Licensed customs brokers must employ at least two of them (Art. 67.1.3), and specialists are re-examined every 2 years (Art. 68.2). The official procedure and training are in Mongolian; this free bank is an independent English-language MCQ study adaptation, not a simulation of the CGA exam.

Sample Customs Registered Specialist Practice Questions

1Under Article 67.1.3 of the Customs Law of Mongolia, what is the mandatory minimum number of Customs Registered Specialists that a legal entity must employ to engage in customs broker activities?
A.At least two registered specialists
B.At least one registered specialist
C.At least three registered specialists
D.At least five registered specialists
Explanation: Article 67.1 of the Customs Law lists the requirements for a legal entity that conducts customs broker activity: no tax arrears, adequate financial capacity, not fewer than two customs registered specialists (67.1.3), and a risk fund (67.1.4). Evidence that these requirements are met must be filed with the permit application under Article 70.2.1.
2Which authority is legally empowered under Article 66.2 of the Customs Law of Mongolia to grant the special permit (license) to operate as a customs broker?
A.The Chairman of the Customs General Administration
B.The member of the Government (Cabinet) in charge of customs matters
C.The Governor of the capital city or relevant aimag
D.The General Authority for State Registration
Explanation: Article 66.2 of the Customs Law provides that a Mongolian legal entity conducting customs broker activity must hold a permit, and that the permit is granted by the member of the Government in charge of customs matters. Article 66.4 prohibits transferring the permit to another person, while the customs central administrative body supervises broker and specialist activity (Article 67.3).
3Under Article 68.2 of the Customs Law of Mongolia, how often does the customs central administrative body examine customs registered specialists to assess their work and professional level?
A.Every 3 years, together with the renewal of the broker's permit
B.Every year, as part of the broker's annual report
C.Every 2 years
D.Every 5 years
Explanation: Article 68.2 requires the customs central administrative body to hold an examination every 2 years to evaluate each registered specialist's activity and professional level. The stakes are real: under Article 68.3.4 an unsatisfactory result in this examination voids the specialist's certificate.
4Which of the following is NOT a statutory ground under Article 68.3 of the Customs Law of Mongolia for revoking a Customs Registered Specialist certificate?
A.Obtaining an unsatisfactory grade in the biennial evaluation examination
B.Being convicted of a crime by a court judgment that has entered into legal force
C.Repeatedly violating customs legislation during clearance operations
D.Changing employer from one licensed customs broker to another licensed broker
Explanation: Article 68.3 lists four grounds on which a registered specialist's certificate is deemed invalid: a criminal conviction confirmed by a court judgment in force (68.3.1), repeated violation of customs legislation (68.3.2), obtaining the certificate with forged documents (68.3.3), and an unsatisfactory result in the biennial examination under Article 68.2 (68.3.4). Moving from one licensed broker to another is not among them.
5Article 11.21.14 of the Law on Infringements fines a customs broker or declarant that violates customs legislation or exceeds its legal powers. What additional consequence does the article's note attach when a customs registered specialist commits this infringement repeatedly?
A.The specialist's rights are revoked, in addition to the penalty for the infringement
B.The specialist must repeat the initial training course but keeps the certificate
C.The broker's permit is automatically suspended for three months
D.The fine is doubled, but the specialist's rights are unaffected
Explanation: The note to Article 11.21 of the Law on Infringements says that a customs registered specialist who repeatedly commits the infringement in part 14 has his or her rights revoked, and is also penalised for the infringement. The Customs Law says the same in Article 292.1, so a repeated breach can end a specialist's career, not just cost money.
6According to Article 67.1.4 of the Customs Law of Mongolia, what financial safeguard must a customs broker establish to protect against potential non-payment of customs duties?
A.A statutory escrow account with the Bank of Mongolia holding at least 1 billion MNT
B.A risk fund established in an amount determined by the Chairman of the Customs General Administration
C.A mandatory commercial indemnity insurance policy covering up to 500 million MNT
D.A personal surety guarantee provided by the company's chief executive officer
Explanation: Article 67.1.4 of the Customs Law requires a broker to set up a risk fund (эрсдлийн сан) to protect against losses that may arise when it pays customs and other taxes, or guarantees their payment, on behalf of declarants. Under Article 67.2, the head of the customs central administrative body sets the amount to be held in the fund according to the volume of goods covered by the broker's services.
7Under Article 69.2.2 of the Customs Law of Mongolia, how must a licensed customs broker take part in customs operations?
A.Through any employee who holds a notarised power of attorney from the declarant
B.Through the declarant's own accountant, with the broker countersigning afterwards
C.Through its customs registered specialists
D.Through a customs inspector assigned to the broker by the customs office
Explanation: Article 69.2.2 obliges a customs broker to take part in customs operations through its customs registered specialists. Because the permit under Article 66.2 is granted only to a legal entity, and Article 67.1.3 requires at least two registered specialists, the specialist is the person who actually prepares and lodges declarations for the broker's clients.
8Article 10.6 of the WTO Trade Facilitation Agreement (TFA) deals with the use of customs brokers. What does Article 10.6.1 require of WTO members from the Agreement's entry into force?
A.Members must transfer tariff classification decisions to licensed private brokers
B.Members must require every import declaration to be lodged by a licensed broker
C.Members must adopt identical broker licensing fees and examination questions
D.Members shall not introduce the mandatory use of customs brokers
Explanation: TFA Article 10.6.1 states that, without prejudice to members that already give brokers a special role, members shall not introduce the mandatory use of customs brokers from the Agreement's entry into force (22 February 2017). Article 10.6.2 adds that members must notify and publish their measures on the use of brokers. Mongolia's law fits this model: Customs Law Article 66.1 says clearance may (not must) be performed through a broker under contract.
9Which of the following is a duty that Article 69.2 of the Customs Law of Mongolia places on a customs broker?
A.Not disclosing the declarant's confidential information or using it unlawfully
B.Issuing binding advance classification rulings to its clients
C.Collecting customs duties into the broker's own account before paying the state
D.Guaranteeing clients that their goods will not be physically inspected
Explanation: Article 69.2 lists the broker's duties in addition to the declarant's duties under Article 57.2. They include signing a contract with the declarant (69.2.1), acting through registered specialists (69.2.2), keeping records and reporting (69.2.3), reporting changes to permit information (69.2.4), keeping the declarant's secrets and not using them unlawfully (69.2.5), and giving customs information on goods 10 days before they cross the border (69.2.6).
10Article 69.2 of the Customs Law says a customs broker bears duties "in addition to those in Article 57.2". What does that incorporation mean for the broker's responsibility when it lodges a declaration for a client?
A.The broker only transcribes data and bears no responsibility for what the client supplies
B.The broker is responsible for the accuracy of the information declared and for paying the customs and other taxes or providing a guarantee of payment
C.The broker's involvement releases the importer from any obligation under the Customs Law
D.The broker becomes responsible only if the importer cannot be located after release
Explanation: Article 57.2.1 makes a declarant responsible for the accuracy of the information given in the declaration and for paying customs and other taxes or providing a payment guarantee. Article 69.2 applies the Article 57.2 duties to the broker as well, so a broker that lodges a declaration answers for its accuracy. The broker's risk fund under Article 67.1.4 exists to cover losses when it pays or guarantees taxes for declarants.
