Scope Review and Business Disputes

The Executive Director, COPE chair, and staff liaison may decline to send a complaint to the full Committee if it states no ground on which COPE may recommend action or lies outside COPE's authority. The complainant receives written reasons, and the full Committee reviews those screening decisions at its regular meetings.

If a matter presents purely business-practice issues, or a mix of ethics and business-practice issues as COPE determines, it is referred first to alternative dispute resolution for the issues outside the Committee's scope. After the business issue is resolved, an ethics complaint may be filed. Notice, Response, and Investigation

Outcomes and Board Authority

COPE prepares a written decision with findings and conclusions. It may issue a cautionary letter, warning, or statement of advice, assign one or more ethics seminars case by case, or order a reprimand. It may recommend that the Board suspend membership for up to one year or expel the member. Certification revocation likewise requires Board action.

A decision to suspend or expel membership or revoke certification does not take effect unless sustained by the Board under the Constitution and Bylaws. That Board decision requires a two-thirds vote at a meeting with a quorum. The current procedure does not list censure or a two-year COPE suspension; those were defects in the earlier draft.

COPE informs the parties of status within 90 days after receiving the case from the Executive Director. If it holds a hearing, it renders a decision within 60 days after the hearing ends. Related civil, criminal, or administrative proceedings may justify pausing the case for fairness or due process.

Appeal

Either party may file a written appeal to the Board within 30 days from the decision-notification letter, specifying why the decision is erroneous and should be revised. Other parties have 15 days from notice of the appeal to respond. The Board may decide on the documents, allow oral argument, affirm, reverse, modify, or return the matter to COPE for further review. Without a timely appeal, the COPE decision becomes final, subject to the required Board approval for suspension, expulsion, or certification revocation.
