2.1 Personal & Commercial Auto Liability

Key Takeaways

  • Auto liability pays covered third-party damages for which an insured is legally responsible, subject to defenses and limits.
  • Collision and other-than-collision are first-party physical-damage coverages, not liability coverages.
  • A business auto policy uses covered-auto symbols to show which autos qualify for a particular coverage.
  • Public-adjuster exam knowledge of auto liability does not expand Chapter 4102 authority beyond insured property claims.

Auto Liability in a Public-Adjuster Exam

Auto liability appears in the official outline even though public insurance adjusting centers on first-party property claims. The exam expects product literacy and careful role boundaries.

Personal auto structure

The liability part of a personal auto policy responds when an insured becomes legally responsible for covered bodily injury or property damage arising from ownership, maintenance, or use of a covered auto. The insurer investigates, defends covered suits, and pays covered damages up to the applicable limit.

Key distinctions:

  • Bodily injury liability concerns physical injury to another person.
  • Property damage liability concerns damage to another person’s tangible property.
  • Medical payments can pay specified medical expenses without requiring proof that the insured was negligent.
  • Uninsured/underinsured motorist coverage protects covered persons when an at-fault motorist lacks adequate insurance, subject to the policy and Texas requirements.
  • Damage to your auto is first-party property coverage and is separate from liability.

Collision generally covers upset of the covered auto or impact with another vehicle or object. Other-than-collision, traditionally called comprehensive, addresses listed noncollision causes such as theft, glass breakage, fire, flood, hail, vandalism, or contact with an animal, subject to wording and deductible.

Liability analysis

Liability requires more than an accident. Ask:

  1. Does the person qualify as an insured?
  2. Did covered ownership, maintenance, or use cause the injury or damage?
  3. Is the insured legally liable under negligence or another applicable theory?
  4. Does an exclusion apply, such as intentional injury or certain business use?
  5. What per-person, per-accident, or combined limit applies?

An insurer’s duty to defend can be broader than its ultimate duty to indemnify, but both are controlled by policy language and applicable law.

Commercial auto structure

The Business Auto Coverage Form uses numerical covered-auto symbols. The symbol next to each coverage determines the eligible vehicles. Examples include any auto, owned autos, hired autos, and nonowned autos. A vehicle can be covered for liability but not physical damage, or the reverse, depending on the declarations.

Commercial auto liability covers sums an insured legally must pay for covered bodily injury or property damage caused by an accident and resulting from ownership, maintenance, or use of a covered auto. Important commercial issues include:

  • employee use of personal autos for business;
  • hired vehicles rented or borrowed by the business;
  • loading and unloading;
  • trailer status;
  • fellow-employee and workers’ compensation exclusions;
  • pollution and mobile-equipment distinctions;
  • permissive users and the named insured’s responsibilities.

Physical damage is again separate. Collision and specified causes or comprehensive-type coverage apply only if selected for the involved covered auto.

Public-adjuster boundary

Texas Insurance Code §4102.101 authorizes a public adjuster to adjust, on behalf of an insured, fire and allied, burglary, flood, and other real- and personal-property claims, including loss of income. That role is not a license to settle an injured third party’s tort claim or give legal advice. A public adjuster might assist an insured with first-party damage to a scheduled commercial vehicle when the license and policy permit, but must not cross into attorney-only work.

Scenario

A delivery employee negligently backs a covered company van into a customer’s loading door, damaging both the door and the van. The customer’s door is analyzed under commercial auto property damage liability. Damage to the company van is a first-party physical damage question and requires the appropriate covered-auto symbol and selected collision coverage. The two losses may have different deductibles, defenses, and limits.

On the exam, reject choices that call every auto payment “liability.” Identify whose property or body was harmed, whose policy is responding, and whether the claim is first-party or third-party.

Separate liability from first-party property coverage

An auto accident can create several claims, so identify whose policy and whose property are involved. Liability coverage responds when an insured is legally responsible to another person, subject to the policy. Collision and other-than-collision coverage are first-party physical-damage coverages for a covered auto. Uninsured or underinsured motorists coverage addresses specified losses caused by drivers without adequate insurance. Medical payments and personal injury protection address injury-related benefits, not the cost to repair the vehicle.

For a commercial risk, also ask which autos are designated by the coverage symbols and whether the claimant is an insured for the coverage invoked. A delivery van owned by the business, an employee’s car used on an errand, and a temporarily borrowed replacement vehicle may not occupy the same coverage category. In a total-loss dispute, confirm vehicle identity, options, condition, mileage, comparable vehicles, taxes or fees required by the policy or law, deductible, and salvage treatment. Public-adjuster authority is centered on insured property claims; a demand for a third party’s bodily injury is not transformed into public adjusting merely because the same collision damaged a car.
