About the Danish Trial Advocacy Exam (Retssagsprøven) Exam
Retssagsprøven is Denmark's practical trial-advocacy examination for prospective advocates. In a real case, the candidate independently conducts the approved court hearing and is assessed by the legal judge and censor, or by three legal judges; an organized fictive-case alternative is also available. Court language is Danish under Retsplejeloven § 149. This local bank is an English-language MCQ study adaptation: it is not an official translation or format simulation and cannot substitute for Danish oral advocacy, witness examination, procedural judgment, or live performance practice.
Assessment
The real-case route takes place during an approved hearing in a byret, landsret, or Sø- og Handelsretten. With one legal judge, an external censor also assesses; three legal judges assess without a separate censor. The performance is judged holistically against six official criteria.
Time Limit
Duration of the approved hearing; no fixed duration is published for a real-case exam.
Passing Score
Bestået / Ikke bestået based on a holistic assessment against six official criteria; no numerical cut score is published.
Exam Fee
DKK 5,500 for a real-case exam; the optional organized fictive-case route currently costs DKK 19,500. (Advokatsamfundet, Justitsministeriets Kursusudvalg, and the relevant Danish court)

Frequently Asked Questions
What is the official Retssagsprøven format?
It is a live practical assessment during an approved real court hearing or an officially organized fictive hearing. It has no written item count.
Must the written Advokateksamen be passed first?
No. Advokatsamfundet states that Retssagsprøven may be taken at any point in the training path without first completing the courses or passing the written examination.
How is the performance assessed?
The guideline lists six holistic criteria. A strong performance on one may offset weakness on another, and the assessors decide whether the candidate can responsibly conduct future court cases.
What cases are ordinarily excluded?
The guideline excludes Chapter 27 court mediation, Chapter 39 small-claims procedure, custody cases, and matrimonial cases other than marital-property division.
Does this bank simulate the official exam?
No. The official performance is in Danish. These English MCQs review rules and judgment but are not an official translation or a substitute for live oral and practical preparation.
