8.3 Current OPCFs, Facility Association & O.A.P. 1 Statutory Conditions
Key Takeaways
- The blueprint expressly identifies OPCFs 5, 16, 17, 19, 19A, 20, 23A, 27, 28, 28A, 39, 40, 43, 44, 47, and 49, plus awareness of conviction-protector products.
- OPCF 47R implements optional accident-benefit coverage and priority choices under the July 2026 reform; OPCF 49 records an election not to recover under DCPD.
- The current O.A.P. 1 statutory conditions are numbered 1 through 13 and also contain condition 10.1 on deductible amounts; termination is condition 11, not condition 9.
- For ordinary insurer cancellation other than non-payment, notice is at least 15 days by registered mail or 5 days by personal delivery, prepaid courier, or consented electronic delivery.
- Facility Association is the residual-market mechanism for eligible motorists who cannot obtain required auto insurance in the voluntary market.
Endorsements change the base policy
An Ontario Policy Change Form (OPCF) changes the O.A.P. 1 for a defined purpose. The correct exam habit is to identify the problem the endorsement solves, then check the current form for scope, insureds, limits, conditions, and exclusions. Do not rely on a customary dollar limit because the certificate or endorsement may show a different amount.
Blueprint endorsement map
| Form | Study purpose |
|---|---|
| OPCF 5 | Permission to rent or lease the automobile and coverage for the specified lessee |
| OPCF 16 / 17 | Suspension and reinstatement of coverage |
| OPCF 19 / 19A | Limiting the amount paid for loss or damage, or agreeing on value as the form provides |
| OPCF 20 | Transportation replacement or loss-of-use expenses after an insured loss |
| OPCF 23A | Protection of a lienholder's interest |
| OPCF 27 | Liability for damage to specified types of non-owned automobiles, subject to the form and shown limits |
| OPCF 28 / 28A | Reduced coverage for a named person or exclusion of a named driver |
| OPCF 39 | Accident-rating protection as described in the approved form |
| OPCF 40 | A deductible for specified fire losses |
| OPCF 43 | Removal of depreciation deduction for an eligible automobile |
| OPCF 44R | Family protection where an inadequately insured motorist causes qualifying injury or death |
| OPCF 47R | Optional accident benefits and priority of payment after the July 2026 reform |
| OPCF 49 | Agreement not to recover loss or damage under DCPD |
"Conviction protector" is also named in the competency profile, but candidates should treat it as an insurer product and read its wording rather than assume an identical provincial form or promise.
Facility Association
Facility Association supports availability of compulsory automobile insurance for eligible risks unable to obtain coverage in the voluntary market. All participating insurers share the mechanism under its plan of operation. Coverage remains an O.A.P. 1 contract, but premium and payment terms can reflect the high-risk classification. A broker should document voluntary-market efforts and explain that Facility Association is a residual market, not a government subsidy or guaranteed low-price option.
Current statutory-condition sequence
The OAP1-EN.3 (2026) wording prints conditions numbered 1 through 13, with an additional 10.1 deductible provision:
- Material Change in Risk
- Incorrect Classification, including premium correction rules
- Monthly Payments
- Authority to Drive and Prohibited Use
- Requirements Where Loss or Damage to Persons or Property
- Requirements Where Loss or Damage to the Automobile, including proof, examination, valuation, repair, and salvage provisions
- Time Limit for notice under conditions 5 and 6
- Inspection of Automobile
- Time and Manner of Payment of Insurance Money
- Who May Give Notice and Proofs of Claim 10.1 Deductible Amounts
- Termination
- Notice
- Statutory Accident Benefits Protected
Older notes that teach "10 automobile statutory conditions" or call termination condition 9 are obsolete for the current form.
Termination under condition 11
For cancellation by the insurer for a reason other than ordinary non-payment, the effective date is no earlier than:
- the 15th day after the insurer gives notice by registered mail; or
- the 5th day after notice by personal delivery, prepaid courier, or electronic means where the insured consented to electronic delivery.
For non-payment, the ordinary notice periods are longer: no earlier than the 30th day for registered mail or the 10th day for the other permitted methods, together with the cure information required by the condition. After two earlier non-payment notices in the same term that were cured, the condition permits the shorter 15/5-day framework for another non-payment.
The current wording deems registered-mail notice given on the day after mailing. Its plain-language section explains that the 15-day period starts on the second day after mailing. Do not calculate from the day a card arrives at the destination post office.
Claims duties
Conditions 5 through 10 organize post-loss duties. Notice under conditions 5 and 6 is due within seven days or, if incapacity prevents that, as soon as possible. Damage to the automobile requires protection from further loss and a statutory declaration within 90 days. The insurer receives reasonable inspection rights, and condition 9 establishes payment timing after proof of loss or appraisal.
Condition 13 preserves entitlement to SABS despite failure to comply with the other statutory conditions. That protection does not guarantee every claimed benefit; the claimant still must meet the SABS terms.
