FSPs, key individuals, representatives and compliance officers, authorisation and the role of the FSCA.
General duties of providers, disclosure to clients about the FSP, product and representative, suitability of advice and the financial needs analysis, the record of advice, advertising and direct marketing, and termination of agreements.
Honesty, integrity and good standing; competence (experience, qualifications, regulatory exams, class of business and product training, and continuous professional development); operational ability; and financial soundness.
