The Florida Dental Laws and Rules Examination

Every applicant for a Florida dental licence must pass a jurisprudence examination in addition to the national and clinical examinations. Section 466.006(4)(a), F.S., makes a written examination on the laws and rules of the state regulating the practice of dentistry a licensure requirement, and s. 466.007(4)(a) does the same for dental hygienists. (Older study material cites "s. 466.006(4)(b)3." for the written examination; the 2024 amendments in chs. 2024-211 and 2024-243, Laws of Florida, restructured subsection (4), and paragraph (b) now deals only with the clinical examination.) The Department of Health has contracted the administration of that examination to the American Board of Dental Examiners (ADEX) working through the Commission on Dental Competency Assessments (CDCA). Candidates register at adextesting.org and test at a computer-based testing centre.

Two separate examinations

A recurring source of confusion — and a common way to memorise the wrong number — is that Florida runs two laws-and-rules examinations that share a format but not their statistics.

The field-test items are unscored questions the testing agency is trialling for future forms. Because up to five of the items on your form do not count, the scored item pool is smaller than the item count you see on screen, and you cannot tell which questions are which. Treat every item as scored.

Note the wording of the passing standard carefully. ADEX describes the requirement as a final score of 75% or higher. Florida does not publish a scaled score, a scaled cut point, or a percentile for this examination — if an answer option offers you a "scaled score of 75," that phrasing is not how the requirement is written.

The three bodies of law you are tested on

The examination is unusual among licensure examinations because its content outline is, quite literally, a reading list. ADEX publishes the reference material rather than percentage weights, and the Board of Dentistry directs content questions to itself rather than to the testing agency. There is no published domain-weight blueprint for the FDLR. What is published is this:

The Board's own compilation — Chapter 466, Florida Statutes; Rules 64B5 and 64B27, Florida Administrative Code — is the single best study document and is posted free at floridasdentistry.gov. The edition in circulation is Revised 07/2023. Because laws and rules change between reprints, the Board warns explicitly that "laws and rules are subject to change at any time"; verify anything time-sensitive against flsenate.gov and flrules.org.

How statutes and rules relate

A statute is enacted by the Legislature. A rule is adopted by the Board under authority the Legislature delegated to it, and it has the force of law only so long as it stays within that delegated authority. Two practical consequences show up repeatedly on the examination:

1. A rule can be more demanding than the statute it implements, but not less. Section 466.003(10), F.S., defines indirect supervision as the dentist authorising the procedure and being on the premises. Rule 64B5-16.001(5), F.A.C., adds that the dentist must also examine the patient and diagnose the condition. Both are current law; the rule controls day-to-day practice.
2. A repealed rule is not law. Several 64B5 rules that once appeared in commercial review courses have been repealed — 64B5-4.004 (Advertising Specialty Services) in 2010 and 64B5-16.007 (Levels of Supervision for Dental Hygienists) in 2018 are the two most frequently mis-cited. Repealed rules retain their numbers in the code with a repeal notation, which is why stale study material keeps quoting them.

Reading a citation

Florida citations are precise, and the examination rewards precision. Section 466.024(2)(f)2., F.S. means chapter 466, section .024, subsection (2), paragraph (f), subparagraph 2. Rule 64B5-25.003(9), F.A.C. means rule chapter 64B5-25, rule .003, subsection (9). When a question and an answer option differ only by a subsection number, the subsection is the point of the question.
