2.2 Required Skin Care Shop Equipment & Facility Rules
Key Takeaways
- Rule 0440-02-.07(2) lists thirteen items every Tennessee skin care shop must have, including a hands-free magnifying lamp, an electric hot towel cabin, a facial steamer and a wax depilatory heater pot.
- The wax heater must carry the manufacturer's intended commercial use statement; consumer-grade pots do not satisfy the rule.
- Aesthetics may be practised only in rooms that are adequately lighted and ventilated, and floors must be swept or mopped each day.
- Tanning beds, massage therapy and tattooing cannot share space with a skin care shop unless they are in a separate room with hard walls.
- The executive director may waive equipment requirements for shops offering limited services, but only on a written application identifying each omitted item.
A List You Can Be Quizzed On Item by Item
Most states describe salon equipment in general terms. Tennessee does not. Rule 0440-02-.07(2) enumerates exactly what a skin care shop must be equipped with, and both the Tennessee licensing block on the theory examination and a real inspector work down that list. Memorise it as a list, because that is how it is tested.
The Thirteen Required Items for a Skin Care Shop
| # | Required equipment | Why the rule cares |
|---|---|---|
| 1 | One sink providing hot and cold running water in the work area, excluding the bathroom | Hand hygiene must be possible without leaving the treatment area |
| 2 | One hands-free magnifying lamp | Skin analysis requires magnification with both hands free |
| 3 | One enclosed and labeled storage area for clean towels | Prevents recontamination of laundered linens |
| 4 | One covered and labeled container for soiled towels | Contains contaminated linen |
| 5 | One covered and labeled trash container maintained in a sanitary condition | Contains single-use waste |
| 6 | One reclining facial chair/table | The treatment platform for facial services |
| 7 | One wet disinfectant | The immersion container required by Rule 0440-02-.13(2) |
| 8 | One ultraviolet sanitizer | Tennessee's named dry storage device |
| 9 | One first aid kit | Required for exposure incidents and client injury |
| 10 | A minimum of one working restroom | Basic facility requirement |
| 11 | One electric hot towel cabin | Safe, controlled heating of towels |
| 12 | One facial steamer | Softening and hydration during facials |
| 13 | One wax depilatory heater pot with manufacturer's intended commercial use statement | Consumer-grade warmers are not permitted |
Three of these are the ones candidates get wrong.
"Hands-free" magnifying lamp. The rule specifies hands-free, meaning a lamp mounted on an arm, clamp or rolling stand — not a handheld loupe. An esthetician performing analysis needs both hands available to move the skin.
"Electric" hot towel cabin. The rule names an electric hot towel cabin specifically. Combined with Rule 0440-02-.13(6)(c), which prohibits dipping a previously used towel into a container of hot water and using it on a patron, Tennessee has effectively closed the improvised-hot-towel loophole from both directions.
Wax pot with a commercial-use statement. This is unusually specific and is exactly the kind of detail a licensing block likes. The heater must carry the manufacturer's intended commercial use statement. A household or consumer wax warmer, however new and clean, does not satisfy Rule 0440-02-.07(2)(m).
Equipment rules that apply to every shop type
Rule 0440-02-.07(5) adds three universal requirements:
- Every shop must contain sufficient equipment to perform all services offered competently and efficiently.
- All equipment must be in working order. A broken steamer sitting in the corner is a finding.
- All containers for cosmetic and any other products must be properly labeled. This includes decanted products, mixed disinfectant solutions and anything transferred out of its original packaging.
Facility Rules
Rule 0440-02-.06 is brief and heavily tested:
- Cosmetology, manicuring, aesthetics and natural hair styling may be practised only in rooms which are adequately lighted and ventilated.
- Floors shall be thoroughly swept or mopped each day. All hair cuttings, nail dust and nail tips shall be removed from the floor promptly after completion of each customer — not at close of business.
- Tanning beds, massage therapy and tattooing shops cannot be located in a cosmetology, skin care, manicuring, or manicure/skin care shop unless it is in a separate room with hard walls.
That third clause matters commercially. A day spa that wants to add tanning or massage cannot simply curtain off a corner. "Hard walls" means a genuinely separate room.
Location and premises rules
| Rule | Requirement |
|---|---|
| 0440-02-.07(6) | Residential shops must have a separate entrance that does not require passage through any part of a private residence, and separate restroom facilities apart from the living quarters. |
| 0440-02-.07(7) | A shop in a mobile home or mobile unit is not approved unless placed on a permanent foundation or otherwise rendered immobile — unless it is licensed as a mobile shop. |
| 0440-02-.07(8) | A shop must have a separate entrance from any other business, except in malls, strip shopping centres, or other commercial property approved by the Board. |
| 0440-02-.07(9) | The Board may approve a shop without a restroom inside it if it sits in a mall or shopping centre and the owner can demonstrate that shared public restrooms are standard for the location. |
Animals
Rule 0440-02-.10 defers to statute, and T.C.A. § 62-4-137 is categorical: no animals, except service animals, fish for decorative purposes, and birds in cages, shall be permitted in any shop. Bird cages must be cleaned daily, and departmental inspectors are directed to ensure cages are cleaned sufficiently to prevent any hazard to human health.
Apply that to a service question and the answer follows: a treatment that uses live fish on a client — a so-called fish pedicure — is not "fish for decorative purposes," so it does not fit the narrow exception the statute allows. A spa cat, a shop dog, or an emotional-support animal that is not a service animal is likewise outside the exception.
The Limited-Services Waiver
Rule 0440-02-.18, added effective January 14, 2024, gives small operators a route. The executive director to the Board may, in his or her discretion, waive one or more of the equipment requirements to accommodate shops offering limited services. The conditions are strict:
- The request must be in writing, on forms prescribed by the Board.
- It must specifically identify the equipment the applicant wants to omit and the reasons that equipment is unnecessary for the limited services provided.
- If the services offered later change, the applicant must complete a new application and receive a new inspection.
- A waived shop must still meet all other requirements of Chapter 0440-02 and pay the fees in Rule 0440-01-.13.
So a brow-and-lash studio that performs no facials may be able to omit the facial steamer — but only with a granted written waiver on file. The waiver is never implied by the nature of the business.
