Sample Social Insurance and Labor Consultant Examination Practice Questions

Try these sample questions to review concepts for the Social Insurance and Labor Consultant Examination exam. Each question includes a detailed explanation. Start the interactive quiz above for the full 101+ question experience with AI tutoring.

1Under Labor Standards Act (労働基準法) Article 32, what is the statutory working-hour limit for an adult employee, aside from a lawful variance system or overtime agreement?
A.7 hours per day and 35 hours per week
B.8 hours per day with no weekly cap
C.9 hours per day and 45 hours per week
D.8 hours per day and 40 hours per week
Explanation: Article 32 sets statutory hours at 8 hours in one day and 40 hours in one week, excluding rest periods. Time beyond those limits needs a 36 agreement (or Article 33) and premium pay. Variance systems change how the 40-hour week is averaged; they do not repeal the statutory cap.
2Under Labor Standards Act Article 34, if daily working hours exceed 6 hours, the employer must give a rest period of at least how long during the workday?
A.15 minutes
B.30 minutes
C.45 minutes
D.90 minutes
Explanation: Article 34 requires at least 45 minutes of rest when working hours exceed 6 hours. If working hours exceed 8 hours, the rest period must be at least 1 hour. Rest is generally given in one block during work hours, not added after clock-out.
3A factory schedule is 9 hours of work in one day (excluding rest). Under Labor Standards Act Article 34, what is the minimum rest period that must be given during that day?
A.30 minutes
B.45 minutes
C.60 minutes
D.No rest is required if overtime premiums are paid
Explanation: When working hours exceed 8 hours, Article 34 requires at least 60 minutes of rest. Paying overtime premiums does not waive rest. The 45-minute rule is only the floor for work that exceeds 6 hours but does not exceed 8 hours.
4Labor Standards Act Article 35 requires the employer to give a worker at least which weekly rest pattern?
A.One rest day per calendar month
B.A rest day only after 40 hours have been worked
C.Saturday and Sunday every week
D.One rest day per week, or four rest days in four weeks
Explanation: Article 35 requires at least one rest day per week, or four rest days in four weeks. Saturday/Sunday weekends are common in work rules but are not the statutory formula. Rest days are not earned by completing 40 hours.
5Except for a disaster or similar Article 33 case, an employer who wants employees to work beyond statutory hours generally needs which document?
A.A notarized individual waiver from each employee
B.A prefectural minimum-wage council resolution
C.Only an oral instruction from the plant manager
D.A written labor-management agreement under Article 36 (36協定) filed with the Labor Standards Inspection Office
Explanation: Article 36 requires a written agreement with the majority union or majority worker representative, filed with the inspection office, before ordinary overtime or statutory-holiday work. Individual waivers and oral orders do not replace the 36 agreement. Minimum-wage councils do not authorize overtime.
6Under Labor Standards Act Article 37 and the implementing cabinet order, the ordinary premium for statutory overtime (not yet over 60 hours in the month, and not at night or on a statutory holiday) is at least:
A.25 percent
B.10 percent
C.35 percent
D.50 percent
Explanation: Ordinary statutory overtime is paid at 25 percent or more of the usual hourly wage. Thirty-five percent is the statutory-holiday floor. Fifty percent is the floor for overtime hours that exceed 60 in a month, or the combined overtime-plus-night rate when both apply.
7The statutory premium for work on a Labor Standards Act holiday (法定休日) is at least:
A.35 percent
B.25 percent
C.50 percent
D.100 percent in lieu of the usual wage
Explanation: Article 37 and the cabinet order set a 35 percent floor for statutory-holiday work. Ordinary overtime is 25 percent. Work on a non-statutory prescribed holiday is generally treated as overtime, not as 法定休日 work. The holiday premium is added to the usual wage, not paid instead of it.
8Labor Standards Act Article 37's night-work window (unless the Minister designates another local window) is:
A.8:00 p.m. to 6:00 a.m.
B.Midnight to 8:00 a.m.
C.10:00 p.m. to 5:00 a.m.
D.9:00 p.m. to 7:00 a.m.
Explanation: Article 37(4) defines night work as 10:00 p.m. to 5:00 a.m. (or 11:00 p.m. to 6:00 a.m. only where the Minister so designates). Night work carries a 25 percent or higher premium, stacked on overtime or holiday premiums when those also apply.
9An employee's usual hourly wage is 2,000 yen. The employee works 3 hours of statutory overtime that also falls between 10:00 p.m. and 5:00 a.m. Monthly overtime is still under 60 hours. What is the minimum pay for those 3 hours under Article 37?
A.6,000 yen
B.7,500 yen
C.9,000 yen
D.10,500 yen
Explanation: Overtime (25 percent) and night work (25 percent) stack, so the minimum rate is 50 percent above the usual wage: 2,000 × 1.50 × 3 = 9,000 yen. Paying only the base 6,000 yen ignores both premiums. 7,500 yen is overtime without night. 10,500 yen would be a 75 percent premium, which is overtime-over-60 plus night, not this fact pattern.
10Usual hourly wage is 1,800 yen. An employee works 8 weekday overtime hours, all before 10:00 p.m., and monthly overtime stays under 60 hours. What is the minimum overtime pay for those 8 hours?
A.18,000 yen
B.14,400 yen
C.21,600 yen
D.27,000 yen
Explanation: Ordinary overtime is paid at 25 percent or more: 1,800 × 1.25 × 8 = 18,000 yen. 14,400 yen is the unpremiumed base (1,800 × 8). 21,600 yen would be a 50 percent premium. 27,000 yen would be a 87.5 percent premium and has no Article 37 basis here.

Social Insurance and Labor Consultant Examination: Suggested Study Strategy

1Use the official subject table: 徴収法 is 択一式 only (questions 8–10 of the workers' compensation and employment-insurance papers).
2Treat subject floors as seriously as the totals; a 2-point 選択式 miss can fail a high overall score.
3Cite article numbers only after opening e-Gov text as of the 58th cutoff (laws in force on 10 April 2026).
4Practice Japanese 選択式 blanks and 択一式 past papers separately; this English bank cannot replace that format.
5Confirm FY2026 yen figures (national-pension premium 17,920 yen, full old-age basic pension 70,608 yen/month for those born on or after 2 April 1956) from MHLW/Japan Pension Service, not from an older handbook.

Frequently Asked Questions

Who administers 社会保険労務士試験?

The Ministry of Health, Labour and Welfare decides who passes. The Japan Federation of Labor and Social Security Attorney's Associations Examination Center (全国社会保険労務士会連合会試験センター) runs applications and delivery. It is not a private prep-school exam.

What is the 58th sitting timetable?

Sunday 23 August 2026. 選択式 is 10:30–11:50 (80 minutes). 択一式 is 13:20–16:50 (210 minutes). Applications closed 31 May 2026. Results are scheduled for 1 October 2026.

Is the official exam an essay paper?

No. Both sessions are Japanese mark-sheet: 選択式 fill-in-the-blank selection (8 items / 40 points) and 択一式 five-option items (70 points). OpenExamPrep questions are independent English MCQs for the same statutes, not official 選択式 blanks.

How is the passing score set?

MHLW publishes overall and per-subject floors on results day. Missing any floor fails the sitting even with a high total. The 57th (FY2025) floors were 選択式 22/40 and 択一式 42/70, with some subject relief.

Does this bank replace Japanese past papers?

No. Official papers are Japanese. This is independent English MCQ study for concepts and calculations. It is not an official translation and not a substitute for writing the 58th sitting.
